Pavement and Street Improvements on Sunnyoaks Avenue
Dear Mark:
This letter summarizes our mutual agreement discussed on April 20, 1995 concerning the
pavement overlay issue on the south half of Sunnyoaks Avenue adjacent to your Tract 8625.
As we discussed, I have directed the City Engineer to defer the decision to install a half street
overlay along Sunnyoaks A venue provided that your Phase II development limits additional
utility trenches to six (6), and that all trenches are restored in an acceptable manner as
determined by the City Engineer.
Upon completion of the work, the City Engineer will inspect the improvements. If the pavement
exhibits premature signs of failure or distress due to excavations and related street work
associated with your development, you agreed to make the necessary repairs, including
resurfacing the half street with an asphalt concrete overlay per City standards.
This agreement shall become a part of the Encroachment Permit you have applied for. The City
Engineer will issue the Encroachment Permit upon receipt of acceptable street improvement
plans and other related documents previously requested by staff.
We look forward to continuing to work cooperatively with you toward the success of your
project.

A. The Tentative Map for Tract 8624 and Tract 8625 was approved
July 20, 1993, by City Council Resolution 8526.

B. The Final Map for Tract 8624 and an agreement were approved
December 13, 1993, by CCR 8584. The agreement for Tract 8624
was recorded on January 9, 1994, but the map was not
recorded.
C. The Final Map for Tract 8625 was approved April 5, 1994, by
CCR 8630. The staff report makes reference to the prior
agreement but the resoluion does not refer to it and it is
questionable that exhibit attached to the recorded agreement
is sufficient to encumber the entire area of both
subdivisions.
Please note that up to this point both tract maps have been
approved and that an agreement has been approved and
recorded but neither of the maps has been recorded.
D. On September 6, 1994, the City Council approved a new
agreement with the developers because the name of the
partnership had changed and because a storm drainage
easement needed to be created. The exhibit attached to the
agreement describes the exterior boundaries of both of the
subdivisions. The City Council also authorized that the
prior agreement could be released after the new agreement
had been recorded.
E. The map for Tract 8624 was recorded August 30, 1994. (Book
658, Maps, pages 15,16). The revised agreement was recorded
October 3, 1994. The release of the prior agreement was
recorded October 27, 1994.
F. The Tentative Map contains conditions of approval by
Building, Planning, SCC Central Fire Protection District,
SCVWD, WVSD, SJWC, PG&E, TCl, Pac Bell, and the Public Works
Department. You and I need to meet with Building and
Planning to determine what conditions need to be included in
any agreement and what bonds and or fees are due and

Please find attached copies of Street Improvement Agreement with
Robsheal Stratford Partners, and Public Storm Drain Easement Dedication
by Robsheal Stratford Partners. Both of these documents have been
recorded at the County Recorder's Office.
With the return of these documents from the Recorder's Office, I have
completed the Notice of Release for KT Sunnyoaks Associates, LP and
forwarded same to the Recorder's Office. I will forward a copy of
this Release when it is returned by the Recorder.

~ THIS AGREEMENT (identified as No. SNKS64) made and entered into this
\; day of ~1"~~ , 1994, by and between ROBSHEAL STRATFORD PARTNERS,
L.P., a Cali forma ImIted partnershIp, heremafter referred to as "Owner," and the CITY OF
CAMPBELL, a municipal corporation of the County of Santa Clara, State of California,
hereinafter referred to as "City."
WHEREAS, on July 20, 1993 the City Council granted approval of TS 93-
01 for that certain real property described in Exhibit A attached and incorporated as though
fully set forth herein, and commonly known as, 710 W. Sunnyoaks Avenue, which property is
hereinafter referred to as "said real property";
WHEREAS, compliance with the terms and conditions of this agreement are
conditions to the approval of the above described Tentative Subdivision Map;
NOW, THEREFORE, IN CONSIDERATION OF THE
ABOVE-MENTIONED APPROVAL, and satisfaction of the conditions to that approval,
(1) Owner shall provide, construct and/or install at his own proper cost and
expense, street improvements as described in section 11.24.040 of the City Code within 12
months from the date first mentioned hereinabove; provided, however that in the computation
of said 12 month period, delays due to, or caused by acts of God, viz., unusually inclement
weather, major strikes, and other delays beyond the control of Owner or his successors shall
be excluded.
(2) It is expressly understood and agreed to that if Owner shall fail to complete
the work required by this Agreement within the said 12 month period, the City, after giving
ten (10) days written notice thereof to Owner, or his successors, may construct and/or install
said improvements and recover the full cost and expense thereof from owner, or his
successors.
(3) Owner, or his successors, shall cause to be prepared at his cost and expense
improvement plans tor the construction and/or installation of said improvements prior to such
construction or installation. Said plans shall be prepared by a civil engineer registered by the
State of California and submitted to the City Engineer for examination and approval.

All of said improvements shall be constructed and/or installed in accordance with
those plans approved by the City Engineer and shall be made under the supervision and
inspection and to the satisfaction of the City Engineer. Said construction and/or installation
shall be in accordance with the existing ordinances and resolutions of the City of Campbell
and to all plans, specifications, standards, sizes, lines and grades approved by the City
Engineer, and all State and County statutes applicable thereto. Upon completion and
acceptance of the improvements by City, Owner, or his successors, shall provide reproducible
as-built plans to the City Engineer.
(4) The construction work of the improvements embraced by this agreement
shall be done in accordance with the specifications of the City of Campbell and West Valley
Sanitation District of Santa Clara County, where indicated.
(5) Prior to approval of the plans by the City Engineer pursuant to Section (3)
of this Agreement, Owner, or his successors, shall pay to the City for examination of
improvement plans, field inspection of construction of improvements and all necessary
expenses incurred by City in connection with said improvements, a sum calculated in
accordance with Resolution No. 8324, as adopted by the City Council on June 11, 1992.
(6) Owner, or his successors, shall file with City, prior to beginning
construction, surety acceptable to the City in an amount equal to the City Engineer's
estimated cost of the street improvements to insure full and faithful performance of the
construction of all the aforementioned improvement work, excluding sanitary sewers and
water distribution system. Said surety shall guarantee that Owner, and his successors, will
correct any defects which may appear in said improvement work within one (1) year from the
date of acceptance of the work by City and pay for any damage to other work resulting from
the construction thereof, as well as pay the cost of all labor and materials involved. This
surety shall remain in effect until one (1) year after date of final acceptance of said
improvements by City. Said surety amount may be reduced by the City Engineer after the
date of final acceptance to not less than twenty-five (25) percent of its full value.
(7) Upon final release of said surety by City, the obligations of Owner, and his
successors, contained in this Agreement shall be considered null and void.
(8) When called upon by City to do so, Owner, or his successors, will execute a
petition for the formation of any special assessment district created pursuant to any special
assessment act as provided in the Streets and Highways Code of the State of California
created for the purpose of constructing and/or installing any or all of said improvements.
(9) Owner, or his successors, shall participate in and become a part of any
special assessment district as described in paragraph (8) of this Agreement.
It is expressly understood that any obligations of Owner, or his successors, contained
in this Agreement that are accomplished to the satisfaction of said City Engineer by said
special assessment district shall be considered null and void.
(10) Owner, or his successors, shall make such deposits or file such bonds and
enter into such agreement as required by West Valley Sanitation District of Santa Clara
County to insure the installation of a sanitary sewage system to serve said real property, and
Owner, or his successors, shall file with City, upon execution of this Agreement, a letter from
said Sanitation District stating that Owner, or his successors, have made such deposits or filed
such bonds and entered into such agreements.

