RESOLUTION NO. 5239
BEING A RESOLUTION APPROVING FINAL MAP
OF TRACT NO. 6107, SAN TOMAS AQUINO ROAD
EAST OF HARRIET AVENUE, AND AUTHORIZING
THE MAYOR TO SIGN THE PROPOSED AGREEMENT.
WHEREAS, there has been submitted to the City Council of the
City of Campbell a final map of Tract No. 6107, San Tomas Aquino
Road ejo Harriet Avenue, for approval; and,
WHEREAS, an agreement, which covers conditions pertaining to
the approval of said map and acceptance of the dedicated streets,
has been presented; and,
WHEREAS, the City Engineer has approved the map to the effect
that it conforms;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Campbell that said map be and the same is hereby approved, and
that the streets, avenues and public ways shown thereon be and the
same are hereby accepted; and,
BE IT FURTHER RESOLVED that the Mayor be and he is hereby
authorized to execute said agreement on behalf of the City of
Campbell.

A G R E E MEN T
THIS AGREEMENT, (identified as No. Lvl. (28) made and entered into this
day of , 19 , by and betweer EDWARD E. CAMPBELL and
CHESTER H. SPIERING, JR. hereinafter referred to as "Subdivider" and the
CITY OF CAMPBELL, amunicipal corporation of the County of Santa Clara, State
of California, hereinafter referred to as "City".
WHEREAS, Subdivider desires to subdivide that certain real property
situate within the City of Campbell in accordance with that certain map here-
tofore filed in the office of the City Clerk of City, marked and designated
"Tract No. 6107, consisting of one sheet, being a portion of Lot, as shown
upon that certain map entitled 'Map of Subdivision of the Lovel Tract, recorded
in Book 'F-l' of Maps, at page 5, Santa Clara County Records, City of Campbell,
Californin~;and
WHEREAS, said map shows a certain court and easements which are offered
for dedication for public uses; and,
WHEREAS, Subdivider desires to construct dwellings upon the lots shown
upon said map of Tract No. 6107; and,
NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED TO by and between the
parties hereto as follows:
(1) In consideration of the approval of said map and of the acceptance
on behalf of the public of said court and easements offered for dedication,
Subdivider shall provide and construct and/or install at his own proper cost
and expense, within said Tract No. 6107, public improvements as follows:
FIRST: Provide and construct City of Campbell residential sidewalk,
curb and gutter, residential driveway approaches which extend from the back
of the curb and gutter to the back of the sidewalk, all consisting of Portland
Cement Concrete, as shown upon the improvement plans for said Tract No. 6107
approved by the City Engineer of City.
SECOND: Provide and construct City of Campbell standard pavement
structures consisting of untreated crushed rock base course and asphaltic
concrete surface course or approved equivalent, in accordance with said
approved improvement plans.
THIRD: Grade said Tract No. 6107 in accordance with approved building
plans.

FOURTH: Provide and install City of Campbell standard regulatory signs
and sign posts therefor, as shown upon said plans.
FIFTH: Provide and install City of Campbell standard street light
steel poles, with upsweep bracket arms, luminaires, with individual integral
photoelectric cells, electrical underground conduits with conductor and
junction boxes, all as shown upon said plans and as approved by said City
Engineer.
SIXTH: Provide and install or cause to be installed, a water dis-
tribution system, including fire hydrants and appurtenances to serve all
lots within said Tract No. 6107 as shown upon said plans.
SEVENTH: Provide and install a sanitary sewerage system to serve all
lots within said Tract No. 6107 as shown upon said plans.
EIGHTH: Provide and install an underground electrical energy system
and an underground telephone system to serve each lot within said Tract
No. 6107.
NINTH: Provide and plant street trees of a variety and size as
approved by the City Engineer.
(2) It is further agreed to that all of said improvements shall be
constructed and/or installed within twelve (12) months from the date first
above written; provided, however, that in the computation of said twelve-
month period, delays due to or caused by acts of God, viz., unusually
inclement weather, major strikes, other delays beyond the control of Sub-
divider shall be excluded.
It is expressly understood and agreed to that if Subdivider shall fail
to complete the work required by this agreement within the said period of
twelve (12) months from the date hereof, the City, after giving ten (10)
days written notice thereof to Subdivider, may construct and/or install said
improvements and recover the full cost and expense thereof from Subdivider.
(3) It is further agreed to that all of said improvements shall be
constructed and/or installed in accordance with those plans approved by the
City Engineer of the City of Campbell, and shall be made under the supervision
and inspection and to the satisfaction of the City Engineer. It is further
agreed to that said construction and/or installation be in accordance with
the existing ordinances and resolutions of the City of Campbell, and to all
plans, specifications, standards, sizes, lines and grades approved by the
City Engineer, and all State and County statues applicable thereto.
(4) It is further agreed to that the construction work of the improve-
ments embraced by this agreement shall be done in accordance with the standard
specifications of the Department of Public Works, Division of Highways, State
of California, dated January, 1973 and in accordance with the specifications
of the City of Campbell, and Sanitation District No.4 of the County of Santa
Clara, where indicated.

