Dear Mr. Oser:
On January 2, 1990 ordinance no. 1781 was passed allowing the
construction of 68 condominiums at 110 Michael Drive. Condition
no. 34 of this approval was a requirement that the applicant "pay
a pro-rate share of area-wide infrastructure improvements and
traffic mitigation currently identified in a manner described by
the City Engineer and approved by the City Council". This is in
response to your question regarding fulfillment of this
condition.
The traffic study prepared by your consultant for the proposed 68
unit complex at 110 Michael Drive has been reviewed by the Public
Works' traffic engineer. This study provided a comprehensive
review of existing traffic conditions at a variety of
intersections previously designated by the Public Works staff.
The study compares the present traffic situation with the traffic
condition anticipated with the addition of a 70 unit condominium
complex. The study also projected the relative contribution this
project would have to the year 2000 traffic conditions. The
results of the study show that none of the intersections reviewed
will be impacted significantly by the addition of this project.
This conclusion is dependent on the assumption that all office
traffic would continue to enter and exit the shared parking area
from Bascom Avenue, as is the case today. Based on the results
of this study, traffic mitigation measures and area-wide
infrastructure improvements will not be required for this
development.

The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed
and amended on property known as 110 Michael Drive - APN: 412-10-46, by
adopting the attached Exhibit A, entitled Plans and Elevations; Exhibit B,
entitled Development Schedule; Exhibit C, entitled Map of Said Property; and
Exhibit D, entitled Conditions of Approval, as per the application of Mr. Burch
Boone, on behalf of Lincoln Bascom Office Center, Ltd., for plans, elevations,
and development schedule to allow the construction of 68 Condominiums, in a
Condominium-Planned Development Zoning District. Copies of Said Exhibits are
on file in the Planning Department.
SECTION TWO: This Ordinance shall become effective 30 (thirty) days
following its passage and adoption and shall be published once within lS
(fifteen) days upon passage and adoption in the San Jose Mercury News, a
newspaper of general circulation in the City of Campbell, County of Santa
Clara, State of California.

The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances of
the City of Campbell and the Laws of the State of California. Additionally,
the applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of
California which pertain to this development and are not herein specified.
1. Elevations/Site Plan: Revised elevations and site plan to be submitted to
the Planning Department and approved by the Site and Architectural Review
Committee and the Planning Commission prior to application for a building
permit.
2. Fencings/Landscaping: Property to be fenced and landscaped as indicated
and/or added in red on the plans. Landscaping and fencing shall be

6. Utility Boxes: Applicant to submit a plan to the Planning Department,

7. Mechanical Equipment/Utility Meter Screening: All mechanical equipment on
roofs and all utility meters to be screened as approved by the Planning

10. Utilities: Underground utilities to be provided as required by Section
20.36.150 of the Campbell Municipal Code.
11. Utilities: Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground utilities
including water, sewer, electric, telephone and television cables.
12. Signing: Sign application to be submitted in accordance with provisions of
the Sign Ordinance for all signs. No sign to be installed until
application is approved and permit issued by Planning and Building
Departments (Section 21.53 of the Campbell Municipal Code).
13. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code
stipulates that any contract for the collection and disposal of refuse,
garbage, wet garbage and rubbish produced within the limits of the City of
Campbell shall be made with Green Valley Disposal Company. This
requirement applies to all single-family dwellings, multiple apartment
units, to all commercial, business, industrial, manufacturing, and
construction establishments.
14. Trash Containers/Enclosures: Trash container(s) of a size and quantity
necessary to serve the development shall be located in area(s) approved by
the Fire Department. Unless otherwise noted, enclosure(s) shall consist of
a concrete floor surrounded by a solid wall or fence and have self-closing
doors of a size specified by the Fire Department. All enclosures to be
constructed at grade level and have a level area adjacent to the trash
enclosure area to service these containers.
15. Handicapped Requirements: Applicant shall comply with all appropriate
State and City requirements for the handicapped.
16. Noise Levels: Noise levels for the interior of residential units shall
comply with minimum State (Title 25) and local standards as indicated in
the Noise Element of the Campbell General Plan.
17. Park Dedication Fee: Applicant is hereby notified that he will be required
to pay a Park Dedication In-Lieu Fee which will be assessed at the time the
subdivision map is submitted.

