PC Res 2651RESOLUTION NO. 2651 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING DENIAL OF A ZONE CHANGE FROM R-l-9 (SINGLE FAMILY RESIDENTIAL) TO PD (PLANNED DEVELOPMENT) FOR PROPERTY KNOWN AS 1253 HARRIET AVENUE AS SHOWN ON THE ATTACHED EXHIBIT (APPLICATION OF COSIMO AND ANGIE GIANCOLA; ZC 89-09). After notification and public hearing as specified by law on the proposed amendments to the Zoning Map of the City of Campbell, and after presentation by the Planning Director, proponents and opponents, the Planning Commission did determine that the change as shown in the attached Exhibit A should not be made to the Zoning Map based on the following findings: The proposed zone change is not consistent with the intent of the General Plan as delineated in the San Tomas Policy adopted by the City Council in 1980 and subsequently incorporated in the Land Use Element of the General Plan. 2. The proposed zoning does not comply with PD (Planned Development) Zoning District requirements. The Planning Commission of the City of Campbell recommends that the City Council make effective the recommendation of the Planning Commission and deny the requested Zone Change. Plannin~ Department The applicant shall recored a covenant limiting the allowable building area on each of the lots to a maximum of 35 percent of the net lot area. The form of the covenant shall be reviewed and approved by the City Attorney and recorded simultaneously with the filing of the final subdivision map on the subject property. The Planned Development Permit shall allow the subdivision of the subject property into three equal size lots as illustrated on the approved site plan. ORDINANCE NO. BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AMENDING TO ZONING MAP FROM R-l-9 (SINGLE- FAMILY RESIDENTIAL) TO PD (PLANNED DEVELOPMENT) FOR PROPERTY KNOWN AS 1253 HARRIET AVENUE. (APPLICATION OF COSIMO AND ANGIE GIANCOLA; ZC 89-09) The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended by adopting the attached Exhibit A entitled map of Said Property, as per the application of Cosimo and Angle Giancola for approval of a Zone Change for property known as 1253 Harriet Avenue. APN: 406-09-005, from R-l-9 (Single-Family Residential) to PD (Planned Development). SECTION TWO: This Ordinance shall become effective thirty days following its passage and adoption in the San Jose Mercury News, a newspaper of general circulation in the City of Campbell, County of Santa Clara. BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL, APPROVING A PLANNED DEVELOPMENT PERMIT AND CONDITIONS OF APPROVAL, TO ALLOW SUBDIVISION OF 3 LOTS ON PROPERTY KNOWN AS 1253 HARRIET AVENUE, APPLICATION OF GIANCOLA, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT, PD 89-22. The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended on property known as 1253 Harriet Avenue - APN: 403-10-069 and 072, by adopting the attached Exhibit A, entitled entitled Map of Said Property and Exhibit B, entitled Conditions of Approval, as per the application of Giancola to allow the subdivision of 3 lots, in a Planned Development Zoning District. Copies of Said Exhibits are on file in the Planning Department. SECTION TWO: This Ordinance shall become effective 30 (thirty) days following its passage and adoption and shall be published once within 15 (fifteen) days upon passage and adoption in the San Jose Mercury News, a newspaper of general circulation in the City of Campbell, County of Santa Clara, State of California.
