EXECUTION OF DONALD K. BECKENHAUER,
ET UX, AGREEMENT.
WHEREAS, there has been submitted to the City Council
by Donald K. Beckenhauer and Lydia M. Beckenhauer, his wife,
an agreement for the development of their real property in
accordance with prescribed conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council that
the Mayor be and he is hereby authorized to execute the said
agreement on behalf of said City.

LETTER OF AGREEMENT
It is understood and agreed by the undersigned that
an investment certificate (No. 4-021764-4, American
Savings) was assigned to the City of Campbell by
Abraham and Elizabeth Van Klaveren. Said assignment
was made to satisfy a condition of that certain agree-
ment between said parties known as Dillon (45), or
"S" 67-77.
It is further understood that in order to avoid undue
inconvenience to the Van Klaverens, the City of Campbell
agrees to release said assignment.
It is further understood that in consideration of said
release the undersigned agrees to replace the certi-
ficate, post a bond, or otherwise satisfy the condi-
tions of said agreement on or before April 19, 1976.

Dear Mr. and Mrs. Van Klaveren:
Enclosed herewith is the original and two copies
of the revised agreement for future installation or
construction of the public street improvement on More
Avenue in front of your property.
At your request, we have changed the agreement to
provide that you shall not be required to install the
sanitary sewerage system or the water main and appurtenances
until other property owner whose property fronts upon
More Avenue join you to acquire the necessary right of
way and to construct the necessary sanitary and water
facilities.

CONDITIONS:
1. Fencing and landscape plan, indicating type of plant materiaJs
and/or feneing to be used and plans for adequate watering system
to be submitted for approval of Planning Director at time of
application for Building Permit.
2. Faithful Performance Bond in the amount of $1,500 to be posted
to insure landscaping, fencing and striping of parking area
within three months of comp~tion of construction, or applicant
may file agreement to complete landscaping, fencing-and striping
prior to final Building Department clearance.
The applicant is notified that, as part of this application, he is
re~uired to meet the following additional conditions in accordance
with ordinances of the City of Campbell:

Section 9316.1 of the Campbell Municipal Code reads as follows:
Any approval granted under this section shall expire one hundred eighty
(180) days after tile date upon which such approval was granted, unless
an extension for such approval is obtained by making written application
for same to the Planning Commission at least fifteen (15) days prior to
the expiration date of such approval.
No building permit shall be issued after the expiration date of any
approval until a new approval has been obtained in the manner provided
for in this chapter.
