BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A
ZONE CHANGE (PLN2001-43) FROM PD (PLANNED
DEVELOPMENT) TO C-PD (CONDOMINIUM-PLANNED
DEVELOPMENT) FOR PROPERTY LOCATED AT 300 ORCHARD
CITY DRIVE. APPLICATION OF WATER TOWER I, LLC. FILE
NO. PLN2001-43.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2001-43:
1. The proposed rezone from P-D to C-P-D is consistent with the General Plan designation of
Commercial for the site.
The proposed rezone from P-D to C-P-D is consistent with the General Plan Housing
Element Policy A: Plan for the addition of new units to the housing stock through the
provision of adequate land zoned for appropriate residential densities.

The proposed rezone from P-D to C-P-D is consistent with the Redevelopment Plan by
providing for the most efficient use of land within the downtown area and by provided an
opportunity for the development of affordable housing.
The proposed residential project is consistent with the Downtown Development Plan, which
has policies that support the development of residential uses on commercial properties within
the downtown.

The location of the property adjacent to the future Vasona Light Rail Downtown Station with
direct pedestrian access offers a unique opportunity to provide attached housing in very close
proximity to mass transit services.
6. The proposed density of 26.25 units per gross acre is no greater than the density allowance of
21-27 units per gross acre permitted in the R-3 (High Density Residential) Zoning District.
7. An Initial Study was prepared for this project and no significant environmental impacts were
found.
Based upon the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed development and uses will clearly result in a more desirable environment and
use of the land than would be possible under any other zoning classification.

2. The development and uses will be compatible with the General Plan of the City and will aid
in the harmonious development of the immediate area.

The proposed development will not result in allowing more residential units than would be
allowed by other residential zoning districts, which are consistent with the General Plan
designation of the property; and
4. The proposed development will not be detrimental to the health, safety or welfare of the
neighborhood or the City as a whole.
o
No substantial evidence has been presented which shows that the project, as currently
presented, and subject to the required conditions of approval, will have a significant adverse
impact on the environment.
