PC Res 2490RESOLUTION NO. 2490 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL DENYING A USE PERMIT ALLOWING A LARGE FAMILY DAY CARE FACILITY (12 CHILDREN OR LESS) ON PROPERTY KNOWN AS 964 HARRIET AVE. IN AN R-l-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. (APPLICATION OF MS NAHID DJAFARZADEH, UP 87-19). After notification and public hearing as specified by law on the application of Ms. Nahid Djafarzadeh for a Use Permit to allow a large family day care (12 children or less) on property known as 964 Harriet Ave. in an R-l-6 (Single Family Residential) Zoning District, as per the application filed in the Planning Department on October 15~ 1987; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: The provision of 4 on-site parking spaces (2 garage, 2 driveway) is considered not adequate to serve the residential use, the employee parking needs and the pick-up/drop-off needs of the proposed day care center. The extent and location of outside play areas are limited on this site. The location of the proposed play area immediately adjacent to other rear yard areas creates a potential noise source. The establishment and operation of a day care home of 12 children at this location may be detrimental to the comfort and general welfare of persons residing in the neighborhood. The proposed site is not adequate in size to accommodate the yards and parRing/loading facilities required to integrate this use into the surrounding area. 5. The.use as presented is not compatible with the adjacent uses in this area. 6e A large family day care home is similiar to other uses permitted in an R-1 Zoning District with a use permit, pursuant to California Health & Safety Code, Section 1596.70 et.seq. Based on the above findings, the Planning Commission does hereby DENY the requested Use Permit. The applicant is notified as part of this application that he/she is required to cOmply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are no~ herein specified.
