WHEREAS, there has been presented to Oity Counoil of
Campbell a Transfer of T1tle transferr1ng and oonvey1ng all
right, ~tle and interest in and to storm sewer system to
serve Traot No. 1560, Exoelsior Manor, from Mrs. Anne Sobrato
to the City of Campbell. a munioipal oorporation; and
WHEREAS. the Oity Eng1neer hRs explained the neoessity
for said Transfer of Title, and has reoommended the aooept-
anoe of same; and
WHEREAS, the 88id Transfer of Title is approved by the
City Attorney for the purpose for which it has been offered:

COUNTY SANITATION DISTI1ICT No.4 OF SANTA CLARA COUNTY, a body
politic and corporate, hereinafter called the Grantee, the right
to locate, maintain, construct, repair, replace and use, for the
conveyance of sewage, such pipe line or lines as the Grantee shall
from time to time elect, within the hereinafter described strip of
those certain premises which are situate in the County of Santa
Clara, state of California, said strip being more particularly des-
cribed as follows:
A strip of land 10.00 feet in width, 5.00 feet on each side of a
center line described as follows:
Beginning at a point in the southerly line of that certain 7.55
acre tract of land conveyed to California Pacific Title Insurance
Company by deed recorded' June 20, 1952, in Book 24Li{)~ page Ll-5,
Santa Clara County Official Recorcls, distant thereon easterly
363.73 feet from the center line of Virginia Avenue; thence South
270l0'4Lj,1I 'llest 72.73 feet, more or les8, to the northeasterly
line of the lL!'.79l acre tract conveyed to Frank lv'iaggiore by
deed recorded in Book 1878.,page 269, Santa Clara County Official
Records, containing 0.017 acres, more or less.
GRANTOR_ HEREBY FURTHER GRANT TO THE GRANTEE:
(1) The right to the use of such land on each side of the
hereinabove described 10
foot strip as may be reasonably neces-
sary for the deposit of earth and building materials, etc., during
the construction of said pipe line or lines.
(2) The right of ingress and egress to the hereinabove des-
cribed right of way from the intersection point of said described
right of way and such roads or lanes as may exist, and if no roads
or lanes exist, then over such routes as shall be the most conven-
ient to the Grantor_.
THE FOHEGO r:ers SUBJECT TO THE FOLLO~n_ EXPRESS
CONDITIONS:
(a) Grantor_ may acquire the right to connect to, and the
use of, the sewer by making formal application to, and complying
with t~e ORDINANC?S of, the Grantee.
(b) Grantor_ shall not erect nor construct any building or
other structure, nor drill or operate any sort of well, within
the limits of the above described right of way.
(c) Grantor_ shall be reimbursed by the Grantee for damages
to crops, trees, etc., incurred in the performance of the main-
tenance and/or repair of said pipe line or lines outside the limits
of the hereinabove described right of way.
(d) Grantor_ shall be reimbursed by the Grantee for damages
to any shallow root plants and/or shallow root crops, incurred in
the performance of the maintenance and/or repair of said pipe line
or lines within the limits of the hereinabove described right of
way.
(e) Grantee shall have the right to erect, maintain and use
gates in all fences which cross or hereafter may cross said strip
or premise.
(f) The easement herein granted to Grantee is nonexclusive
and the Grantor_ reserve the right to grant easements to others for
any purpose whatsoever, in, over, or under the lands of the
Grantor_ affected by this agreement, if such grants are not incon-
sistent with the use and convenants of thls agreement.
(g) Grantee will indemnify Grantor~ or, at the option of the
Grantee, shall have replaced in kind, any or all loss or damage
which may be caused by the exercise of said ingress and egress for
the performance of the maintenance and/or repair of the said pipe
line or lines or by any wrongful or negligent act or omission of
Grantee or its employees in the course of their employment.
Grantor shall file claim, in writing, for damages with the office

of the Grantee within sixty (60) days from date of the occurance
of said damages.
The provisions hereof shall inure to the benefit of, and
bind, the helrs, successors and assigns of the respective parties
hereto.
