I have no knowledge that contradicts anything contained in your letter to
Jeffrey Barnett, attorney for the homeowners association of Tract No.
8179.
Bill Seligmann is not aware of any statutory requirement for the City to
review the design of on-site pavement or inspect it during construction.
He doesn't believe the City has any liability exposure should the
homeowners fail to achieve monetary satisfaction from the developer.
Tim Haley has no recollection of City involvement in the creation of a new
easement to Santa Clara Valley Water District either before or after the
map was filed. He does remember the Water District complaining that the
actual construction of the project was interfering with their access to
the percolation ponds.
I called Don King at his home shortly before noon on Wednesday Jan 2nd.
but received no reply. I will try to talk to him as well as to Chuck Gomez
before the end of the week but anticipate no reason why your letter to the
attorney cannot be mailed as written.

Dear Jeff:
Following your question in November, I asked staff in the
Building and Engineering Divisions to review their files for
anything relevant to your inquiry as I understood it.
I will try to respond to the questions in your letter as
follows:
1) An application to develop the property now known as Tract
8179 was filed with the City's Planning Department on April
20, 1988.
2) Because the property adjacent to the south is owned and
operated by Santa Clara Valley Water District (SCVWD), and
because of existing easements across the proposed
development, the developers had several discussions with
SCVWD in advance of and following the application.
3) The development was required to meet conditions of the
District (see District letters of 3/29/88, 5/25/88 and
11/18/88; copies attached).
4) The development received City approval on June 7, 1988
subject to several requirements including filing a
subdivision map and satisfying SCVWD conditions (see
attached Exhibit D).

5) A final map was prepared for the property by P1umb1ine
Engineering in August 1988, approved by me on January 21,
1989 and the city Council on March 7, 1989. This map showed
an easement in favor of SCVWD (6110 OR 313 recorded
7/18/63) .
6) City files known to me do not contain any information
concerning grant of a water pipelines easement on October
13, 1989. None of the staff recall any "notice" to the City
concerning recordation of this easement. My "unofficial"
understanding is that the preexisting 16' SCVWD easement
needed to be amended to conform to the on-site improvements
constructed by the development and to preserve the
District's use of the easement. However, the facts of this
grant and the "nature and extent" of the easement I leave to
grantor and grantee.
7) The City does not regulate on-site paving and so no
construction specifications for such work are included in
City approved "off-site" plans. Such improvements are
constructed under direction of the developer and their
agents as persons licensed by the State to perform such
work.
8) There is no record of any City inspection of the private
roadway. As I mentioned, we do not regulate such work. The
file does contain a report from SCVWD that addresses
grading, paving and fencing (signed 12/19/89). This report
appears to relate to final approval of the development by
the Planning Department (see 12/15/89 letter from Tim
Haley) .

Dear Mr. Naderzad:
lve have reviewed the latest revised plan for the development at 490 West
Sunnyoaks Avenue delivered to us on October 6.
The proposed layout of the driveway and landscaping islands provides a
workable, although not ideal, solution for our access to the percolation
ponds.
As discussed in our previous letter dat~d July 1, 1988 additional right
of way or ingress egress rights should be transferred to the District to
ensure our continued use of this area. A plat and description of the
driveway area should be prepared. Contact Mr. Vince Lico of our Real Estate
Division to make the ncessary arrangements for the transfer of this right
of way.
The District's 24-inch diameter pipeline located within the 16-foot wide
easement should be shown on your plans. The pipeline was installed nearly
30 years ago and the as-built plans we have are not very detailed. The
pipeline appears to be located within 5 to 7 feet of the easterly property
line at an unknown depth. The pipe should be located prior to grading
operations to ensure that it is not damaged.
The existing bUildings on the site have recently been demolished and a chain
link fence installed around the site. District maintenance personnel will
need to continue to use our access to the ponds. The District will not
be responsible for any damage to the chain link fence or gate from our
continued use of this area. The maintenance access should remain open during
construction of your development.