18. Retaining Walls: Retaining walls at property lines are limited to a height
of 15 inches if constructed of wood.

23. If the three hour horizontal separation permitted in UBC, Section 702(a) is
used to increase the area or height of the building, the following shall
apply:
a. Compliance with UBC. Section 702(a) 1, 2, 3 and 4.
b. The proposed first story parking level is restricted to the storage of
passenger vehicles, and may contain laundry room and mechanical rooms
incidental to the operation of the building. and shall not include
residential units. UBC, Section 792(a) 3.
24. The building shall be provided with fire sprinkler protection throughout
UFC, Section 10.308 and 1~ inch hose outlets. UFC. Section 10.311(f).
25. CAC Title 19. Section 3.05 requires minimum 20 feet wide access roads from
EVERY building to a public street. Roads shall be all-weather and
hard-surfaces; existing turf-block not allowed, UFC 10.207(a).
26. CAC Title 24, Section 2-1216 requires a fire alarm system unless all
provisions of said section has been complied with and all R-1 Buildings are
no more than two stories in height.
27. All portions of the parking levels shall be located within 200 feet travel
distance to the nearest exterior exit door, enclosed stairways or other
exit ways., UBC, Section 3303(c).
28. On-site fire hydrants are required under UFC, Section 10.301(c).
29. Provide key lock box keyed to the Campbell Fire Department Know Box
system. UFC. Section 10.209.
30. The fire sprinkler system shall be fully supervised by an approved central
alarm station. UFC, Section 10.309.

38. Parking: The applicant shall record a covenent obligating existing and
future property owners to mitigate spillover parking problems if they are
deemed to exist by the Campbell City Council. The mitigation measures may
include but are not necessarily limited to the following:
1. Implement an office car pool program.
2. Implement a program encouraging employee ridership of alternate
means of transportation.
3. Implement a valet parking program for the office component.
4. Limit the number of employees permitted to occupy the office
structure.
5. Other methods determined to be reasonable by the City Council.

BACKGROUND
We have completed our review of the 110 Michael Drive application for
PD permit 89-20. This development deserves particular consideration
because it is located within the E. Campbell Avenue area which has
been identified as an area experiencing problems due to existing
infrastructure. The developments in this area are evaluated in a
manner consistent with the City's current plans as well as possible
future plans for this area.
This development proposes construction of a 70 unit complex adjacent
to an existing 3 story office building on Bascom Avenue. The
proposal includes a shared parking area between the office and
residential uses. The complex is located near downtown Campbell and
within an established transit corridor. Because of its proximity to
downtown, it is anticipated that the complex will support the
downtown businesses and will also serve to bring increased housing
closer to the available job market. With the potential for
development of the Vasona light-rail, along with the existing bus
routes on Campbell Avenue, this complex will also benefit from easily
accessible transit alternatives. This combination of circumstances
is consistent with the regional transportation concept and with the
City's traffic management philosophy.
Due to the circumstances outlined above, we believe this development
can effectively be incorporated into the future plans for the E.
Campbell Avenue area. However, all developments in this area should
be conditioned to pay a pro-rata share of the area-wide
infrastructure improvements and traffic mitigations identified by the
City Engineer and approved by the City Council.

this pattern, control measures to prevent the office traffic from
infiltrating Michael Avenue must be installed. A card key controlled
gate where residents only are given the card is one option being
considered. As a condition of approval for this type of arrangement,
Public Works requires that a parking management plan which includes a
resident parking manager be included in the development of the
complex. This manager must ensure that the control measure is
effective and is kept operable.
SUMMARY
Public Works recommends the following conditions for approval of PD
89-20:
1. File and process a tract map.
2. Provide 5 sets of drainage plans.
3. Obtain an excavation permit, pay fees and post surety for all
work in the public right-Of-way.
4. Pay a pro-rata share of area-wide infrastructure improvements and
traffic mitigations currently identifi~d in a manner described by
the City Engineer and approved by the City Council.
5. Office traffic shall not be allowed ingress or egress to Michael
