PLANNING COMMISSION
BEING AN RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A VARIANCE
TO THE SIDEYARD SETBACK TO ALLOW THE CONSTRUCTION
OF AN ADDITION TO AN EXISTING RESIDENCE ON
PROPERTY KNOWN AS 111SHEREEN PLACE
(APPLICATION OF D. SMITH, ¥ 89-02).
After notification and public hearing as specified by law on the
application of D. Smith for a variance allowing the construction of an
addition to an existing residence on property known as 111Shereen Place
in a R-l-6 (Single Family Residential) Zoning District, as per the
application filed in the Planning Department on April 14, 1989; and, after
presentation by the Planning Director, the hearing was closed.
After due consideration of all evidence presented, the Commission did find
as follows:
Hardship: Strict or literal interpretation and enforcement of the
specified regulation would result in practical difficulty inconsistent
with the objectives of the Zoning Ordinance by preventing the
applicant from reasonably developing the subject property.
Exceptions: There are extraordinary circumstances applicable to the
property involved due to the yard easement (zero-lot-line) concept and
lot shape which do not apply generally to other properties classified
in the same zoning district.
Special Privilege: The granting of the variance will not constitute a
grant of special privilege.
Health/Safety: The granting of the variance will not be detrimental
to the public health, safety, or welfare, or materially injurious to
properties or improvements in the vicinity.
Based on the above findings, the Planning Commission does hereby recommend
approval of the requested variance.

The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances of
the City of Campbell and the Laws of the State of California. Additionally,
the applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of
California which pertain to this development and are not herein specified.
Building/Fire Department
Applicant to provide a one hour construction wall without openings where
walls are less that 3 ft. from the property line, Table (5D), in accordance
with the Uniform Fire Code.
2. Applicant to meet all requirements of Table (5A) - setback requirements, in
accordance with the Uniform Fire Code.
