Re: Application of Elmo Pardini: Set Back Lines
This letter is in reply to yours of February 1, 1966 with refer-
ence to the above matter.
It is my position that the City may require the applicant to
conform with the plan line although I have previously ruled that
we cannot require him to dedicate from the plan line on a
private easement. A requirement to set back the building does
not, in my opinion, constitute either direct or inverse condem-
nation. The only prohibition would lie in those cases where
by reason of the set back lines the lot size was so diminished
as to deprive the owner from any reasonable use of the property.
(203 CA 2nd 602). For your information, I will cite Gorieb v.
Fox 274 U. S. 603 wherein the court in upholding the building line
ordinance of Roanoke, Virginia said:
"It is hard to see any controlling difference between
regulations which require the lot owner to leave open
areas at the sides and rear of his house and limit the
extent of his use of the space above his lot and a
regulation which requires him to set his building a
reasonable distance back from the street. Each inter-
feres in the same way, if not to the same extent, with
the owner's general right of dominion over his property.
All rest for their justification upon the same reasons
which have arisen in recent times as a result of the
great increase and concentration of population in urban
communities and the vast changes in the extent and
complexity of the problems of modern city life."
I also make reference to the decision of the Supreme Court of
Florida in upholding the validity of set back lines of the City
of Miami in which the court said:

"The fact that, as shovm by the testimony adduced at the
trial, the city officials may have had in mind an eventual
widening of the ri~ht-of-way on the particular street
abutting appellees property does not, in our opinion,
constitute a 'taking' of the appellees' property for public
use, 't'lithin the meaning of Article XII of the Declaration
of Rights. Until such time as the city officials find
that the public interest 'tvill be best served by condemning
all or any portion of the lv-foot strip for street pur-
poses, the property owner is free to use such strip of
land in any lawful manner and for any lawful purpose,
except the construction of a building thereon. And, as
heretofore shown, the appellees have already llsed a portion
of the lO-foot strip abutting their property for their own
purposes, to wit, the construction of a five-foot sidewalk
adjoining their building."
These matters are clearly supported by the text in Yokley on
Zoning Law and Practice, particularly Sections 162, 163, and 164.
There are, of course, California authorities in line with these
decisions.

Section 9316.1 of the Campbell Municipal Code reads as follows:
Any approval granted under this section shall expire one hundred eighty
(180) days after the date upon which such approval was granted, unless
an extension for such approval is obtained by making written application
for same to the Planning Commission at least fifteen (15) days prior to
the expiration date of such approval.
No building permit shall be issued after the expiration date of any
approval until a nC"l approval has been obtained in the manner provided
for in this chapter.
