RESOLUTION NO. 10186
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE CITY MANAGER TO EXECUTE AGENCY AGREEMENTS
FOR COUNTYWIDE AB939 IMPLEMENTATION FEE AND
COUNTYWIDE HOUSEHOLD HAZARDOUS WASTE COLLECTION PROGRAM
WHEREAS, pursuant to Public Resources Code Section 41901, a city, county, or city
and county may impose fees in amounts sufficient to pay the costs of preparing, adopting, and
implementing an integrated waste management plan; and
WHEREAS, the City of Campbell, in agreement with the Recycling and Waste
Reduction Commission of Santa Clara County, has determined that a Countywide AB939
Implementation Fee of $3.35 per ton of waste disposed at landfills located within the county
should be collected with $1.50 per ton of the fee assisting in funding the costs of implementing
the integrated waste management plan in the fifteen cities and the unincorporated areas of the
county and $1.85 per ton of the fee funding the Countywide Household Hazardous Waste
Collection Program; and
WHEREAS, the City Council finds that execution of an Agency Agreement for the
implementation of a Countywide AB939 fee collection program is in the best interests of the
residents and businesses of the City of Campbell; and
WHEREAS, the County of Santa Clara implements and administers the Countywide
Household Hazardous Collection Program whereby residents and small generators of hazardous
waste of the participating jurisdictions and unincorporated areas have an opportunity to safely
dispose of household hazardous waste; and
WHEREAS, the City Council finds that execution of an Agency Agreement to continue
the provision of a safe and convenient means of disposing of household hazardous waste is in the
best interests of the residents and businesses of Campbell.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby authorizes the City Manager to execute Agency Agreements and future extensions of the
Agreements for Countywide AB 939 Implementation Fee and Countywide Household Hazardous
Waste Collection Program.
