PC Res 2542RESOLUTION NO. 2542 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT ALLOWING THE CONVERSION OF AN EXISTING GARAGE TO LIVING AREA ON PROPERTY KNOWN AS 131 HARDY AVE. IN AN R-1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. (APPLICATION OF MR. AND MRS. ERIC GROO, UP 88-04). After notification and public hearing as specified by law on the application of Mr. and Mrs. Eric Groo for a Use Permit to allow the conversion of an existing garage to living area on property known as 131 Hardy Ave. in an R-1 (Single Family Residential) Zoning District, as per the application filed in the Planning Department on May 5, 1988; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: The proposed garage conversion will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing in the neighborhood, or be detrimental to properties and improvements in the neighborhood. 2. The applicant has indicated the provision of two on-site parking spaces in the driveway satisfying the parking requirement for this use. 3. The proposed conversion is compatible to the other uses in this neighborhood. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: 1. Applicant to secure all necessary building permits. Applicant to provide easement agreement, satisfactory to the City Attorney, indicating driveway access to the rear garage. Lease to remain in effect at all times during the approved use. 3. Revised plans to show removal of original driveway in front yard that accesses the garage that is being converted to living area. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
