CONDITIONS OF APPROVAL
1. Property to be fenced and landscaped as indicated and as
added in "red" on plans.
2. Landscape plan indicating type of plant material, location of
hose bibs Or sprinkler system and type of fencing to be sub-
mitted for approval of the Planning Director at time of appli-
cation for building permit.
3. Faithful performance bond in the amount of $3,006 to be posted
to insure landscaping, fencing and striping of outdoor parking
areas within three (3) months of completion of constructiont or I
applicant may file written agreement to complete landscaping,
fencing and striping of outdoor parking areas prior to final
building department clearance.
4. An enclosure consisting of a concrete floor surrounded by a
six-foot high solid wall or fence shall be constructed to house
trash container in an area approved by the Planning Director
and rire Department. Said enclosure to be 8' x 12' minimum with
six (6) foot self-closing gates.
5. Side yard elevations approved on March 16, 1970, tobe substituted
for elevations shown on plans submitted for approval on
December 21, 1970.
The applicant is notified as part of this application that he is
required to meet the fOlloHing conditions in accordance \-lith Ordinc.1!Iccs
of the City of Campbell:
A. All parking and driveway areas to be developed in compliance
with Section 9319 of the Campbell Municipal Code.
B. Underground utilities to be provided as required by Section
9110.6 of the Campbell Municipal Code.
C. Plans submitted to the building department for plan check
~hall indicate clearly the location of all connections for
underground utilities inCluding water, sewer, electric) telephone
and television cables, etc.
D. Applicant to obtain excavation permit for drivway approach and
provide easement for utility installation.

Gentlemen:
Pursuant to our telephone conversation of recent date, we have examined
our records with reference to the property of Peter J. Ricci et ux, and the
conveyance to the City of Campbell of Michael Drive, with reference to the
Record of Survey of said Drive.as recorded June 19, 1969, Book 255 of Maps,
page 30.
We are enclosing for your examination copies of the following:
1. Deed from Peter P. Ricci et al, to the City of Campbell
recorded January 8, 1968, Book 7986 Official Records,
page 473.
2. Deed from Peter P. Ricci et al, to Peter J. Ricci and
Bernardine M. Ricci, his wife, in joint tenancy, recorded
April 16, 1968, Book 8090 Official Records, page 735.
You will note that by description contained in Deed No.1 above that
portion of Michael Drive conveyed to the City of Campbell by said Deed
is Westerly of the Drive as shown on said Record of Survey.
You will also note that the Deed No.2 above overlaps the parcel described
in the Deed to the City of Campbell, and again uses as it's Easterly boundary
different curve date than in the Record of Survey and again falls slightly Westerly
of the Drive as shown on the Record of Survey.

It is our opinion, as of the date of this letter, that in order to clear
the title of Peter J. Ricci and Bernardine M. Ricci, his wife, (the owners
of the property West of said Michael Drive as shown on the Survey), a
Deed should be executed by the City of Campbell to Peter J. Ricci and
Bernardine M. Ricci, his wife, in joint tenancy, conveying the parcal of
land as described on the enclosed description.
In view of subsequent Deeds of record as to premises Easterly of
Michael Drive, as established by said Deed to the City, No.1 above, it
would appear the City of Campbell should order a Litigation or Condemnation
Guarantee in connection therewith.
Please examine the above and advise us as to what procedure the City
wishes to take to correct the record.