(11) Owner, or his successors, shall pay to Pacific Gas and Electric Company any
and all fees required for installation of underground wiring circuit to all electroliers within
said real property when Owner, or his successors, is notified by either the City Engineer or
the Pacific Gas and Electric Company that said fees are due and payable. Owner's, and his
successors', obligations under this section shall not be relieved by delay or the passage of
time, but shall remain binding indefinitely and forever.
(12) Owner, or his successors, shall make such deposits or file such bonds and
enter into such agreement as required by San Jose Water Company when called upon to do so
to insure the installation of a water distribution system to serve said real property, including
fire hydrant. Owner's, and his successors', obligations under this section shall not be relieved
by delay or the passage of time, but shall bind Owner and successors indefinitely and forever.
(13) Any easement and right of way within or without said real property
necessary for the completion of the improvements shown upon aforesaid improvement plans
shall be acquired by Owner, or his successors, at his own cost and expense. It is provided,
however, that in the event eminent domain proceedings are required for the purpose of
securing said easement and right of way, Owner, or his successors, shall deposit or cause to
be deposited with City a sum covering the reasonable market value of the land proposed to be
taken and to be included in said sum shall be a reasonable allowance for severance damages,
if any. It is further provided that in addition thereto such sums as may be required for legal
fees and costs, engineering and other incidental costs shall be deposited with the City.
(14) Owner, or his successors, shall carry out any and all negotiations with all
interested parties and shall perform or cause to be performed at his own cost and expense and
to the satisfaction of the City Engineer any and all work required to abandon, remove, raise,
lower, relocate and otherwise modify irrigation line or lines within the boundary of said real
property.
(15) To the fullest extent permitted by law, Owner, and his successors, shall
indemnify, defend and hold the City of Campbell, and its agents, employees, attorneys,
officers, officials and assignees harmless from any and all claims, damages, losses and
expenses, including, but not limited to, attorneys' fees, arising out of, or resulting from any
negligent or intentional act or omission (including misconduct) of said Owner, or his
successors, or any subcontractor, or anyone directly or indirectly employed by him, or anyone
for whose acts any of them may be liable in the course of performance of the Agreement.
The Owner, and his successors, shall also indemnify, defend and hold the City of
Campbell, and its agents, attorneys, employees, officers, officials, and assignees harmless
against and from any and all claims, demands, liabilities, losses, lawsuits, judgments,
damages, costs and expenses (including, but not limited to, attorneys' fees and court costs,
whether incurred at trial, appellate or administrative levels) which the City of Campbell may
incur or suffer, or to which the City of Campbell may be subjected resulting from the failure
of Owner, or his successors, or his agents, employees, subcontractors, or anyone performing
services under him, to fulfill any of the obligations imposed under this Agreement.
(16) It is acknowledged that the provisions of this Agreement constitute
covenants for the improvement of the subject real property for the mutual benefit of Owner's
property, commonly known as 710 W. Sunnyoaks Avenue, and the City's property, commonly
described as Sunnyoaks Avenue where it adjoins Owner's property. These covenants shall be
considered to affect rights in the above-described real properties, and shall be binding on the
heirs, assigns, successors, and grantees of Owner to said real property.

(17) Nothing contained herein shall be construed to transfer
any unvested interests in real or personal property for purposes of the rule against perpetuities.
(18) In the event that Owner, or his successors, should breach any of the terms,
conditions, or covenants of this Agreement, the City shall be entitled to recover, in addition to
any other relief available in law or equity, all costs incurred in attempting to obtain
enforcement of the Agreement, or compensation for such breach. These costs shall include
reasonable attorneys' fees and court costs.
(19) This is the entire Agreement between the parties, and there are no
representations, agreements, arrangements or understandings that are not fully expressed
herein.
(20) This Agreement can be executed in counterparts by the parties hereto, and as
so executed shall consist of one agreement, binding on all the parties.
IN WITNESS WHEREOF, said City has caused its name to be affixed by its Mayor
and City Clerk, who are duly authorized by resolution of the City Council, and said Owner
has caused his name to be affixed the day and year first above written.

May 26, 1992 in Book M206 of Official Records at page 0351, Santa Clara County
Records, as follows:
PARCEL ONE:
Being the North one-half (1/2) of Lot Numbered 9 of the Sunny Oaks Tract, as
laid down and delineated upon a Map of said Tract, recorded in the office of the
County Recorder of the County of Santa Clara, State of California, on January
18th, 1896 in Book "H" of Maps, at page 149, to which Map and record thereof,
reference is hereby made for further description.

Thank you for taking the time to meet with me yesterday and for
your efforts in reviewing the sequence of events surrounding the
storm water re-design.
We are disappointed to hear your decision this afternoon requiring
us to provide additional clearance between our storm pipe and the
water line within W. Sunnyoaks. We feel that the additional cost
involved is completely unnecessary and unwarranted. Our civil
engineers, TS Nowack & Associates, were confident with their
original re-design as were both utility companies when originally
contacted regarding same.
In order to mitigate further losses from additional construction
delays, we will acquiesce to your decision but do so under
protest.

work under this permit. Failure to notify is cause for revocation of Dermit and removal of work. Exercise of this permit
shall indicate acceptance of and agreement to comply with all provisions included herein. This permit is subject to the
General Provisions listed on the reverse side 'hereof or as expressly modified in the additional Special Provisions listed
below. Violation of any provision shall be cause for immediate revocation of permit.
SPECIAL PROVISIONS
1. All backfill within District right of way shall be compacted to at least 90 percent relative compaction in accordance with
California Test Method 216 or 231 or ASTM Test Designations D1556. D1557. or D2922 except as modified herein.

