1201 W. Parr Ave. (80-10) ORDINANCE NO. 1456 ~ fbAyeL- ~ BEING AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF CAMPBELL, CALIFORNIA (Up 80-10). The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell, together with amendments thereto, is hereby changed and amended when the existing Interim Zone is lifted. Said amendments being outlined on the map attached hereto entitled Exhibit A. SECTION TWO: This ordinance shall become effective 30 days following its passage and adoption and shall be published once within 15 days upon passage and adoption in the Campbell Press, a newspaper of general circula- tion in the City of Campbell, County of Santa Clara. RESOLUTION NO. 2182 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A CHANGE TO THE ZONING MAP AS SHOWN IN EXHIBIT A ONCE THE EXISTING INTERIM ZONE IS LIFTED. (APPLICATION OF PEN LAND & CATTLE CO., UP 80-10) After notification and public hearing as specified by law on proposed amendments to the Zoning Map of the City of Campbell and after pre- sentation by the Planning Director, proponents and opponents, the Planning Commission did determine that the change as shown in Exhibit A, attached, should be made to the Zoning Map when the Interim Zone is lifted, based on the following findings: 1. The proposed zone change is consistent with the land Use Element of the General Plan which shows "Low-Medium Density Residential" for the subject property, 1201 w. Pa rr A venue. 2. The proposed zone change from Interim to PD would allow the development of six townhomes. 3. The proposed zone change will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such zone change or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. 4. The proposed zone change is consistent with the Land Use Element of the General Plan. The Planning Commission of the City of Campbell recommends that the City Council enact the Ordinance attached hereto as Exhibit A making effective the recommended changes to the Zoning Map. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse. garbage. wet garbage and rubbish produced within the limits of the city of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business. industrial, manufacturing, and construction establiShments. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. Applicant shall comply with all appropriate State and City require- ments for the handicapped. Noise levels for the interior of residential units shall comply with minimum ~tate (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. Parr Avenue in an Interim (Low- Medium Density Residential) Zoning District, as per application filed in the Office of the Planning Department on April llt 1980, and after presentation by the Planning Directort proponents and opponents, the hearing was closed (UP 80-10). After due consideration of all evidence presented, the Commission did find as follows: , That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to the property and improvenents 1n the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: 1. Property to be fenced and landscaped as indicated and/or added in red on plans. 2. landscaping plan indicating type and size of plant mlterial. and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director prior to application for building permit. 3.
