southeasterly along a northeasterly boundary line of said Tract No.
2351 to an angle point in the northeasterly line of Lot 31 of said

NO. 2351, SUNNYBROOK GARDENS, UNIT NO.2; ACCEPT-
ING THE DRIVE, WAY, COURTS, ROADS, AND STREETS;
AUTHORIZING THE CITY ENGINEER AND CITY CLERK TO
SIGN THE FINAL NIAP; AND AUTIIORIZING AGREEMENT IN
CONNECTION THEREWITH.
WHEREAS, THERE HAS BEEN PRESENTED TO THE CITY COUNCIL for
approval and for authorization to record a final map of Tract No.
2351, Sunnybrook Gardens, Unit No.2, being a portion of Lots 1,
2, and 11 of the Resubdivision of the E. N. Parr Subdivision, show-
ing streets and drives; and
WHEREAS, there has been presented to the City Council pro-
posed agreements for the construction of improvements, including
street, court, drives, way, roads, sidewalks, curbs, and gutters,
and good and sufficient bonds have been presented for the faithful
performance of said work and the carrying out of said agreements;
and said maps, agreements, and bonds having been approved by the
City Engineer and City Attorney; now, therefore,
BE IT HiSOLVED, that said Final Map of Tract No. 2351,
Sunnybrook Gardens, Unit No.2, being a portion of Lots 1, 2, and
11 of the Resubdivision of the E. N. Parr Subdivision, be and the
same is hereby approved; and the street and drives shown thereon
be and the same are hereby accepted; and the City Engineer and the

Gentlemen:
At the Council meeting on December 29, 1958 a question
was raised in respect to a proposed local improvement district
including the above subdivision as to whether the Council had
the authority and could legally proceed in the formation of such
a local improvement district for the purpose of installing streets
and other improvements including drainage facilities. I have
discussed the matter of the proposed local improvement district
with Mr. Arthur J. Harzfeld, an attorney who is a very good
friend of mine and with whom I have worked in connection with
various legal matters and who has had wide e:::perience in the
formation and completion of assessment districts of all kinds
and he confirmed my opinion that the assessment district, which
I am proposing for the City of Campbell, which includes the above
subdivision. and portiol1s of other property, is feasible, legal,
and may be readily accomplished if it is the will of your Council.
Mr. Harzfeld expressed his views to me in the form of a letter
dated today which I am enclosing. I would appreciate it if I
may appear before you again at your meeting of January 12 in
respect to an expression of the views of your Council in this
matter.

GENERAL SUM,MARY
I.
1. 1911 Act Proceedings and Bonds will require the following from City:
a. Conduct and oversee proceeding s (publ ic) :
(1) Hearing upon 10c8l improvement district formation
(2) Bid opening a,nd award of construction contract
(3) Hearing upon equity of assessments
b. Engage district engineer (City or private).
c. Engage bond attorney, plus added services from City Attorney.
d. Nearly all costs incurred by Ci ty under proceedings may be
Chargeable to assessment; but if no bids are received, or
job not awarded, City would be responsible for all costs
incurred (between 10% - 15% of constructions costs on LIDs
under $100,000).
e. No guarantee by City if default of payments by property
owners benefitted.
2. 1913 Proceedings - 1911 Act Bonds
a,. All features in a,bove 1911 Act Proceedings and Bonds
b. More leniency allOWing the inc Insion of more City deposi ts and
fees than 1911 Act.
3. 1913 Act Proceeding-1915 Act Bonds wj,ll require the fo llowing from
Ci ty:
a. All features in above Items a" b, c, and d for 1911 Act.
b. City guara.ntees pa,yment of defaulted payments by property
owners to ma,ximum extent of $0.10 per $100 assessed val ua-
tion over the entire city per local improvement district
proceeding, 1. e., if 10 su'bdiv isons wer e completed by local
improvement district, maximum guara,ntee could obligate city
ta,xpflyers to $1.00 per $100 assessed valuation.
4. General comments - 1911 and 1913-1915 Improvement ActS.
a. Cities often use 1913-15 financing when a project is of
both city-wide and local benefit, i.e., Widening a, major
city street with a substantial city contribution to the
project.

b. Ci ties occa,siona lly use 1911 Act Bonds for subdivisions
since improvements are of local benefit, and City may not
desire to obligate ta.:x:payers of entire City to gua.rantee
pa.yments in default.
c. City will need sJ:lecial agreements to incorporate transition
from lira"." la.nd to recorded lots. There is mlDe questi on
a,s to what extent usua,l deposits a,nd fees may be included
in the assessment for the 1911 Act proceedings, while most all
of these ca.n be inc luded under 1913 Act pr oceeding s.
d. It should be noted that overhead costs under either proceed-
ings a.re generally in excess of these encountered by private
development, particularly on relatively small jobs.
e. If project does not ma.terialize, City is liable for all costs
incurred from concept of project to bid opening. 'l'bis lia-
bility could be minnmized by requiring a developer to post
a, deposit for these costs, prior to instigating proceedings.
