Dear Mr. Nowack:
Your letter of September 20, 1983 requests permission to revise the approved
plan for Tract No. 6973 in the City of Campbell to allow a direct cormection
to the existing 48 inch storm drain in Los Gates, in lieu of a manhole.
The cormection will be allowed with the following conditions:
1. The contractor shall obtain an encroachment penni t from the Town
(contact Gene Campbell) for cormecting to the Town storm drain.
2. At the time of application for the encroachment penni t, we will need
two prints of the approved plan, including cormection detail.
3. Provide the Town with our standard storm drainage fee. The fee based
on our fee schedule would be $2,000.00 per gross acre, plus $ 75.00 per
unit in excess of two units. The minimum fee is $500.00. Credit
at $12.00 per foot for 47 feet of 12 inch ReP should be subtracted from
the total fee. Please provide us the net fee a.."ld fee calculation prior
to our issuance of the encroachment penni t.

Dea r Mr. Nowack:
This letter is to confirm our telephone conversation today regarding your
two requested changes to the approved plans for Tract 6973 on West Parr
Avenue.
First is the storm manhole. The City of Campbell requires that a storm
manhole be installed on the existing 4811 main at the point of connection
of the 1211 lateral, as shown on the approved plans. Jim Van Houten, Di rec-
tor of Publ ic Works at Los Gatos, has no problem with this installation,
and will issue the required permit upon appl ication and meeting their con-
ditions.
Second is the street section. We will approve your proposed revision to
the required street reconstruction detail. Please submit a copy of the en-
closed, approved plan with your appl ication for a Public Works permit for
the street construction work.

Gentlemen,
During the revie'l,lT of the plans for the improvement of West Parr
Avenue in connection with Tract 6973, we were required to remove
the existing pavement on West Parr Avenue and repave with 4-1 /2
inch deep lift asphalt concrete. The reason given for this
requirement W8B the lack of records on the existing pavement
section.
We have retained Terrasearch, Inc. to make a field investigation
of the existing pavement. They found that it consisted of 4-1/2
inch asphalt concrete over 12 to 14 inch aggregate base. This
far exceeds what we have been asked to replace it with.
I would propose that we accept the recorrrrnendation of Terrasearch
and overlay the existing pavement with 1-1 /2inch ashal t concrete
to give it a "new" appearance and to cover the trench patching.
This will result in 6 inches asphalt conrete over 1 2 inches
8€"gregate base. We are enclosing a "Typical Section" of our
proposed section.

BEING A RESOLUTION APPROVING FINAL MAP OF
TRACT NO. 6973, LOCATED ON THE NORTH SIDE
OF WEST PARR AVENUE, AND AUTHORIZING THE
MAYOR TO SIGN THE PROPOSED AGRtEMENT
WHEREAS, there has been submitted to the City Council of the City
of Campbell a final map of Tract No. 6973, located on the north side
of West Parr Avenue, for approval;
WHEREAS, an agreement, approved by the City Attorney as to form,
which covers certain conditions of approval of said map has been
presented;
WHEREAS, the City Engineer has certified that the map conforms to
Subdivision Map Act and City ordinance;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Campbell that said map be, and the same is hereby, approved, and
that any real property offered for dedication for public use is ac-
cepted on behalf of the public in conformity with the terms of the
offer of dedication.
BE IT FURTHER RESOLVED that the Mayor be, and he is hereby, author-
ized to execute said agreement on behalf of the City of Campbell.

The following items are needed in order to place the subject Tract Map on the
City Council agenda for final approval:
1. The Final Tract Map, signed and notarized.
2. The improvement plans signed by County Sanitation District No.4.
3. A letter of release from County Sanitation District No.4 saying that
all of their conditions have been met.
4. Letters from PG&E and PT&T saying that easements shown on the revised Final

5. A copy of the CC&R's for our review, if they are different from the ones

Tract 6973 located on the north side of Parr Avenue. The plan shows
a connection to the existing 48-inch RCP in W. Parr Avenue within
the TOhn of Los Gatos. It is our policy to require manhole connections
to stonn drain mains. The plans should be revised to show the stonn
manhole and a note that an Encroachment Pem t from the Tmvn will be
required for the work in tmYll.
Since the on-site drainage is tributary to the existing 48-inch RCP
in W. Parr Avenue, it will also be necessary to pay a drainage fee
to tt"'le Tm\ll. The amOl.mt of the fee is $690 based on 0.406 acres at
$1,700 per acre. We will issue an Encroadunent Penni t upon submission
of revised plaIls ffild payment of the drainage fee plus $30.00 E.lcroach-

The following conditions of approval are recommended concerning the subject tenta-
tive subdivision map submitted by Nowack and Assoc., Inc.
Installation of a sanitary sewerage system to serve all lots within the sub-
division in conformance with the proposed plans of the County of Santa Clara
Sanitation District No.4. Sanitary sewerage service to be provided by said
1. District No.4.
Installation of water distribution system to serve all lots within the sub-
division in conformance with the plans of the San Jose Water Works. Water
2. service to be provided by said water company.
Subdivider shall create or provide any public service easement and any other
public utility and/or public service easements as may be necessary for the
3. installation of any and all public utilities and/or facilities.
Compliance with the provisions of Title 20, Subdivisions of the Campbell
4. Municipal Code.
5. Subdivider to pay Storm Drainage Area Fee based on $765 per net acre.
6. Subdivider to furnish copy of Preliminary Title Report.
Subdivider shall install street improvements in accordance with the requirements

We have reviewed the tentative map and are forwarding our
requirements to Paul Nowack and Associates. The developer
of this property is obligated to install 84 feet of sanitary
sewer main in West Parr Avenue plus what is required internally
to serve his tract.
Also, the developer, Nello Santacroc~ of Tract 6538, Town of
Los Gatos, is obligated to install a portion of the main sewer
in West Parr Avenue. We are requesting that both parties
contact one another in an effort to make this a joint venture.
By a copy of this letter I am advising Mr. Santacroce that his
agreement for District cost participation will lapse July 15, 1980.
Prior to recording a map of the lands of Heaviside, the following
will be required: 8% plan check fee and inspection deposit;
100% performance bond fee; deposit and bond will be on the esti-
mated cost of sanitary sewer construction.
There is a connection permit #24602 issued for the existing
residence on the site. Prior to obtaining a connection permit
on each condo unit $88.50 plus pro rata sewer service charges
will be due. Rates are effective until 7/1/81.
