BEING A RESOLUTION AUTHORIZING EXECUTION OF
RELEASE OF AGREEMENT WITH FRANK AND MARLENE
BONACICH FOR THE INSTALLATION OF STREET
IMPROVEMENTS AT 131 SHELLEY AVENUE
WHEREAS, a certain agreement recorded in Book 0024 of Santa
Clara County Official Records at page 328 was entered into by
and between Frank and Marlene Bonacich, referred to therein
as OWNERS, and the City of Campbell, a municipal corporation
referred to therein as CITY, relative to construction of cer-
tain street improvements across lands described therein; and
WHEREAS, the owners, their successors or assigns have fulfilled
all the terms and provisions as contained in said agreement;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Campbell does hereby release the owners as above set
forth, their heirs, successors, or assigns from all obliga-
tions contained in said agreement, and terminates said agreement.

RESOLUTION NO. 6929
BEING A RESOLUTION ACCEPTING STREET
IMPROVEMENTS AT 131 SHELLEY AVENUE
WHEREAS, the City Council has been advised by the City
Engineer that all street improvements at 131 Shelley
Avenue have been completed in accordance with that
agreement entered into September 11,1972, and
identified as W.O. (5); and
WHEREAS, The City Engineer recommends acceptance of
said street improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council that
the street improvements at 131 Shelley Avenue are hereby
accepted, and that the City Engineer is hereby ordered
to record a Notice of Completion of said street improve-
ments.

an agreement to this City Council for the development of their
real property located at 131 Shelley Avenue .in accordance with
prescribed conditions; and,
~~EREAS, in accordance with said prescribed conditions and
as specified and recited in the agreement and concurrently here-
with Frank Bonacich and Marlene Bonacich have submitted a Grant
Deed of certain portions of their real property for public
street purposes and related public uses (including public utility
easements, public service easements, storm sewer easements); and,
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by this City
Council that said agreement is hereby accepted and that the Mayor
be and he is hereby authorized and directed to execute said
agreement on behalf of the City of Campbell; and,
BE IT FURTHER RESOLVED by this City Council that the said
Grant Deed submitted in accordance with said prescribed conditions
be and it is hereby accepted for the purposes for which it is
offered.

Section
21.42.090 of the Campbell Municipal Code reads as follows:
Any approval granted under this section shall expire one year after
the date upon which such approval was granted, unless an extension
for such approval is obtained by making written application for same
to the Planning Commission at least fifteen (15) days prior to the
expiration date of such approval.
No building permit shall be issued after the expiration date of any
approval until a new approval has been obtained in the manner provided
for in this Chapter.

"S" 72-11 CONDITIONS OF APPROVAL
1. Property to be fenced and landscaped as indicated on plans.
2. LAndscape plan indicating type of plant material, location of
_hose bibs or sprinkler system and type of fencing to be sub- .
mitted for approval of the Planning Director at time of appli-
cation for building permit. All planter areas to be enclosed
within 4" to 6" raised concrete curbs.
3. Landscaping shall be mairt4ined in accordance with the approved
landscape plan. .
4. Faithful performance bOIld'1n tfie-amount of $1,000.00 to be
posted to insure landscaping, fencing and striping of parking
area within three (3) months of completion of construction or
applicant may file written agreement to complete landscaping,
fencing and striping of parking area prior to final building
department clearance.
S. Trash containers of a size and quantity necessary to serve
the development shall be located in area(s) approved by the
fire department. Unless otherwise noted, enclosure(s) shall
consist of a concrete floor surrounded by a solid wall or
fence (Six feet high and sight obscuring) and have self-Closing
doors of a size specified by the fire department.

A. All parking and driveway areas to be developed in compliance

Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed
until application is approved and a permit issued by the
building department.
Applicant to dedicate to 60 foot right-of-way on Shelley Avenue.
Applicant to sign an agreement and post a bond with the City
of Campbell for future street improvements.
Applicant to pay storm drainage fee in the amount of $250.00
Fire extinguishers shall be mounted in approved cabinets with
breakable glass fronts.
The applicant is notified that he shall comply with all applicable
Codes or Ordinances of the City of Campbell which pertain to this
development and are not herein specified.