2. Permittee shall use only nonpotable or reclaimed water for completion of activities under this permit, unless the District
approves another source.
3. Permittee must also contact Mr. Dennis Dresti at (408) 265-2607, extension 2116, prior to the placement of fill in the
existing ditch to make arrangements for the control of release flows into the ditch.
4. Filling of the ditch and placement of the new pipe shall be done in a timely manner to minimize system downtime.
5. This permit does not include "on site" improvements including fences, walkways, landscaping, and any paving within

Reference is made to our phone conversation of July 6 relative to the terms of the easement deed
and the language of Special Provision No. S of the subject permit.
The deed states that the easement area must be kept clear of any type of fences, pavement or
trees unless prior written approval is obtained from the District. The written approval provided
by the District is an encroachment permit which is issued on the basis of District approval of
plans or drawings with or without descriptions, as appropriate, ..which show details of the
' improvements to be installed in the easement. The easement language is included in the deed to
protect the District from unauthorized acts by subsequent purchasers of the subdivision lots.
It has always been our understanding that the type of improvements mentioned, landscaping.
sidewalks and fencing would be installed' on the affected lots. Note Number S on your
improvement plans has been noted by the District, and we have not requested its removal or
modification.
Special Provision No. S OD the District's permit states that Permit No. 94925 does not in itself
include or authorize the construction of any fencing" sidewalks or landscaping. A separate
District permit must be obtained for this work based on plans sent to us for our review. You
must submit plans for the above-described work that will be included as a part of your
subdivision. A future homeowner must also submit plans for any such additional work that he/she
may do after you have completed your obligation.
We are not denying or changing any prior understanding allowing the use of the District's
easement for these improvements.

The District will permit those improvements in our easement that will not unduly restrict our
a~, impact our pipeline, or bear high replacement costs if access or repairs to our pipeline
are needed. Generally, fencing materials should be wood or chain link. A masonry or concrete
wall would not be permitted. Landscapinl materials should consist of lawn, ground cover and
shrubs. Trees should Dot be planted in the easement. Sidewalks along the side of the houses
Would be permitted, however, the placement of concrete driveways or larae concrete patios in
the easement should be avoided.

RECOMMENDATION
Adopt the attached resolution approving the final map of Tract 8625 and accept the
dedications offered thereon.
DISCUSSION
On July 20, 1993, the City Council approved a Tentative Subdivision Map (TS 93-01) to
create 37 single family lots on property located at 710 West Sunnyoaks Avenue. The final
map under consideration at this time, which creates 24 lots, is the second of two phases of
this subdivision. The first phase of the subdivision was approved by the City Council at their
meeting of December 13, 1993. An agreement for installation of street improvements by
the developer, KT Sunnyoaks Associates, has already been executed by the developer and
the City. Additionally, the name of the new street in this subdivision has already been
approved by the Civic Improvement Commkgon and the City Council. '
Staff is satisfied that all conditions of approval of the tentative map have been satisfied or
will be satisfied prior to recordation of the map, and the final map is therefore
recommended for approval by the City Council.

The District has received the revised construction drawings as requested that show the use of a
48-inch RCP to replace the open channel for Page Ditch through the subject tract.
As stated in our phone conversation several days ago, the details shown on Sheet 4 for the pipe
inlet need to be modified. The detail needs to include dimensions, a detail of the sacked riprap
construction and rebar installation, and notes as appropriate for the construction. We suggest you
refer to the District's guide sheets for an outfall with concrete sacked rip rap for the necessary
information.
We have also completed a hydraulic analysis of the existing storm drain system for Page Ditch
and have found that the existing system is not adequate to convey runoff based on a lO-year
recurrence interval. Storm drainage from this site may not be directed to the Page Ditch system.
The revised plans must show the requested inlet details and the rerouting of the site storm drain
such that it does not drain to the Page Ditch system. Two sets of revised plans should be sent
to us for our review and issuance of a permit.

The above fees include the fees associated with Tract 8624, as reflected in my letter of-
December 15, 1993, as well as those associated with Tract 8625.
Additionally, the funds must be available for the payment of the premium for the $357,000
faithful performance bond for Phase 1, and the $94,000 bond for Phase 2. This bond is to
be made available to the City by Willis Corroon Corporation of San Jose immediately upon
payment of premium. The fees outlined in the attached letter from West Valley Sanitation
District must be made payable to the Sanitation District immediately upon recordation of
the map.
Finally, the City requires one full-size xerox mylar of each map after recordation.

The District has received the copy of a letter dated February 15 from Nowack & Associates
regarding subject site and revisions to the improvement plans.
This letter states that the District's Operations Department has approved the use of an asphalt
dipped metal pipe for our facilities. While the District's Raw Water Operations Division's input
regarding this issue is as stated, input from other District divisions have concluded that the
installation of reinforced concrete pipe is required. To avoid obtaining conflicting information
from the District, requests for information relative to development or the use of District facilities
must be directed to the Design Coordination Division. Staff in this division seek input from other
District divisions to provide a thorough and complete response.
As you are aware, the Page Ditch in addition to serving the District's needs, receives local storm
drainage water downstream of our Page Percolation Ponds. The system of open ditches and
pipelines drains a total area of about 240 acres. As this is below the average requirement to
qualify as a District facility, it should be within the City's storm drainage system. Should the
District and the City agree to a transfer of property rights and maintenance responsibilities for
this system in the future, the proposed pipeline should be constructed to a standard acceptable
by the City. Because of this and our own maintenance concerns relative to a metal pipe within
the street right of way, the culvert installed to replace the existing open ditch must be reinforced
concrete pipe.

As stated in our letter dated January 26, storm drainage from this site is to be directed to the
system within Sunnyoaks Avenue in conformance with the City's storm drainage master plan.
We have instructed KT Properties that the District, with the City's concurrence, would consider
allowing site drainage to be directed to Page Ditch if acceptable calculations show that the system
has adequate capacity to serve the drainage area. The documentation must include hydrologic and
hydraulic calculations. We strongly recommend that site drainage be directed to the storm drain
in Sunnyoaks Avenue.

In response to your request, I have reviewed the issue of subsequent park in lieu of fees for
the above-referenced subdivision and Site and Architectural approval which would allow
37 single-family homes at 710 W. Sunnyoaks Avenue. Each newly created lot should pay
a park in lieu of fee of $10,990. Seventy five percent (75%) or $8,242.50 should be due at
the time of final map recordation and the remaining 25% is due at the time of building final
or occupancy. The proposed subdivision allowed the creation of 37 single-family lots with
a credit for one existing single-family lot. Consequently, the final subdivision should be
charged a park in lieu of fee of $395,640. The specific timing and amount would depend
on the phasing of the [mal maps.