Dear Mr. Naderzad:
We have reviewed the site plan delivered to us on March 21 for the residential
dcve1opmen~ of two parcels located on West Sunnyoaks Avenue in Campbell.
As you are aware. the District has a 16-foot-nde easement along the eastern
edge of this site. This easement is used for access to tbe Sunnyoaks Percolation
Ponds located on the south side of this site. For normal operations and
inspections we may need access to the ponds up t~ three to four times a
day. For these operations we will conform to the proposed one way ingress
and egress. However. rights of ingress and egress over the entire one way
roadway will need to be granted to us. Please contact Mr.' Vince Lico of
our Real Estate Division to make these arrangements.
Periodically, it is necessary to remove soil from the bottom of the ponds
to improve the percolation potential. During this operation, fully loaded
dump trucks will need to gain access to and from the ponds. \lith appropriate
flag con~rol we will travel in both directions along the 16-foot-nde easement.
The pavement should be designed for H-20 loading as should the patterned
concre~e area. The ~istrict nll not be responsible for any damage to this
pavement or the proposed landscaping within our right of way.
This cleansing operatJ.on does not occur very frequently but generally takes
a couple of weeks to complete. As the operation tends to be noisy and dusty,
we ask that potential buyers be made aware of it.
When prepared, grading and drainage plans should be sent to us for our
review. There should be no overbank drainage into the percolation ponds.
All drainage should be directed to Sunnyoaks Avenue and should be incorporated
into an existing drainage system that does not drain into the percolation
ponds.
Detailed landscaping and irrigation system plans should also be sent to
us for review. Trees included in the landscaping along the access road
should consist of varieties that can provide a minimum of 15 feet of vertical
clearance.

The applicant is hereby notified, as part of this application, that he/she
is required to meet the following conditions in accordance with the
Ordinances of the City of Campbell and the Laws of the State of
California. Additionally, the applicant is hereby notified that he/she is
required to comply with all applicable Codes or Ordinances of the City of
Campbell and the State of California which pertain to this development and
are not herein specified.
1. Property to be fenced and landscaped as indicated and/or added in red
on the plans. Landscaping and fencing shall be maintained in
accordance with the approved plans.
2. Landscaping plan indicating type and size of plant material, and
location of irrigation system to be submitted to the Planning
Department and approved by the Site and Architectural Review Committee
and/or Planning Commission prior to issuance of a building permit.
3. Fencing,plan indicating location and design details of fencing to be
submitted to the Planning Department and approved by the Planning
Director prior to issuance of a building permit.
4. Applicant to either (1) post a faithful performance bond in the amount
of $5,000.00 to insure landscaping, fencing, and striping of parking

5. Applicant to submit a plan to the Planning Department, prior to
installation of PG&E utility (transformer) boxes, indicating the

installed.
7. All parking and driveway areas to be developed in compliance with
Chapter 21.50 of the Campbell Municipal Code. All parking spaces to
be provided with appropriate concrete curbs or bumper guards.
8. Underground utilities to be provided as required by Section 20.36.150
of the Campbell Municipal Code.
9. Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television
cables, etc.
10. Sign application to be submitted in accordance with provisions of the
Sign Ordinance for all signs. No sign to be installed until
application is approved and permit issued by Planning and Building

11. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single-family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
12. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self-closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to the trash enclosure area to service
these containers.
14. Noise levels for the interior of residential units shall comply with
minimum State (Title 25) and local standards as indicated in the Noise

5. Obstructions to the existing waterway between October 15 and April15 will not be allowed except by special permit to
be applied for at least 15 days in advance and requiring District approval of detailed plans and provisions for
emergency flows.
6. All activities under this permit relative to the use, diversion, extraction or pumping
of groundwater or of surface water must be conducted in a manner that will prevent
the waste or unreasonable use of water.
7. The existing District chain link fence shall be maintained in place or replaced in
kind. Replacement of said fence shall be done in accordance with Section 80 of the
State of California Standard Specifications and to the satisfaction of the District
Inspector.
8. This District will not be held liable or responsible for any damage to improvements
placed within the existing easement or ingress-egress easement from any cause.

policy for providing gas and electric services in this Project.
Gas and electric facilities will be extended to and within this
subdivision in accordance with our Gas Rules 15 and 16, and our Electric
Rules 15 or 15.1 and 16, in effect at the time service is requested.
These rules are on file with the California Public Utilities Commission
and are available through this office upon request.
