RESOLUTION NO. 10169
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
SUMMARILY VACATING EXCESS PUBLIC STREET RIGHT -OF-WAY
FOR PROPERTY LOCATED AT 1145 SOUTH SAN TOMAS AQUINO ROAD
WHEREAS, on June 13, 2000, the Planning Commission of the City of Campbell
adopted Resolution No. 3285 granting a Site and Architectural Approval for property located at
1145 South San Tomas Aquino Road; and,
WHEREAS, public street right-of-way along the frontage of said property is no longer
necessary for public street purposes; and,
WHEREAS, the vacation is to be made pursuant to Chapter 4, Summary Vacation, of
Part 3 of Division 9 of the California Streets and Highways Code; and,
WHEREAS, a legal description and plat depicting the excess public street right-of-way to
be vacated is correctly described in Exhibit "A" attached.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby vacates excess public street right-of-way as described in Exhibit ",A(' attached; and,
BE IT FURTHER RESOLVED that the City Council of the City of Campbell hereby
authorizes the Public Works Director to sign a quit claim deed transferring ownership of said
vacated public street right-of-way to the owners of 1145 South San Tomas Aquino Road.

All that certain property situate in the City of Campbell, County of Santa Clara, State of
California, described as follows:
PARCEL ONE:
A strip of land 5 feet wide, previously dedicated to the City of Campbell for Public Street
Purposes, described as follows to wit:
Beginning at the Southeasterly comer of the parcel of land described in the Deed from Chas.
Stephen et ux, to Charles K. Wilson et ux, dated June 23, 1944 and recorded June 27, 1944 in
Book 1205 of the Official Records, page 329, Santa Clara Records, in that Westerly line of San
Tomas Aquino Road 40 feet wide; thence along said westerly line of said road, N. 9 - 05' E.,
10.40 feet; thence parallel with the Southerly line of said parcel ofland S. 83 - 13' W., 190.06
feet to the True Point of Beginning; thence along said parallel line S. 83 - 13' W., 75.36 feet;
thence at right angles N. 6 - 47' W., 5 feet; thence at right angles N. 83 - 13' E., 75.36' feet;
thence at right angles S. 6 - 47' E., 5 feet to the True Point of Beginning and being a portion of
Lot 2 as shown upon the Map of the Subdivision of Lovell Tract, which Map is of record in the
office of the Recorder of the County of Santa Clara, State of California, in Book 403 of Maps,
page 15, Santa Clara County records; described as follows:
The South 5.00 feet of said Lot 2;
Containing 0.0087 acres (376.80 sq. ft.), more or less.