Drainage for Tract 8624
As discussed in our conversation earlier this week, the District cannot permit the installation of
storm drainage from subject tract into the Page Ditch system.
Page Ditch within and downstream of this site was originally constructed to convey water for
irrigation purposes. Over the years portions of the open channel were placed in pipe and storm
drainage outfalls were directed to the facility.
In 1977, in conjunction with the construction of the townhouses on Capri Drive, the City
provided the District with a storm drainage map of the area. This map and the accompanying
analysis prepared by the District showed that the system would be inadequate without the
installation of a parallel pipe along Westmont Avenue (the terminus of the system before it enters
Smith Creek). This parallel pipe was subsequently installed, thus rendering the system adequate
to convey runoff from the watershed area defined on the drainage map.
The drainage plan provided by the City does not include this tract within the Page Ditch
watershed. The site drains toward Sunny oaks A venue and runoff should be directed to the storm
drain in Sunnyoaks Avenue.

3HIS AGREEMENT (identified as No. Snks 64) made and entered into ili~~!!.j~~~'~d#y of _
ec' , 19~ by and between KT SUNNYOAKS ASSOCIATES, L.P., a CalifornIa
Limited Partnership, hereinafter referred to as "Owner," and the CITY OF CAMPBELL, a
municipal corporation of the County of Santa Clara, State of California, hereinafter referred
to as "City."
WHEREAS, on July 20, 1993 the City Council granted conditional approval of TS
93-01 for that certain real property described in Exhibit A attached and incorporated as
though fully set forth herein, and commonly known as, 710 W. Sunnyoaks Avenue, which
property is hereinafter referred to as "said real property";
WHEREAS, compliance with the terms and conditions of this agreement are
conditions to the approval of above described Tentative Subdivision Map;
NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE-MENTIONED
APPRO V AL, and satisfaction of the conditions to that approval,
(1) Owner shall provide, construct and/or install at his own proper cost and
expense, street improvements as described in section 11.24.040 of the City Code within 12
months from the date first mentioned hereinabove; provided, however that in the computation
of said 12 months period, delays due to, or caused by acts of God, viz., unusually inclement
weather, major strikes, and other delay beyond the control of Owner or his successors shall
be excluded.
(2) It is expressly understood and agreed to that if Owner shall fail to complete
the work required by this Agreement within the said 12 month period, the City, after giving
ten (10) days written notice thereof to Owner, or his successors, may construct and/or install
said improvements and recover the full cost and expense thereof from owner, or his
successors.
(3) Owner, or his successors, shall cause to be prepared at his cost and expense
improvement plans for the construction and/or installation of said improvements prior to such
construction or installation. Said plans shall be prepared by.a civil engineer registered by the
State of California and submitted to the City Engineer for examination and approval.
All of said improvements shall be constructed and/or installed in accordance with
those plans approved by the City Engineer and shall be made under the supervision and
inspection and to the satisfaction of the City Engineer. Said construction and/or installation
shall be in accordance with the existing ordinances and resolutions of the City of Campbell
and to all plans, specifications, stMdards, sizes, lines and grades approved by the City
Engineer, and all State and County statutes applicable thereto. Upon completion and
acceptance of the improvements by City, Owner, or his successors, shall provide reproducible
as-built plans to the City Engineer.
(4) The construction work of the improvements embraced by this agreement shall be
done in accordance with the specifications of the City of Campbell and West Valley
Sanitation District of Santa Clara County, where indicated.
(5) Prior to approval of the plans by the City Engineer pursuant to Section (3) of this
Agreement, Owner, or his successors, shall pay to the City for examination of improvement
plans, field inspection of construction of improvements and all necessary expenses incurred
by City in connection with said improvements, a sum calculated in accordance with
Resolution No. 8324, as adopted by the City Council on June 11, 1992.
(6) Owner, or his successors, shall file with City, prior to beginning construction,
surety acceptable to the City in an amount of equal to the City Engineer's estimated cost of
the street improvements to insure full and faithful performance of the construction of all the
aforementioned improvement work, excluding sanitary sewers and water distribution system.
Said surety shall guarantee that Owner, and his successors, will correct any defects which
may appear in said improvement work within one (1) year from the date of acceptance of the
work by City and pay for any damage to other work resulting from the construction thereof,
as well as pay the cost of all labor and materials involved. This surety shall remain in effect
until one (1) year after date of final acceptance of said improvements by City. Said surety
amount may be reduced by the City Engineer after the date of final acceptance to not less
than twenty-five (25) percent of its full value.
(7) Upon final release of said surety by City, the obligations of Owner, and his
successors, contained in this Agreement shall be considered null and void.
(8) When called upon by City to do so, Owner, or his successors, will execute a
petition for the formation of any special assessment district created pursuant to any special
assessment act as provided in the Streets and Highways Code of the State of California
created for the purpose of constructing and/or installing any or all of said improvements.
(9) Owner, or his successors, shall participate in and become a part of any special
assessment district as described in paragraph (8) of this Agreement.
It is expressly understood that any obligations of Owner, or his successors, contained
in this Agreement that are accomplished to the satisfaction of said City Engineer by said
special assessment district shall be considered null and void.
(10) Owner, or his successors, shall make such deposits or file such bonds and enter
into such agreement as required by West Valley Sanitation District of Santa Clara County to
insure the installation of a sanitary sewage system to serve said real property, and Owner, or
his successors, shall file with City, upon execution of this Agreement, a letter from said
Sanitation District stating that Owner, or his successors, have made such deposits or filed
such bonds and entered into such agreements.
(11) Owner, or his successors, shall pay to Pacific Gas and Electric Company any and
all fees required for installation of underground wiring circuit to all electroliers within said
real property when Owner, or his successors, is notified by either the City Engineer or the
Pacific Gas and Electric Company that said fees are due and payable. Owner's, and his
successors', obligations under this section shall not be relieved by delay or the passage of
time, but shall remain binding indefinitely and forever.
(12) Owner, or his successors, shall make such deposits or file such bonds and enter
into such agreement as required by San Jose Water Company when called upon to do so to
insure the installation of a water distribution system to serve said real property, including fire
hydrant. Owner's, and his successors', obligations under this section shall not be relieved by
delay or the passage of time, but shall bind Owner and successors indefinitely and forever.
(13) Any easement and right of way within or without said real property necessary for
the completion of the improvements shown upon aforesaid improvement plans shall be
acquired by Owner, or his successors, at his own cost and expense. It is provided, however,
that in the event eminent domain proceedings are required for the purpose of securing said
easement and right of way, Owner, or his successors, shall deposit or cause to be deposited
with City a sum covering the reasonable market value of the land proposed to be taken and to
be included in said sum shall be a reasonable allowance for severance damages, if any. It is
further provided that in addition thereto such sums as may be required for legal fees and
costs, engineering and other incidental costs shall be deposited with the City.
(14) Owner, or his successors, shall carry out any and all negotiations with all interested
parties and shall perform or cause to be performed at his own cost and expense and to the
satisfaction of the City Engineer any and all work required to abandon, remove, raise, lower,
relocate and otherwise modify irrigation line or lines within the boundary of said real
property.
(15) To the fullest extent permitted by law, Owner, and his successors, shall indemnify,
defend and hold the City of Campbell, and its agents, employees, attorneys, officers,
officials and assignees harmless from any and all claims, damages, losses and expenses,
including, but not limited to, attorneys' fees, arising out of, or resulting from any negligent
or intentional act or omission (including misconduct) of said Owner, or his successors, or any
subcontractor, or anyone directly or indirectly employed by him, or anyone for whose acts
any of them may be liable in the course of performance of the Agreement.
The Owner, and his successors, shall also indemnify, defend and hold the City of
Campbell, and its agents, attorneys, employees, officers, officials, and assignees harmless
against and from any and all claims, demands, liabilities, losses, lawsuits, judgments,
damages, costs and expenses (including, but not limited to, attorneys' fees and court costs,
whether incurred at trial, appellate or administrative levels) which the City of Campbell may
incur or suffer, or to which the City of Campbell may be subjected resulting from the failure
of Owner, or his successors, or his agents, employees, subcontractors, or anyone performing
services under him, to fulfill any of the obligations imposed under this Agreement.
(16) It is acknowledged that the provisions of this Agreement constitute covenants for
the improvement of the subject real property for the mutual benefit of Owner's property,
commonly known as 710 W. Sunnyoaks Avenue, and the City's property, commonly
described as Sunnyoaks Avenue where it adjoins Owner's property. These covenants shall be
considered to affect rights in the above-described real properties, and shall be binding on the
heirs, assigns, successors, and grantees of Owner to said real property.
(17) Nothing contained herein shall be construed to transfer
any unvested interests in real or personal property for purposes of the rule against
perpetuities.
(18) In the event that Owner, or his successors, should breach any of the terms,
conditions, or covenants of this Agreement, the City shall be entitled to recover, in addition
to any other relief available in law or equity, all costs incurred in attempting to obtain
enforcement of the Agreement, or compensation for such breach. These costs shall include
reasonable attorneys' fees and court costs.
(19) This is the entire Agreement between the parties, and there are no representations,
agreements, arrangements or understandings that are not fully expressed herein.
(20) This Agreement can be executed in counterparts by the parties hereto, and as so
executed shall consist of one agreement, binding on all the parties.
IN WITNESS WHEREOF, said City has caused its name to be affIxed by its Mayor
and City Clerk, who are duly authorized by resolution of the City Council, and said Owner
has caused his name to be affixed the day and year fIrst above written.

