PC Res 2667RESOLUTION NO. 2667 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT ALLOWING THE APPROVAL OF A USE PERMIT TO ALLOW A NON-PROFIT VOCATIONAL TRAINING SCHOOL, ON PROPERTY KNOWN AS 90 EAST LATIMER AVENUE, APPLICATION OF MR. RAYMOD HESS, UP 90-04). After notification and public hearing as specified by law on the application of Mr. Raymond Hess for a Use Permit to allow a non-profit vocational training school, located on property known as 90 East Latimer Avenue, in a PF (Public Facilities) Zoning District, as per the application filed in the Planning Department on February 13, 1990; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: Health/Safety: The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Compatibility: The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. Traffic: The proposed site is adequately served by streets of sufficient capacity to carry the kind and quality of traffic such use would generate. Compatibility: area. The proposed use is compatible with the uses in the Compatibility: The use is essential or desirable to the public convenience or welfare, and is in harmony with the various elements or objectives of the City's General Plan. 6. The proposed use is surrounded by residential uses. The proposed use during the evening hours could disrupt the peace, comfort or general welfare of the residents. The proposed activities that occur outside the building could disturb the peace, comfort and general welfare of the surrounding residents unless operations are restrained within the building. Resolution No. 2667 adopted 3/27/90 by the Planning Commission page 2 Location: The proposed facility is located on the south side of Latimer Avenue approximately 400 feet east of Winchester and Latimer intersection. 10. Building: The building is a rectangular, single-story design of simple concrete block and exposed aggregate construction. 11. Parking: The site provides 62 parking spaces. Handicapped parking/access is not currently provided. The number of students per evening class will not exceed 15. Staff is comprised of six instructors/clerical employees, therefore parking is sufficient. 12. Landscaping: Due to the length of time the property has been vacant, landscaping on-site has deteriorated. The applicant has indicated that he will install additional landscaping and provide interior and exterior upgrading to the building, replanting the existing landscape area. The Site and Architectural Review Committee is recommending that 3 parking spaces be removed and replaced with landscaping. 13. Traffic: Due to the relatively low number of students, and staff members at the location each night, the proposed operation will not impact the existing traffic counts on Latimer Avenue and Winchester Boulevard. Additionally, classes average three hours in length, therefore, the amount of traffic generated to and from will be minimal. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: Landscaping/Irrigation/Lighting/Trash Enclosures: Landscaping plan indicating type and size of plant material, and location of irrigation system, lighting and trash enclosures shall be submitted to the Planning Department and approved by the Site and Architectural Review Committee and/or Planning Commission prior to issuance of a building permit. Performance Bond - Landscaping, Fencing, Striping: Applicant to either (1) post a faithful performance bond in the amount of $5,000 to insure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file written agreement to complete landscaping, fencing, and striping of parking areas. Bond or agreement to be filed with the Planning Department prior to application for a building permit. Parking/Driveways: Ail parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. Resolution No. 2667 adopted on 3/27/90 by the Planning Commission page 3 Siqninq: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). Trash Containers/Enclosures: Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. 7. Handicapped Requirement: Handicap access to building and restrooms must comply to minimum requirements. Hours of Operation: The hours of operation shall be between the hours of 7:00 a.m., and 6:00 p.m., on weekdays (Monday through Friday) and Saturdays. The applicant may operate from 7:00 a.m., to 10:00 p.m., up to three weekdays per week. Approved Use: Approval is granted to allow the operation of a non-profit vocational floor covering installation training program, in the former Post Office building consisting of 8500 sq. ft. 10. Six-month Review: The Planning Commission shall conduct an informal six-month review for the purpose of mitigating any problems that may arise. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