WHEREVER the word "State" or words "Division of Highways" are mentioned
in the State Specifications, it shall be considered as referring to the City
of Campbell. Also, wherever the "Director" or "Director of Public Works" is
mentioned, it shall be considered as referring to the City Engineer.
In the case of conflict between the State Specifications and the Spec-
ifications of the City of Campbell and Specifications of County Sanitation
District No. 4 of Santa Clara County, the Specifications of the City of
Campbell and County Sanitation District No.4 shall take precedence over and
be used in lieu of such conflicting portions.
(5) It is further agreed to that Subdivider shall deposit with City,
upon execution of this agreement, for office examination of improvement
plans, field examination of improvements, inspection of construction of
improvements, and all necessary expenses incurred by City in connection of
said Tract No. 6107 the sum of FIVE HUNDRED SEVEN DOLLARS ($507.00).
(6) It is further agreed to that Subdivider shall file with City, upon
execution of this Agreement, a bond in the amount of SEVEN THOUSAND TWO
HUNDRED FIFTY DOLLARS ($7,250.00) to insure payment for labor and materials,
and bond in the amount of FOURTEEN THOUSAND FIVE HUNDRED DOLLARS ($14,500.00)
to insure full and faithful performance of the construction of all the
aforementioned improvement work, excluding sanitary sewers and water dis-
tribution system. Said bonds shall guarantee that Subdivider will correct
any defects in the aforementioned improvement work, excluding sanitary sewers
and water distribution system. Said bonds shall guarantee that Subdivider
will correct any defects in the aforementioned improvements which shall
appear within one (1) year from the date of acceptance of the work by City
and pay for any damage to other work resulting from the construction thereof,
as well as paying the cost of all labor and materials involved. These bonds
shall remain in full force and effect until one (1) year after the date of
final acceptance of said improvements by City.
(7) It is further agreed to that Subdivider shall pay City, for storm
drainage area fee in conformance with Section 20.16.060 of the Municipal
Code of City the sum of EIGHT HUNDRED FIFTY DOLLARS ($850.00).'
It is further agreed to that City reserves the right to revise the
storm drainage system upon the approved improvement plans for said Tract
No. 6107 provided Subdivider is given a reasonable written notice of City's
intention to make revisions.
(8) It is further agreed to that Owners shall make such deposits or
file such bonds and enter into such agreement as required by Sanitation
District No.4 of Santa Clara County to insure the installation of a sanitary
sewerage system to serve said Tract No. 6107 and that Subdivider shall file
with City, upon execution of this Agreement, a letter, from said Sanitation
District No. 4 of Santa Clara County stating Subdivider has made such deposits
or filed such bonds and entered into such agreements.

