300 Orchard City Dr. (78-19) ORDINANCE NO. 1206 BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL ADOPTING PLANS, ELEVATIONS AND DEVELOPMENT SCHEDULE FOR THE PLANNED DEVELOPMENT ZONE ESTABLISHED BY ORDINANCE OF THE CITY OF CAMPBELL (APPLICATION OF PACIFIC DESIGN GROUP ON BEHALF OF THE FACTORY, PO 78-19). The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended by adopting the attached "Exhibit All entitled "Plans and Elevations", "Exhibit B'I, entitled "Development Schedule", "Exhibit C" entitled "Map of Said Property", and "Exhibit 0", entitled "Conditions of Approval'l, as per the application of Pacific Design Group on behalf of The Factory, for approval of plans, elevations, and development schedule to allow construction of a commercial center on property known as 30 S. Central Avenue in a Planned Development Zoning District. Copies of said exhibits are on file in the office of the Planning Department. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. EXHIBIT D CONDITIONS OF APPROVAL PO 78-19 A. landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director prior to application for building permit. B. Fencing plan indicating location and design details of fencing to be submitted for approval of Planning Director prior to application for building permit. C. landscaping and fencing shall be maintained in accordance with the approved plan. D. Applicant to either (I) post a faithful performance bond in the amount of $5,000 to insure landscaping, fencing, and striping of parking areas within three months of completion of construction, or (2) file written agreement to complete landscaping, fencing and striping of parking areas prior to final Building Department clearance. E. All mechanical equipment located on roofs to be screened/designed as approved by the Planning Director. F. Second and third floors to be limited to office use only. G. Underground util ities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. H. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. I. Sign application to be submitted in accordance with provisions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Building Department. (Section 21.68.070 of the Campbell Municipal Code.) J. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the city of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apart- ment units, to all commercial, business, industrial, manufacturing, and construction establishments. K. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. EXHIBIT 0 PO 78-19 Page 2 L. Applicant shall comply with all appropriate State and City requirements for the handicapped. BUILDING DEPARTMENT M. Change in use of this building from warehouse to assembly and retail uses shall require this building be made to comply with the requirements of the latest edition of the Uniform Building Code and State Codes. FIRE DEPARTMENT N. Provide one street fire hydrant on S. Central Avenue and one private hydrant at rear alley. o. Extend automatic sprinkler system to all areas. P. Provide 2A-IOBC fire extinguishers in metal cabinets for corridors and public areas. PUBLIC WORKS DEPARTMENT Q. Execute an agreement to install street improvements in Central Avenue and post security to guarantee the work. R. Pay storm drainage area fee of $588. SECOND STREET ---------------------------------------------------------- RECOMMENDATION That the City Council ratify the decision of the Planning Commission approving a use permit to allow valet parking for a period of six months. DISCUSSION The applicant is requesting to use Parcel #1 (See attached Exhibit A) for valet parking for The Factory while construction of the parking structure is underway. It is the Commission's opinion that the proposed valet parking is acceptable in that it provides for more efficient parking and should result in less noise emitted from the parking area, due to the drop-off and pick-up taking place at The Factory entrance. At its meeting of November 7, 1978, the Planning Commission took action to recommend approval of this use permit by a 6-1-0 vote. Attach. PJS:jw RESOLUTION NO. 1745 PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF THE APPLICATION OF MR. RONALD PECK AND THE BRONDON CORPORATION FOR A USE PERMIT TO ALLOW VALET PARKING ON PROPERTY KNOWN AS 36 S. SECOND STREET (UP 78-15). After notification and public hearing as specified by law on the application of Mr. Ronald Peck and the Brondon Corporation for a use permit to allow valet parking on property known as 36 S. Second Street in a P-D (Planned Development/Commercial) Zoning District, as per the application of Mr. Ronald Peck and the Brondon Corporation filed in the office of the Planning Director on October 5, 1978, and after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all the evidence presented, the Commission did find as follows: That the establishment, maintenance, and operation of the proposed use wi 11 not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: (1) (2 ) Approval would be for six months (starting from date of City Council ratification). That an agfeement be submitted to both the Planning Commission and City Attorney whereby the tenants of the food, beverage, and entertainment areas located within the Factory have agreed upon a pick-up point as well as the regulations that govern the operations of the valets involved in this parking, and in addition there would be a statement whereby the owners of the Factory would restdct the 'valet to minimum inter- ference with the public p~rki~g lot lccated at the rear of the Factory.