SUNNYOAKS AVENUE PROPERTY
CAMPBELL, CALIFORNIA
INTRODUCTION
This report summarizes the results of our geotechnical investigation of a 7(=)
acre property located south of the intersection of Sunnyoaks Avenue and
Sharmon Palms Lane in Campbell. California. The approximate location of the
site is shown on the Vicinity Map included with ~he Site Plan. Figure 1.
As presently planned. the site will be subdivided into thirty-seven
residential lots. A one or two-story. wood-frame house with a raised wood
floor will be constructed on each lot. Two new cul-de-sacs. Capri Drive and
"A" Street. wi 11 provide access to lots in the southern part of the property.
The preliminary Grading Plan prepared by Nowack and Associates indicates fills
will be up to 3 to 4 feet thick and cuts will be up to about 1 foot deep for
construction of the building pads. Cuts as deep as 2 to 3 feet will be
necessary for the on-site streets.
The creek channel near the southern property line will be backfilled. and an
arch culvert will be constructed to maintain drainage between the two creek
sections adjacent to the site. The culvert will be installed below the on-
site streets. and will pass through easements on Lots 22 and 23. and on Lots
15 and 16.
The objective of this investigation was to evaluate subsurface conditions at
the site and to develop geotechnical recommendations for earthwork. foundation
design and minimum pavement sections.
INFORMATION PROVIDED
For this investigation. we were provided with: 1) a Preliminary Development
Plan. dated September 1990; 2) a Tentative Subdivision Map. dated May 13.
1993; and 3) a preliminary Grading Plan. dated April 29. 1993. These 1"=40'
scale drawings were prepared by Nowack & Associates. Inc.
SCOPE OF WORK
The following work was performed for this geotechnical investigation.
1. Review of in-house geologic information pertaining to the site.
2. Exploration. sampling and classification of subsurface soils by
means of six exploration borings ranging in depth from 10 to 20
feet. The borings were backfilled with native soil.
3. Collection of a bulk sample of near-surface soil from the
proposed pavement area.

4. Laboratory testing to measure pertinent index and engineering
properties of selected soil samples collected from the borings.
An R-value test was performed on the bulk sample.
5. Engineering analysis of field and laboratory test data to develop
geotechnical recommendations for project design and construction.
6. Preparation of this report summarizing our findings and
recommendations for: site preparation. grading and compaction:
backfilling of utility trenches: building foundations; concrete
slabs-on-grade: retaining wall design: and minimum vehicle
pavement sections.
FINDINGS
Surface Conditions
The rectangular-shaped site is bordered by Sunnyoaks Avenue on the north. and
existing developments on the south. east and west. The ground surface across
the site is essentially flat. There is a creek channel about 30 to 40 feet
north of the southern property line. This channel is about 10 feet wide at
the top and about 5 to 6 feet deep.
The house and sheds that once occupied the center portion of the site have
been demolished. There was a basement beneath the eastern portion of the
house. The septic tank and leach field was reported to be south of the house.
There is a pile of concrete rubble and debris in the central portion of the
site. The remaining areas of the site are occupied by an orchard and oak
trees.
Subsurface Conditions
For this investigation. six exploratory holes were drilled to depths of 10 to
20 feet below existing ground surface. Penetration testing and soil sampling
were performed in the borings at selected depths. The borings were backfilled
with native soil. The approximate locations of the borings are shown on the
Site Plan. Figure 1.
Surface and subsurface soils encountered in the borings consisted of layers of
sand and gravel with a variable amount of fines. The sand and gravel layers
varied in relative density from medium dense to very dense.
Ground water was not encountered in any of the drill holes at the time of
exploration. The ground water level could rise to within the depth of our
borings during the rainy season.

