PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL
OF A TEXT AMENDMENT TO THE CAMPBELL MUNICIPAL
CODE, CHAPTER 21.61.030 - ADDITIONAL LIVING
UNITS. TA 87-01
AFter notification and public hearing as specified by law on proposed
amendments to the text of the Campbell Municipal Code, and after
presentation by the Planning Director, proponents and opponents, the
hearing was closed.
After due consideration of all evidence presented, and based upon the
following findings, the Commission did determine that there was a need to
amend Chapter 21.61.030 - Additional Living Units of the Campbell
Municipal Code.
Detached units are detrimental to the neighborhood and the adjacent
property owners in terms of loss of privacy, additional noise, and
change in the appearance of the neighborhood. Many property owners
have appeared at public hearings on individual units and voiced
objections citing the aforementioned concerns.

Units that are attached to and incorporated in an existing residence
blend in with the neighborhood, and many times are completely
unnoticeable. Design standards require the appearance from the street
to be that of a single family residence. These units are less likely
to cause the concerns indicated in #1 above.
Allowing attached units on 12,000 sq.ft, lots or larger affords the
opportunity for hundreds of additional living units throughout the
City.
The Planning Commission does hereby recommend that the City Council adopt
the attached Ordinance enacting the necessary legislation to make the
proposed text amendment effective.

BEING AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF CAMPBELL AMENDING CHAPTER
21.61.030 - ADDITIONAL LIVING UNITS
OF THE CAMPBELL MUNICIPAL CODE (TA 87-01)
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That Chapter/Section 21.61.030 - Additional Living Units of
the Campbell Municipal Code is hereby amended as set forth in Exhibit A,
attached hereto.
SECTION TWO: This Ordinance shall become effective thirty days following
its passage and adoption and shall be published once within fifteen days
upon passage and adoption in the San Jose Mercury News, a newspaper of
general circulation in the City of Campbell, County of Santa Clara.

All the sections of 21.61.030 shall remain unchanged except for the
following:

Definitions. An additional living unit is a separate complete
housekeeping unit with a kitchen, sleeping and full bathroom
facilities, which is a part of, or an extension to, an existing
structure originally designed for occupancy by a single family.
Living unit - attached. The living unit is to be
attached to the existing main dwelling and shall be
located within the living area of the existing
dwelling. The total floor area shall not exceed 640
sq.ft, and it shall not have more than one bedroom.

Increase in floor area. Whenever an increase in floor
area is involved, it shall not exceed 15 percent of the
existing main residence.
