PC Res 2625RESOLUTION NO. 2625 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL DENYING APPROVAL OF A MODIFICATION TO A PREVIOUSLY APPROVED USE PERMIT TO ALLOW CONVERSION OF A 23 BED SENIOR HOUSING FACILITY TO A 19 BED RESIDENTIAL DRUG TREATMENT FACILITY FOR YOUTHS, ON PROPERTY KNOWN AS 531 NORTH CENTRAL AVENUE (APPLICATION OF MR. MARK STANFORD, ON BEHALF OF PATHWAY SOCIETY, INC., M 89-16). After notification and public hearing as specified by law on the application of Mr. Mark Stanford, on behalf of Pathway Society, Inc., for a Modification to a previously Use Permit to allow conversion of a 23 bed senior housing facility to a 19 bed residential drug treatment facility for youths on property known as 531 North Central Avenue, in a C-1-S (Neighborhood Commercial) Zoning District, as per the application filed in the Planning Department in August 1989; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: Health/Safety: The proposed use would operate as an unlocked facility, and has a limited number of overnight staff. As such, the establishment, maintenance or operation of the use may be detrimental to the health, safety, peace, morals, comfort or general welfare of person residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Site Size: The proposed site is not adequate in size and shape to accommodate the yards, parking and loading facilities, landscaping and other development features necessary to integrate said use with uses in the surrounding area. The parking provided does not meet the code requirements. The proposed use may generate conflicts with other uses in the area. Compatibility: The proposal is an institutional activity which by its nature must be separated and isolated from direct interface with the surrounding neighborhood. As such, it does not integrate with or enhance the integrity of the surrounding residential or commercial neighborhood. Traffic: The use will involve shift changes at intervals of six hours each, shuttling residents to school, guest speakers, and visitor traffic impacting the surrounding residential neighborhood and representing a significant intensification over the activity level of the previous residential use at this site. Based on the above findings, the Planning Commission denied the requested modification to the existing Use Permit. RESOLUTION NO. 2625 - 531 N. CENTRAL AVENUE DENYING M 89-16 The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