Materials encountered in the borings are described on the appended Exploratory
Drill Hole Logs. The logs depict subsurface conditions at the locations shown
on the Site Plan. Subsurface conditions at other locations may differ from
those encountered at the explored locations. Stratification lines shown on
the logs represent the approximate boundaries between soil types; the actual
transition from one soil type to another may be gradational.
Seismic Considerations
The site is located within the seismically active San Francisco Bay area but
outside the Special Studies Zones defined by the Alquist-Priolo Special
Studies Zones Act of 1972.
The known active faults that are closest to the site include: the San Andreas
fault, which passes about 6 miles to the southwest; the Hayward fault. which
passes about 11.5 miles to the northeast; and the Calaveras fault. which
passes about 13 miles to the northeast.
Seismic hazards can be divided into two general categories: hazards due to
ground rupture and hazards due to ground shaking. Because no active or
potentially active faults are known to cross the site. the risk of
earthquake-induced ground rupture across the site appears to be low. Based on
historic records and on the known general seismicity of the San Francisco Bay
region. it is probable that during the next 50 years the site will be shaken
by at least one earthquake of Richter Magnitude 7.0 or greater and by numerous
earthquakes of lesser Magnitude.
Should a major earthquake (Richter Magnitude 7.0 or greater) occur with an
epicentra1 location close to the site. ground shaking at the site will
undoubtedly be severe. as it will be for other sites in the area.
Liquefaction potential of the sands and gravels encountered in our drill holes
is low.
RECOMMENDATIONS
The following recommendations are presented as guidelines to be used by
project planners and designers. These recommendations are prepared assuming
that Terratech. Inc. will be commissioned to review project grading and
foundation plans prior to construction. and to observe and test during
earthwork and foundation construction. This additional opportunity to examine
the site will allow us to compare subsurface conditions exposed during
construction with those inferred from this investigation.
Site Preoaration. Gradinq and Comoaction
Prior to grading. the site should be cleared of all obstructions and
deleterious material, such as the pile of construction debris and remains of
the former buildings and septic system. Trees designated for removal should
be felled. and their roots and stumps should be grubbed. Probe holes should
be excavated in the areas of the previous structures to evaluate if the

basement of the old house has been properly backfilled, and to look for any
remaining foundations, utilities and buried structures. Loose backfill and
underground improvements should be removed. Holes and depressions that are
below finish grade should be backfilled as recommended for structural fill.
After clearing, the site should be stripped of vegetation and organic topsoil.
Soil containing more than 2 percent of organic matter by weight should be
considered organic. The actual stripping depth should be determined by a
member of our staff at the time of stripping, but for planning purposes, an
average stripping depth of 4 inches may be assumea. Strippings may be
stockpiled for later use in landscaping or hauled off-site.
After stripping and excavation to rough grade, exposed soil surfaces in areas
to receive structural fill, foundations, concrete slabs-on-grade or pavements
should be scarified to a depth of about 6 inches, conditioned with water (or
allowed to dry), and compacted as recommended for structural fill. After the
ground surface is properly prepared, the site may be raised to finish grade by
placement of structural fill.
Prior to backfilling of the creek channel, the bottom of the creek should be
evaluated by a member of our staff. If soil in the creek bottom is wet. loose
or unstable, mitigation measures such as excavation and recompaction, use of
geotextiles, and/or placement of a gravel blanket should be implemented. The
appropriate mitigation measures should be determined in the field based on
field conditions at the time of grading. For planning purposes, we suggest
assuming that excavation and recompaction of at least one foot of soil will be
necessary. Extra measures should be anticipated if grading takes place during
or soon after the rainy season.
Material for structural fill may consist of on-site inorganic soil or imported
soil approved by our engineer. In general, soil for use as structural fill
should be free of organic and deleterious material, should contain no rocks or
clods over 4 inches in greatest dimension, and should contain no more than 20
percent by weight of rocks larger than 2.5 inches. Import fill should be
predominantly granular, should have a Plasticity Index no greater than IS, and
should contain sufficient binder to allow excavations without caving. Prior
to delivery to the site, a representative sample of proposed import should be
sent to our laboratory for testing and evaluation.
Structural fill should be water-conditioned and compacted in lifts no thicker
than 8 inches. Structural fill should be compacted to at least 90 percent
relative compaction at a soil water content slightly above the laboratory
optimum value. Evaluation of relative compaction should be based on ASTM Test
01557 -91.
The upper 6 inches of pavement subgrade and all aggregate base for pavements
should be compacted to at least 95 percent relative compaction based on ASTM
Test 01557-91.

Utility Trenches
Construction and protection of trench excavations should comply with the
current guidelines of CAL/OSHA and local jurisdiction. Trenches in on-site
sand and gravel may be prone to localized sloughing and caving.

For purposes of this section of the report. backfill is defined as material
placed in a trench starting 1 foot above the pipe. and bedding is all material
placed in a trench below the backfill.
Unless concrete bedding is required around utility pipes. free-draining sand
should be used as bedding. Sand bedding should be compacted to at least 95
percent relative compaction based on ASTM Test 01557-91. Sand bedding should
not be jetted or ponded into place.
On-site inorganic soil or approved import may be used as utility trench
backfill. Backfill in trenches located under and adjacent to structural fill.
foundations. concrete slabs and pavements should be placed in horizontal
layers no more than 8 inches thick. Each layer should be compacted to at
least 90 percent relative compaction at a soil water content slightly above
the laboratory optimum value. Compaction of backfill by water jetting should
not be permitted.
The bottom of utility trenches parallel to foundations should not extend below
an imaginary plane sloping downward at a 45 degree angle from the bottom edge
of foundations.
Buildinq Foundations
The proposed houses may be supported on conventional reinforced concrete
foundations bearing on undisturbed native soil or on compacted structural
fill. Placement and compaction of structural fill should be performed as
described in the section on "Site Preparation. Grading and Compaction."
Continuous and isolated foundations may be designed using a net allowable soil
bearing pressure of 2.000 pounds per square foot for dead plus live loading.
This allowable pressure may be increased by one-third when considering
additional short-term wind or seismic loading.
Foundations should be at least 12 inches wide and should be embedded at least
18 inches below pad grade or adjacent finished grade. whichever provides a
deeper embedment.
Concrete should be placed only in foundation excavations that have been kept
moist. that are free from drying cracks. and that contain no loose or soft
soil and debris. Foundation excavations should be observed by a member of our
staff to verify that they extend into suitable bearing material.

Garaoe Floors and Exterior Concrete Slabs-on-Grade
Soil subgrades below concrete slabs for garages. driveways and exterior walks
should be prepared as recommended in the section entitled "Site Preparation.
Grading and Compaction."

