PC Res 2451RESOLUTION NO. 2451 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT ALLOWING AUTO SALES ON PROPERTY KNOWN AS 2420 S. WINCHESTER BLVD. IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. (APPLICATION OF MANUAL AND JAVIER MILANO, UP 87-06). After notification and public hearing as specified by law on the application of Manual & Javier Milano for a Use Permit to allow auto sales on property known as 2420 S. Winchester Blvd. in a C-2-S (General Commercial) Zoning District, as per the application filed in the Planning Department on February 26, 1987; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: The establishment, maintenance or operation of the auto sales use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accomodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: Property to be fenced and landscaped as indicated and/or added in red on the plans. Landscaping and fencing shall be maintained in accordance with the approved plans. Landscaping plan indicating type and size of plant material, and location of irrigation system to be submitted to the Planning Department and approved by the Site and Architectural Review Committee prior to establishment of use. ® Fencing plan indicating location and design details of fencing to be submitted to the Planning Department and approved by the Planning Director prior to establichment of use Resolution No. 24. ~ -2- April 14, 1987 4e Applicant to either (1) post a faithful performance bond in the amount of $3,000.00 to insure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file written agreement to complete landscaping, fencing, and striping of parking areas. Bond or agreement to be filed with the Planning Department. 5e Ail parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. e Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. e Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.68.030 of the Campbell Municipal Code). 8e Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. 10. Applicant shall comply with all appropriate State and City requirements for the handicapped. PLANNING DEPARTMENT 11. Use permit is not valid until all conditions of approval have been satisfied. 12. If the applicant fails to satisfy and comply with the conditions of approval within one year from Planning Commission action, Planning Commission approval shall be void. 13. No repair of vehicles is permitted outside of buildings. Resolution No. 2~ -3- April 14, 1987 14. The auto sales operation shall be limited to the display of 16 vehicles as illustrated on the approved site plan. No lighting, display of banners, or signage is granted as a part of this Use Permit approval. 15. Use Permit to be reviewed by the Planning Commission 2 years from date of Planning Commission approval. 16. Applicant to provide a copy of lease verifying the permitted use of parking facilities as illustrated on the site plan to the Planning Director. BUILDING DEPARTMENT 17. Applicant to submit three copies of on-site grading and drainage for approval of Building Official. FIRE DEPARTMENT No comments at this time. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
