OF THE CITY OF CAMPBELL APPROVING A USE PERMIT
ALLOWING THE ESTABLISHMENT OF A SEMI-PRIVATE
CLUB AND AN ON-SALE BEER/WINE LICENSE ON
PROPERTY KNOWN AS 440 MARATHON DR. IN A PD (PLANNED
DEVELOPMENT/COMMERCIAL) ZONING DISTRICT.
(APPLICATION OF N. NOVOTNY, UP 89-07).
After notification and public hearing as specified by law on the application of
Mr. Neal Novotny for a Use Permit and approval to allow the establishment of a
semi-private club and an on-sale beer/wine license on property known as 440
Marathon Drive in a PD (Planned Development/Com~nercial) Zoning District, as per
the application filed in the Planning Department on June 1, 1989; and, after
presentation by the Planning Director, proponents and opponents, the hearing
was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows:
1. The conditions of approval imposed on this application are intended to
reduce possible conflicts with neighboring uses.

The use permit is approved with a review by the Planning Commission after
six months and one year, thereby providing the City with adequate control
over the use.
3. The use permit is approved for the San Jose Rugby Football Club only, and
will not be open to the general public.
Based on the above findings, the Planning Commission does hereby grant the
requested Use Permit, subject to the following conditions:
PLANNING DEPARTMENT
1. The number of persons occupying the facility shall not exceed limits
established by the Fire Department.
2. Club functions shall take place completely within the building and not in
the parking area.
The Use Permit is approved for the San Jose Rugby Football (semi-private)
Club only, and not to the general public. Should the San Jose Rugby Club
vacate the premises, subsequent semi-private or private clubs must seek Use
Permit approval.
The Use Permit will be reviewed after six months and again at one year
from the date of occupancy.

Prior to establishing the use, applicant to provide evidence, satisfactory
to the City Attorney, that the applicant has the right to use parking on
adjacent parcels in the shopping center.

Hours of operation shall be restricted to weekdays from 8:00 p.m. to 11:00

8. Provide one hour corridor as shown on floor plan.
9. Provide illuminated exit signs as shown on plans.
10. Provide 20 minute rated fire doors as shown on plans.

11. Provide panic hardware on all exit doo~s from club to exterior.
12. Provide one hour occupancy walls between club and adjoining B-2 occupancy.
FIRE DEPARTMENT
13. The tenant space shall comply with all requirements of CAC Title 19 and
Title 24 as an ."A" occupancy.
14. Two remotely located exits are required.
15. Provide panic hardware on all exit doors serving the Seahawks clubhouse.
16. The corridor within the tenant space and the corridor extending to the
exterior of the building shall have walls and ceilings of one-hour
construction with all openings protected as required in CAC Title 24,
Section 33.05.(h).
The applicant is notified as part of this application that he/she is required
to comply with all applicable Codes and/or Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.

~nis letter will confirmthe City Council's action on September 5, 1989 to
ratify the decision of the Planning Ccmmlission to approve a Conditional
Use Permit to allow the establishment of a semi-private club andon-sale
beer/wine license at 440 Marathon Drive. As you are aware, this approval
was granted, subject to revision of Condition No. 4 to state:
The Use Permit is granted for a period of six months, and shall
automatically expire unless extended by the Planning comnission. If
extended, the Planning Ccmnission shall find that the club's facility
did not create a police problem or traffic spillover problem which
extended into the residential neighborhood."
A revised copy of Planning Commission Resolution ~622i~ enclosed for
your records.