Where floor dampness is not objectionable. concrete slabs may be cast directly
on a scarified. water-conditioned and compacted soil subgrade.
If floor dampness in garages is objectionable. our office should be consulted
about recommendations for capillary break and vapor barrier.
Reta in i no Wa 11 s
The following parameters may be assumed for design of retaining walls proposed
along lot lines and property lines. These walls will be up to 3 to 4 foot
high.
1. The average unit weight of backfill placed behind the walls may be
assumed to be 100 pcf.
2. The vertical plane behind the walls will be subject to the lateral
soil pressures given below. For a cantilever wall. the vertical
plane should extend down from the ground surface behind the wall
to the heel of the wall base. For a timber wall. the vertical
plane should extend down from the ground surface behind the wall
to the lowest adjacent finish grade in front of the wall. The
lateral soil pressures below are for non-seismic and level
backfill conditions.

At-rest soil pressure should be used for deSign of walls that are
restrained at the top and not free to rotate. or for walls where
settlement of wall backfill. or wall rotation. is not desirable.
At-rest soil pressure should be used for all walls closer than 2:1
(h:v) to the base of house foundations.
Active soil pressure may be used for deSign of unrestrained walls
where the top of the walls are free to rotate and resulting wall
rotation and settlement of backfill is tolerable. Displacements
of about 1/2 percent of the wall height would be necessary to
develop active pressure.
The additional effects of earthquakes on the walls may be
simulated by applying a horizontal surcharge force of 10H2 pounds
per foot length of walls at a height of 0.6H above the wall
bottom. where H is the height of the vertical plane described
above.

4. The additional effects of live loads may be simulated by applying
50 percent of the live loads as horizontal surcharges on the
vertical plane discussed above. The point of application of
surcharge from each live load should be at the same distance down
from the top of the backfill as the horizontal distance between
the load and the vertical plane.
5. For design of cantilever walls:
Ultimate coefficient of friction = D.45 between wall base
and underlying soil;
Ultimate passive soil resistance against embedded portion of
wall base = 350 psf/ft for level ground in front of the
wall;
Allowable soil bearing pressure for wall base founded on
competent bearing soil = 2,500 psf for dead plus live
loading; 3,300 psf when considering additional short-term
seismic loading.
6. If the method outlined in Section 29 of the Uniform Building Code
is used to calculate the minimum required embedment of piers for
timber walls. a lateral soil bearing value of 120 psf per foot of
depth may be assumed. The upper 1 foot of soil should be ignored
in calculating lateral load capacity.
To achieve a drained backfill condition. a zone of free-draining. cohesionless
material at least 12 inches wide should be placed on the backfill side of the
walls. The drainage material should consist of either Class 2 Permeable
Material (Section 68. Caltrans Standard Specifications. latest edition) or
3/4-inch by NO.4 clean. durable aggregate. If the aggregate is used. it
should be encapsulated by a filter fabric. such as Mirafi 700X or equivalent.
The drain material should be placed in layers about 8 inches thick and
moderately compacted by hand-operated equipment, or densified by a concrete
stinger. to reduce post-construction settlement of the backfill. The drainage
material should be capped with at least 12 inches of compacted on-site soil.
Water accumulated in the drainage material should be discharged through weep
holes or slots, or by means of a perforated pipe at least 4 inches in diameter
placed "holes down" near the bottom of the drainage material. The perforated

at a suitable point.
Vehicle Pavements
On-site soils have high supporting capacity for vehicle pavements. An R-Value
of 73 was measured at an exudation pressure of 300 psi on a sample of soil
collected at the location shown on the Site Plan. To account for variation
across the site. an R-value of 60 was used to calculate the minimum pavement
sections shown on Table 1 below.

Aggregate used for asphalt concrete should comply with the requirements
specified in Section 39 for Type B aggregate. Aggregate used for asphalt
concrete surfacing should conform to the grading specified in Section 39 for
1/2 inch maximum. medium grading.
Compaction of pavement subgrades and aggregate base should be as recommended
in the section on "Site Preparation. Grading and Compaction."
Surface Drainaqe
Surface drainage gradients should be constructed to prevent ponding and to
direct surface water away from building foundations and edges of concrete
slabs-on-grade and pavements. and towards suitable collection and discharge
facilities.
Vehicle pavements should be constructed with sufficient surface drainage
gradients to promote rapid drainage of surface water without ponding. We
suggest a drainage gradient of about 2 percent in the principal direction of
drainage.
Landscaoe Desiqn
Water seepage or the spread of extensive root systems into soil subgrade of
foundations. slabs or pavements could cause differential movements and
consequent distress in these structural elements. Landscape designs should
be made accordingly.
Post-Report Geotechnical Services
We recommend TERRATECH be commissioned to provide the following services.
1. Review grading and foundation plans prior to construction.
2. Observe. test and advise during site preparation. removal of
former foundations and buried structures. preparation and
compaction of soil subgrades. and placement and compaction of
structural fill.
3. Observe and advise during foundation and slab construction.

APPENDIX
FIELD INVESTIGATION AND LABORATORY TESTING
Our field investigation consisted of site reconnaissance and subsurface
exploration. On August 23. 1993. six exploration holes were drilled with a
CME 45 truck-mounted drill rig to depthS between 10 and 20 feet below existing
ground surface. The borings were backfilled with native soil. The
approximate locations of the borings are shown on the Site Plan. Figure 1.
Materials encountered in the borings were logged by our field representative
and described in accordance with the Unified Soil Classification System
modified to distinguish fine-grained soils with intermediate plasticity
(Liquid Limit between 35 and 50). Logs of the drill holes are included in
this appendix. Soil samples were obtained from the drill holes at selected
depths and a bulk sample of the near-surface soil was collected in the
proposed pavement area. All samples were taken to our laboratory for further
examination and laboratory testing.
The penetration blow counts noted on the drill hole logs were obtained by
driving a sampler into the soil with a 140-pound hammer dropping through a
3D-inch free fall. The sampler was driven up to 18 inches into the soil and
the number of blows recorded for each 6-inch penetration interval. The
numbers indicated on the logs are the total number of blows that were recorded
for the second and third 6-inch intervals. or the number of blows that were
required to drive the penetration depth shown if high resistance is
encountered. The types of samplers used are identified on the logs with the
following symbols.
X = Modified California sampler
* = Standard Penetration Test sampler
The objective of the laboratory testing program was to determine index and
engineering properties of selected soil samples collected during exploration.
Tests performed include water content. dry density. grain size distribution.
and R-Value. Laboratory test results are presented on the drill hole logs and
on separate sheets after the logs.

After due consideration of all evidence presented, the City Council does hereby
ratify the Planning Commission's action per application No. TS 93-01, including the
findings, Map (Exhibit B), and the Conditions of Approval (Exhibit A) outlined in
Resolutio~ No. 2860, adopted by the Planning Commission on June 22, 1993, on a
roll call vote of 5-0-2 (Commissioners Perrine and Akridge absent).
Further, the applicant is notified as part of the application that he is required to
comply with all applicable Codes and Ordinances of the City of Campbell and the
State of California which pertain to this development and are not herein specified.

