PC Res 2605RESOLUTION NO. 2605 PLANNING COMMISSION BEING A RESOLUTION OF THE PI~ING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED USE PERMIT TO ALLOW THE EXPANSION OF A BILLIARD PARLOR ON PROPERTY KNOWN AS 2097 S. BASCOM AVENUE. (APPLICATION OF MR. PAUL NAMKOONG, M 89-05 (UP 85-03). After notification and public hearing as specified by law on the application of Mr. Paul Namkoong approval of modification of a previously approved Use Permit (UP 85-03) to allow the expansion of a billiard parlor on property known as 2097 S. Bascom Avenue in a C-2-S (General Commercial) Zoning District, as per the application filed in the Planning Department on May 18, 1989; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: Health/Safety: The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Compatibility: The proposed site is adequate in size and shape to accomodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. 3. Traffic: The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: 1. License Billiard Parlor. Applicant to comply with Chap. 5.28 of the Campbell Municipal Code. 2. Size. Use is limited to 14 billiard tables. 3. Alcohol. No alcoholic beverages shall be served or consumed in the billiards room. 4. Limited hours of operation. Hours of operation: 10:00 a.m. to 2:00 a.m. 5. One Year Approval. If this use is not established and a business license obtained within one year, Use Permit shall be void. Resolution No. 2605 2 - M 89-05 e Securing Permit Approvals. Applicant to obtain all necessary permits from the Police, Fire, and Building Departments. BUILDING DEPARTMENT Ye Handicap parking. Show handicap parking, accessibility to building and restrooms. Se Exit paths/signs. Establish exit paths and show illuminated exit signs on plans. 9. Plan review. Submit detailed plans for technical plan review. 10. Occupancy separation. Show use on both sides to establish requirements for occupancy separation. FIRE DEPARTMENT 11. Safety exits. Ail exit doors shall be provided with panic hardware. 12. Occupancy load. The occupancy is an A-3 Occupancy, having a calculated occupant load in excess of 50 persons. The use shall comply with C.A.C. Title 19 and Title 24 for a Group A-3 Occupancy. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
