PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A USE PERMIT
ALLOWING THE APPROVAL OF A CONDITIONAL USE PERMIT
ON PROPERTY KNOWN AS 88 MILTON AVENUE (APPLICATION
OF R.E. FOXX, UP 89-10).
After notification and public hearing as specified by law on the application of
R. E. Foxx for a Use Permit and approval of a Conditional Use Permit on
property known as 88 Milton Avenue in a R-1 (Single-Family Residential) Zoning
District, as per the application filed in the Planning Department on August 10,
1989; and, after presentation by the Planning Director, proponents and
opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows:
1. Scale: The proposed project is an appropriate scale in relationship the
adjacent developed uses.
2. Parking: The provided parking meets the code requirements.

Health/Safety: The establishment, maintenance or operation of the use
applied for will not be detrimental to the health, safety, peace, morals,
comfort or general welfare of persons residing or working in the
neighborhood of such proposed use, or be detrimental or injurious to
property and improvements in the neighborhood or to the general welfare of
the City.
Compatibility: The use is essential or desirable to the public convenience
or welfare, and is in harmony with the various elements or objectives of
the City's General Plan.
Zoning Regulations and Compliance: The proposed site is adequate in size
and shape to accommodate the yards, walls, fences, parking, loading and
facilities, landscaping or other development features required in order to
integrate said uses with the uses in the surrounding area.
6. Compatibility: The use is compatible with uses in the area.

General Plan: The use is essential or desirable to the public convenience
or welfare and is in harmony with the various elements or objectives of the
City's General Plan.
Based on the above findings, the Planning Cox~ission does hereby grant the
requested Use Permit, subject to the following conditions:
1. Provide tempered glazing at window forming a portion of the shower
enclosure. 5406 (d) UBC.

Ail windows to sleeping rooms including existing rooms must meet minimum
emergency egress requirements, ie. 20" openable width, 24" minimum height,
44" maximum at sills. 1205 UBC
3. Provide smoke detectors outside sleeping rooms. 1210 UBC
4. Provide a fan for the laundry room.
5. The gas wall furnace must be located 12' minimum from any door openings or
swinging door - relocate. 805(a) UMC
The applicant is notified as part of this application that he/she is required
to comply with all applicable Codes and/or Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
