Current Planning Peter and Melissa Bovenberg 1083 Holmes Avenue Campbell, CA 95008 October 1, 1997 RE: Meeting of September 23, 1997 regarding property located at 665 McGlincey Lane (Modem Bench Operations Collision Repair Center) Dear Peter and Melissa Bovenberg: It was a pleasure to meet with you and Mr. Troy Domier last Tuesday, September 23, 1997 to discuss the efforts which must be made to mitigate the code violations which currently exist on your property located at 665 McGlincey Lane. Based upon our meeting which was attended by the City Attorney, William Seligmann, and various other staff members from the Planning, Public Works, Building and Central Fire Departments, it was agreed that the various violations pertaining to outdoor storage, unapproved signage and the unapproved uses of the site would be handled in the following manner: 1. Immediate removal of the chain link fence and associated outdoor storage currently within the public right-of-way. It was discussed at the meeting that no portion of the public right-of-way is to be used for building of structures or storage of any kind, including auto parts, debris, trash containers, picnic tables and benches, etc. All public right-of-way area is to be maintained free and clear immediately. An inspection will be conducted on October 7, 1997 to verify that the storage of materials and the chain link fence structure has been removed. 2. Submission of evidence showing City approval of the existing signage and on-site fencing (allowing enclosed storage uses) on the property by Tuesday, October 7, 1997. During the meeting, it was communicated that City Staffhas no evidence of approvals for the existing signage and for the existing on-site fencing which is being used to enclose outdoor storage. If you are not able provide the requested evidence, please be advised that you will be required to submit applications for the City's review by October 23, 1997. 3. Submission of a revised and scaled site plan by October 23, 1997 for review by the Community Development Department and to include all structures on site, location of all uses, proposed on-site trash enclosure area and the required number of parking spaces. It was explained that the current use of your property is not in conformance with the previously approved site plan (S 69-7) and that a number of violations on site pertain to unapproved outdoor storage uses, including storage of 70 North First Street. In response, you had stated that you would like to propose a modification to the previously approved site plan to accommodate the needs of your auto repair business, including some outdoor storage areas. In consideration of your efforts to provide a revised site plan, it was agreed that the City would not pursue compliance of these above-referenced outdoor storage violation issues until the revised site plan is submitted to the City for review in a timely fashion. Please find enclosed a Site and Architectural Review Permit application which you will be required to submit in conjunction with your request to modify the previously- approved Site and Architectural Review permit. The fee for a Modification of a previously-approved Site and Architectural application is $960.00. Also enclosed is a Sign application, which you will be required to submit in the absence of evidence of an approved Sign permit. A copy of the City's Sign Ordinance (Chapter 21.53) is also enclosed for your review and reference. The fee for a Sign application is $120.00. Landscape plan indicating type of plant material, loca- tion of hose bibs or sprinkler system and type of fencing to be submitted' for approval of the Planning Director at time of application for building permit. 3. Faithful performance bond in the amount of $500 to be posted to insure landscaping, fencing and striping of parking area within three (3) months of completion of construction, or applicant may file written agreement to complete landscaping, fencing and striping of park- ing area prior to final Building Department clearance. 4. An enclosure consisting of a concrete floor surrounded by a six foot high solid wall or fence shall be con- structed to house trash container in an area approved by the Planning Director and Fire Department. Said enclosure to be 8' x 12' minimum with 6 foot self- closing gates. 5. Planning Director to approve revised parking plan. The applicant is notified as part of this application that he is required to meet the following conditions in accotdance with Ordinances of the City of Campbell. A. All parking and driveway areas to be developed in com- pliance with Section 9319 of the Campbell Municipal Code. (Revised parking plan to be approved by the Planning Director). B. All underground utilities to be provided as required by Section 9110.6 of the Campbell Municipal Code. C. Plans submitted to the Building Department for plan check shall indicate clearly the location of all con- nections for underground utilities including water, sewer, electric, telephone and television cables, etc. D. Applicant to obtain excavation permits for driveway approaches. E. Sign application to be submitted in accordanmwith provisions of the sign ordinance for all signs. .
