PC Res 2573RESOLUTION NO. 2573 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SKATEBOARD RAMP AS AN ALLOWABLE USE IN AN R-1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT WITH APPROVAL OF A CONDITIONAL USE PERMIT. After due consideration of evidence pertaining to a request for a determination that a skateboard ramp be considered as a permitted use in a residential zoning district, the Planning Commission did find as follows: (1) A skateboard ramp is similar to other incidental recreation uses of single family residential uses such as swimming pools and swing sets. (2) Skateboard ramp structures are similar to other accessory buildings permitted in residential zoning districts and should meet the development standards of such structures. (3) Allowing a skateboard ramp as an accessory structure in R-1 (Single Family Residential) Zoning District will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing in residential neighborhoods. (4) A conditional use permit requirement is needed due to the possible impact of noise on neighbors. (5) The following restrictions shall apply: (A) The building or structure could not exceed 14 feet in height (or a single story). (B) The structure shall not be less than 10 feet from the rear of the main building located on the same lot. (C) When located at the side of a main building, the structure shall not be less than 5 feet from the main building. (D) The structure shall meet all setback requirements as specified in Chapter 21.55. (E) Not more than one accessory structure shall exceed 200 sq.ft, in area. No accessory structure shall exceed a maximum size of 1,000 sq.ft. Therefore, the Planning Commission determines that a skateboard ramp be added to the list of allowable uses in a residential zoning district upon approval of a Conditional Use Permit.