(9) It is further agreed to that Subdivider shall pay to Pacific
Gas and Electric Company any and all fees required for installation of
underground wiring circuit to all electroliers within said Tract No, 6107
when Subdivider is notified by either the City Engineer of Campbell or
the Pacific Gas and Electric Company that the said fees are due and
payable.
(10) It is further agreed to that Subdivider shall make such
deposits or file such bonds and enter into such agreement as required by
San Jose Water Works when called upon to do so to insure the installation
of a water distribution system to serve said Tract No. 6107.
(11) It is further agreed to that any easement and right of way
within or without Tract No. 6107 necessary for the completion of the
construction and/or installation of any and all of the public improve-
ments embraced by this agreement and as may also be otherwise shown
upon the improvement plans for said Tract No. 6107 shall be acquired
by Subdivider at his own cost and expense. It is provided, however,
that in the event eminent domain proceedings are required for the purpose
of securing said easement and right of way, the Subdivider shall deposit
or cause to be deposited with City a sum covering the reasonable market
value of the land proposed to be acquired and to be included in said
sum shall be a reasonable allowance for severence damages, if any.
It is further provided that in additional thereto such sums as may
be required for legal fees and costs, engineering, and other incidental
costs shall be deposited with City.
(12) It is further agreed to the Subdivider shall carry out any
and all negotiations with all interested parties and shall perform or
cause~o be performed at his own cost and expense and to the satisfaction
of the City Engineer any and all work required to abandon, remove, raise,
lower, relocate, and otherwise modify irrigation line or lines within the
boundary of said Tract No. 6107.
(13) It is further agreed to that Subdivider shall indemnify and
save harmless the City of Campbell, the City Council, the City Engineer,
and all other officers or employees of City from any suits, claims,
or actions brought'byany person for or on account of any injuries or
damages to persons or property sustained during or arising out of the
construction of the on-site work due to any acts, omissions, or
negligence of Subdivider, his officers, agents, employees, or contractors.
(14) It is further agreed to that the above named terms and
conditions shall bind the heirs, successors, administrators, or assigns
of the Subdivider.

ENGINEERING
Installation of a sanitary sewerage system to serve all lots within the
subdivision in conformance with the proposed plans of the County of
Santa Clara Sanitation District No.4. The septic tank on lots 4 and 7,
shall be filled and the existing house connected to sanitary sewer.
2. Installation of ~ter distriwtion system to serve all lots within the
subdivision in conformance with the plans of the San Jose Water Works.
Water service to be provided by said San Jose Water Works. Fire hydrants
and appurtenances shall be provided and installed at the locations
specified by the Fire Chief, Fire Department, City of Campbell. Fire
hydrant rental fees shall be paid to City at the rate of $195.00 per
fire hydrant. The well on lot shall be sealed.
3. Subdivider shall create or provide any Public Service Easement and any
other publ ic utility and/or public service easements as may be necessary
for the installation of any and all public utilities and/or faci lities.
4. Compl iance with the provisions of Title 20, Subdivisions, of the Campbell
Municipal Code.
5. Subdivider to pay Storm Drainage Area Fee.
6. Subdivider to furnish copy of Preliminary Title Report.
7. Lots 2, 3, and 4 to be combined into one lot.
8. Subdivider shall enter into an agreement with City and post bonds for
street improvements within the cul-de-sac and along the frontage of
San Tomas Aquino Road as required by the City Engineer.

Gentlemen
Pursuant to the above subject, a sanitary sewer extension will have
to be made from the main stubbed at the end of Lamont Court.
By a copy of this letter we are forwarding information on the existing
sewer in Lamont Court and a suggested layout for the sewers to be
installed to the engineer.
Prior to recording a map, the following will be due:
Frontage Fee None
Acreage 1.393 Ac @ $150.00/Ac $208.95
Eight percent plan check fee and inspection deposit, these costs are
based on the estimated sanitary sewer construction cost. Also a
100% performance bond to insure the completion of the sanitary sewer
will be required.
Upon application for a connection permit $111.25 will be due on each
lot (rates effective until 7/1/77)

Environmental Health Services has reviewed the proposed 7 lot
subdivision, located on San Tomas Aquino Road, as shown on
a tentative map submitted to this department dated April, 1977,
prepared by Civil and Construction Consultants, Inc., Civil
Engineers. It is noted that there are 7 numbered single family
residential lots.
Sewage disposal is to be provided by sanitary sewers installed
by the subdivider and connected by him to one of the existing
trunk sewers of the Santa Clara County Sanitation District
No.4. The subdivision is in the service area of and shall
be furnished domestic water by San Jose Water Works.

Final approval of the proposed subdivision is contingent
upon the posting by the subdivider with the Santa Clara County
Sanitation District No. 4 of an adequate bond to insure

by Sanitation District No. 4 prior to recording the final map.
Subdivider must agree to permit no occupancy of any otherwise
completed residences until usable sanitary sewer connections
have been effected.
