Dear Mr. ~ortensen;
In regards to my ap9lication for a bu~lding permit which was
Cb:1ditionally approvedby the City Council meeting on July 27,
1959, I wish to make the following observations.
1. The application so acted upon concerned a parcel l70'x
97.9' as described in a description appended thereto
along with, by reference, a parcel of approximately ~~
the same size lying to the north of said parcel and
indicated as a future development.
2. The above land constitutes my personal holding of a
parcel described in deed recorded June 12, 1957, in Book
3819, Offici~l Records, page 257, Santa Clara County
Records, which deed included, (as an expedient) a
portion actually bought and paid for by Jack H. Craig
and a portion owned, by virtue of the community property
laws of California, by my then wife, Madelyn Brown and
subsequently relegated to her personal interest by an
act of property settlement.
3. The decision made in June, 1957 by Mr. Craig, myself
and our respective wives to buy and use for industrial
purposes the 3 3/4 acre parcel described in deed recorded
June 12, 1957, involved a lengthy consideration of tthe
problems posed by the narrowness of this plot, and
ultimately assumed that reason would prevail in the
percentage of this narrow width th;:;t would be consumed
by a roadway.
4. It would be expedient to agree to a 66 foot road upon
conditions which would conceivably never come about,
that is, the sale by myself of any part of my personal
holding as defined in sub-paragraph (1) of this letter.
Beyond this expedience, the mere thought of more than
40 feet of roadbed subtracted from the total property
width of 196 feet is totally reprehensible both to my-
self and to Mr. Craig.

I must confess that the "intent" you speak of is not yet
clear to me. If the intent is toforestall the division of
the 3 3/4 acre parcel of reference in your"Agreement", I
am afraid this has already come about. If the intent is to
deny the reasonable use of this land by insisting upon a
"standard" which we owners can not meet, I am afraid the
loss will be felt by the City of Campbell as well. If the
intent is to insure adequate access to this property, I can
assure you that Mr. Craig and myself have thought long and
hard of this. If, finally, the intent is to protect future
owners, I believe a study of the wording of the deeds rele-
vant to this property will show that adequate access to all
parts tl1ereof is guaranteed in perpetua and that the respon-
sibility of each owner is clear.
In light of the above considerations, I cannot conscionably
sign the "agreement" you have presented to me. However, if
you will amend it in the way that ~ have indicated, I will
be glad to do so.
