This office has examined the subject Agreement which
was approved by the Board of Supervisors of the County
of Santa Clara on August 14, 1967.
As far as this office can determine, the Agreement
does not obligate the City of Campbell tt? construct the
st.reet improvemem:s mentioned in t.he A<JJ:'eement.. The
only obligation that. t.he City of Campbell assumes i8 the
maint.enance of the improvement.s after const.ruction.
Since the improvement.s have not. been construct.ed, the
City of Campbell a.sumes no obligat.ion whatsoever.

1967 Aqreement for Street Improvement
It appears to me that both the City and the County
have fulfilled their obligations of the agreement.
The County specifically excluded (Paragraph 2)
building curb, gutter, sidewalk, and street lighting.
They did build a county "urban" type street.
More important, the City's only real obligation was to
"maintain the (existing) street." (Paragraph 9)
I cannot see any way the agreement could be construed
to include any further improvements or obligations on
the part of either agency.

Dear Mr. Kelley:
This letter will confirm our telephone conversation regarding
your request relative to reimbursement for a portion of the
off-site street improvements required in connection with the
development of the new Apostolic Church on West Parr Avenue.
As a matter of backgroudd information, all of the off-site
street improvements required by the City in connection with
this development are pursuant to the applicable sections of
t.he Campbell Municipal Code as they are commonly applied to
all subdivisions and spot developments within the City. The
specific requirements were incorporated into that certain
agreement entered into between the church and the City of
Campbell in August of 1.71 and also as specified on those
improvement plans submitted by Allied Engineering to the City
of Campbell in September of 1971.
Specifically in response to your request, it is the policy of
the City of Clmpbell that the developer of a parcel of land
abutting a public street shall be responsible for all of the
required improvements abutting his property on his side of the
street. This requirement would embrace the street paving
section, the curbs, gutters, and sidewalks, catch basins if
determined necessary, fire hydrants if determined necessary,
electroliers if determined necessary, and any and all other
standard appurtenances to the above. If is our belief that this
represents an equitable treatment for the developers inasmuch as
these types of improvements are common and the predetermined
spacings generally equate between various parcels in regard to
total expenditures per foot per frontage.

Gentlemen:
Before the City of Campbell would allow the New Apostolic Church to
construct a church building at 650 West Parr Avenue the church was
required to install certain street improvements.
It is usual and in accordance with standard practice of most California
cities to require the owner to improve the street and sidewalk directly
in front of their property. This the New Apostolic Church did to City
of Campbell's specifications and at the churches expense.
However, the church was also required to install an electrolier in front
of their property at cost to the church of $2,459.58. Now this charge
is not equitable and not in accordance with standard practice of California
cities for the following reasons.
If the entire street were improved at one time, the electroliers would have
been placed approximately 150 ft. on center alternating across the street.
This would mean that each 300 feet of property would pay for one electro-
lier. The New Apostolic Church front property line is 151.47 feet.
Therefore, they should only pay ( 151.47 x 2,459.58) $1,241.84 of the
cost to install this electrolier. 300.00
Since the entire street is not now being improved the City of Campbell
could refund to the church as the street is improved in the same manner
that the Sanitary District will do as property owners on West Parr con-
nect on to the sewer main that the church installed at their cost.

It is not equitable to require the New Apostolic Church to install more
than their fair share of street improvements. Therefore, we request
that the City of Campbell take whatever action is necessary to correct
this inequity.

Enclosed please find an agreement entered into by and between
the County of Santa Clara, the City of Campbell, and various
property owners on West Parr Avenue.
Mr. Al Tapella, Realtor, of Maxwell Realty, 2050 South
Bascom Avenue, Campbell, California, brought this agreement
in to me and he says that the property owners are of the opinion
that the County of Santa Clara and the city of Campbell are
committed to construct and maintain street improvements upon
West Parr Avenue in exchange for the right-of-way dedication.
May we please get an unofficial opinion from Mr. Dempster.
