PC Res 2476RESOLUTION NO. 2476 PLANNING COMMISSION BEING AN ORDINANCE OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A VARIANCE TO THE SIDE AND REAR SETBACK REQUIREMENTS AND TO THE 14-FOOT HEIGHT REQUIREMENT TO ALLOW AN ACCESSORY BUILDING ON PROPERTY KNOWN AS 1315 EL SOLYO AVE. IN AN R-l-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. (APPLICATION OF MR. FRANK FORBES, V 87-01). After notification and public hearing as specified by law on the application of Mr. Frank Forbes for a variance to the side and rear setback requirements and the 14-foot height requirement to allow an accessory building on property known as 1315 E1 Solyo Ave. in an R-l-6 (Single Family Residential) Zoning District, as per the application filed in the Planning Department on August 27, 1987; and, after presentation by the Planning Director, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: The structure is not detrimental to the neighborhood, as indicated by the support of the adjacent property owners. The structure was constructed numerous years ago in the County before the applicant purchased the property. Relocating the structure would create a hardship for the applicant. A driveway goes back to the structure and if the structure were moved to meet setback requirements, it would be more difficult to access the structure. This is an exceptional or extraordinary situation which does not apply generally to land, buildings, or uses in the same district. Based on the above findings, the Planning Commission does hereby recommend approval of the requested variance, subject to the following conditions: Applicant to obtain all necessary permits from the Building Department. e If this accessory building falls into disuse, is abandoned, or destroyed, this variance is terminated.
