Re: Mona Way Extension, East Darryl - #3-2014
Dear Mr. McDermott:
By letter of January 12, 1977, we have been assured that
Campbell will enforce the agreement recorded in Book C-217,
pp. 461 through 466 which provides for the improvement of
portions of Mona Way between Darryl and San Tomas Expressway.
In addition, they will require that the City of San Jose
be named as additional insured in connection with this
project. We have received and recorded a deed for those
portions of Mona Way covered within the agreement and
within the City of San Jose.
The remaining obligations which must be met prior to recording
the map creating the lot at the northeast corner of Darryl
Drive and Mona Way are:
1. Sign the attached agreement and provide the $1,000
completion deposit assuring that the sidewalk,
including handicapped ramp, will be built. This is
refundable upon completion of the work.
2. Obtain a sidewalk permit (no fee) from the Sidewalk
Section, Room 459, City Hall, allowing the actual
construction. This permit automatically provides
for any necessary insurance coverage.
3. Pay area fees in the amount of $202.00 for sanitary
sewers and $301.00 for storm sewers. Additional
sanitary unit and treatment plant fees will be
required at the time a building is proposed for the
si te and will be based on the type, .size and use of
the building.

SUBJECT: Mona Way Extension Between Darryl Drive
and San Tomas Expressway
Dear Mr. Boardman:
Enclosed please find a copy of the recorded agree-
ment for the construction of public street improvements
within the Mona Way extension. Also enclosed is a
sketch indicating the limits of these improvements.
All surface improvements and storm drainage
imprQvem~nts within the indicated limits are covered
by the Agreement and are described on page 2 of 5.
We also have bonding for all of these improvements.
Improvements outside of the indicated limits are not
included.
It is the City of Campbell's intention to have
the plans for the public street improvements embraced
by this Agreement reviewed and approved by the City
of San Jose. It is also the City of Campbell's
intention to require the developer, at the time he
applies for his building permits, to insure the City
of San Jose for $~ million.

Dear Mr. Boardman :
The property owners, developers, and their engineers involved with this projeot
have apparently resolved their differenees. An agreement has been made that
Mr. Grattan will oause the neoessary right-of-way to be offered for dedioation, and
the Kelly-Gordon Company will oause most of the street improvements to be con-
struoted.
Enolosed please find the Grant Deed for the right-of-way. This dedioation is
being offered to San Jose without conditions. We are requesting that San Jose
take the neoessary aotion to aocept and record this dedioation.
Kelly-Gordon Company will be taking aotion to oause the preparation of plans for
the oonstruotion of that portion of the improvements that fall within the area
indioated upon the attaohed sketoh. It is Campbell's intention to process the
plans, oollect the fee., and inspect the oonstruction. We will continue to consult
with San Jose to assure that the plan. are acceptable to both agenoies, and that
matters suoh as liability insuranoe are satisfactory.
It is our understanding that a Parcel Map of the subject property within San Jose
is now being processed. It should be made clear that any requirements, other than
those that may be satisfied by this projeot as presented above, wit'! be the respon-
sibility of the applioant.
We will inform you of any further aotion as it takes place, add when the sUbject
improvement plans are submitted we will forward prints to you for your review.

Company and Kelly - Gordon Company dated December 13, 1976.
This office has transmitted to the City of San Jose the Sunrise Grant
Deed for the Mona Way right-af-way.
The coordination of this pro1ect will be somewhat complex and time
consuming because lie the n~rous utilitj,."aompanies, public agencies,
and private companies involved. It becomes important for this office
to be aware of what your intentions are regarding the preparation of
the impeovement plans and the time frame for the construction of the
improvements. Please no~e that the Vista Construction Company agree-
ment calls for these improvements to be completed within the next twelve
mon ths .

Enolosed please find a copy of the agreement between Sunrise Investment
Company and Kelly - Gordon Company dated December 13, 1976.
It is our understanding that this agreement supersedes your letter of
November 30, 1976, whioh accompanied the Grant Deed for the Mona Way
extension when it was delivered to this office. Therefore, we are
transmitting the Deed, without conditions, to the City of San Jose.
We will indioate to San Jose that Campbell is prepared to proceed with
this project, and that we are taking steps to cause the neoessary docu-
ments and plans to be prepared.

Bill:
Per your request, attached find two (2) signed and notarized
copies of the Deed for the "land to be granted to the City
of San Jose" as required by the City of Campbell, for the ded-
ication of Mona Way.
These items are submitted in fulfillment of the direction outlined
in your letter of June 18, 1976 and per your telephone conversation
with Bill Heiss on 11/29/76.
The offering of this dedication is conditioned upon the City of
Campbell requiring the installation of those improvements outlined
in said letter of June 18th and the agreement dated June 30, 1976
between the City of Campbell and Vista Construction Company. A
further condition is that said improvements be required to be con-
structed in conjunction with and concurrently with Tract # 5950.
A final condition is that the City of Campbell advise the City of
San Jose that subject improvements have been bonded for and the
City of Campbell will require the improvements referenced in said
June 18th letter and June 30th agreements. This latter statement
will replace Campbell's position outlined in your letter of Nov. 18th
to Mr. Boardman at the City of San Jose.

VISTA CONSTRUCTION COMPANY AGREEMENT.
WHEREAS, there has been submitted to the City Council by
Vista Construction Company an agreement for the development of
their real property in accordance with prescribed conditions; and
WHEREAS, by the terms of said agreement, ,and concurrently
herewith they have submitted grant deeds of certain portions of
their property for street purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
Mayor be and he is hereby authorized to execute the said agreement
on behalf of said City; and
BE IT FURTHER RESOLVED that the grant deed submitted in
connection therewith be and the same is hereby accepted.
