PC Res 2519RESOLUTION NO. 2519 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT ALLOWING THE ESTABLISHMENT OF A "HOBBY KENNEL" FOR 4 DOGS ON PROPERTY KNOWN AS 948 CROCKETT AVE. IN AN R-1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. (APPLICATION OF MS. SUSAN MAJ, UP 87-22). After notification and public hearing as specified.by law on the application of Ms. Susan Mai for a Use Permit and approval to establish a "hobby kennel" for four dogs on property known as 948 Crockett Ave. in an R-1 (Single Family Residential) Zoning District, as per the application filed in the Planning Department on December 12, 1987; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. 2. The proposed site is adequate in size and shape to accommodate the dog runs, fencing and other development features required for this use. 3. This use of the site, with modifications to dog run locations,' is compatible to the adjacent residential uses. Based on the above findings, the Planning Commission does hereby grant the requested Use permit, subject to the following conditions: 1. This hobby kennel use is limited to the care of 4 adult dogs. 2. The applicant shall maintain a clean and sanitary facility for the dogs, in a manner acceptable to the Health Officer of the City. 3. The Planning Commission, upon recgipt of a complaint of noise at this location, may revoke its approval of' this use permit. e Approval of this use permit restricts the care of pet to those owned by the resident and does not allow the care or boarding of animals or pets not owned by the resident. 5. ~his use permit approval is not transferrable to another owner, unless approval is granted by the Planning Commission. Resolution No. 251~ -2- UP 87-22 BUILDING DEPARTMENT e Dog house (3 x 10) & (10 x 10) dog run is at property line, and closer than 3'0". Therefore, it my be required to have a one-hr, fire rated enclosure at this point. Further construction details required. PLANNING COMMISSION 7. This approval to be reviewed in.3 months and again in 6 months from date of approval. The applicant is notified as part of this application that he/she is required to comply with all ~pplicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