RECOMMENDING APPROVAL OF A TENTATIVE SUBDIVISION
MAP, FILE NO. 1'5 93-01, LANDS OF TERSINI, APN: 406-08-012,
ON PROPERTY LOCATED AT 710 W. SUNNYOAKS AVENUE IN
A R-1-6 (SINGLE F.AMn.y RESIDlWTIAL) ZONING DISTRICT.
After notification and public hearing as specified by law on the application for
approval of a Tentative Subdivision Map as referenced in the above heading;
as per the application filed in the Planning Department on March 26, 1993;
and, after presentation by the Planning Director, proponents and opponents,
the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. 1'5 93-01:
1. The proposed subdivision density of 5.1 units per gross acres is consistent
with the low density residential land use shown on the Land Use
Element of the General Plan.
2. The proposed map is consistent with the minimum lot standards for the
, , R-l-6 (Single Family Residential) Zoning District.
3. The proposed subdivision layout subject to the provision of a emergency
easement adequately addresses the access needs of the neighborhood and
the future residents of the subdivision.
4. An initial study was prepared for this project and no significant
environmental impacts were found.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The proposed subdivision is consistent with the General Plan;
2. The proposed subdivision does not impair the balance between the
housing needs of the region and the public service needs of its residents
and available fiscal and environmental resources;
3. The design of the subdivision provides, to the extent feasible, for future
passive or natural heating or cooling opportunities.
4. No substantial evidence has been presented which shows that the
project, as currently presented, and subject to the required conditions,
would have a significant adverse impact on the environment.

The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances
of the City of Campbell and the State of California. The lead department with

SITE DESIGN
1. Approved Project: Approval is granted for a Tentative Subdivision Map
allowing the creation of 37 single family lots. The map shall
, , substantially conform to the map prepared by Nowack & Associates, Inc.,
dated May 13, 1993, except as may be modified by the Conditions of
Approval herein. (Planning)
a'. Developer to submit a revised map addressing the conditions of
approval, prior to final map submittal.
2. Emergency Access: Map to provide a 14 foot wide easement from West
Sunnyoaks Avenue to the proposed Capri Drive cul-de-sac and to
improve easement area as required by the Planning Director and Fire
Marshall:
a. A minimum 14 foot width with appropriate radius and appropriate
breakaway gates for fire truck access is required.
b. Property owners adjacent to easement will be responsible for

LANDSCAPING
3. Tree Preservation: Prior to final map approval, applicant to submit a
tree preservation/mitigation plan to ensure the protection of the Coast
Live Oak between Lots 5 and 6, and replacement of the 37" diameter
Valley Oak tree consistent with equivalent diameter of similar tree type
per WELS standards. The plan must be prepared by a licensed arborist
and approved by the Site and Architectural Review Committee prior to

PROPERTY MANAGEMENT/UTILITIES
4. Property Maintenance: The property is to be maintained free of any
combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by
having windows boarded. up and doors sealed shut, or be demolished or
removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform
Fire Code). (Fire)
5. Santa Clara County Valley Water District: Prior to fmal map approval,
applicant to provide a clearance letter from Santa Clara Valley Water
District approving abandonment of existing easements and creation of
new easements on the project site.
6. Street Name: Obtain approval of a new street name by the City Council
upon recommendation of the Civic Improvement Commission prior to
final map approval. (Planning)
7., Retaining Walls: Retaining walls at property lines are limited to a
, height of 15 inches if constructed. of wood. (Building)
PUBLIC SAFETY/WELFARE
8. Handicapped Requirements: Applicant shall comply with all
appropriate State and City requirements for the handicapped. (Building)
9. Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)
10. Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to
the Planning Department, prior to installation of PG&E utility
(transformer) boxes and S.J. Water back-flow preventers, indicating the
location of the boxes and screening (if boxes are above ground) for

11. Park Dedication Fee: Applicant to pay Park Dedication In-lieu Fee,
which will be assessed at the time the subdivision map is submitted.

FIRE DEP ARIMENT
13. Provide two fire hydrants, one near lot 12, one near lot 23.
14. This development provides for a dead end street in excess of 1000 feet.
This street should go through and connect with West Sunnyoaks
Avenue or a 14 foot emergency access shall be provided.
PUBLIC WORKS DEPAR1MENT
15. As a condition of approval, the applicant must process and file a final
map.
16. Applicant must obtain approval of Civic Improvement Commission
and County Communications for names of streets within subdivision.
17. Sewers: Installation of a sanitary sewerage system to serve all lots
within the subdivision in conformance with the proposed plans of the
West Valley Sanitation District. Sanitary sewerage service to be
provided by said district
18. Water Service: Installation of a water distribution system to serve all
lots within the subdivision in conformance with the plans of the San
Jose Water Works. Water service to be provided by said water company.
~Fire hydrants and appurtenances shall be provided and installed at the
locations specified by the Frre Chief, Fire Department, City of Campbell.

The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances
of the City of Campbell and the State of California. The lead department with
which at the applicant will work is identified on each condition.
Additionally, the applicant is hereby notified that he/she is required to
comply with all applicable Codes or Ordinances of the City of Campbell and
the State of California that pertain to this development and are not herein
specified.
SITE DESIGN
1. Approved Project: Approval is granted for a Tentative Subdivision Map
allowing the creation of 37 single family lots. The map shall
substantially conform to the map prepared by Nowack & Assoqates, Inc.,
dated May 13, 1993, except as may be modified by the Conditions of
Approval herein. (Planning)
2. Pedestrian Access: Map to be modified to provide a 20 foot wide
pedestrian easement from West Sunnyoaks Avenue to the proposed
Capri Drive cul-de-sac and to improve easement area as required by the
Planning Director and Fire Marshall:
a. A minimum 12 foot paved area with appropriate radius for fire
truck access is required.
b. Maintenance of this access area would be provided by adjacent
property owners through a recorded maintenance agreement
and deed restriction as approved by the Planning Director.
c. Property owners to provide and maintain landscaping along
pathway. (Planning/Fire)
3. Percolation Pond Access: Map to be modified to provide a 15 foot wide
pedestrian easement on lot 16 to allow future access to the percolation
pond east of the project site. (Planning)
LANDSCAPING
4. Tree Preservation: Prior to final map approval, applicant to submit a
tree preservation plan to ensure the protection of the two oak trees and

to investigate the retention of existing walnut trees along the southerly
property line. The plan must be prepared by a licensed arborist and

PROPERTY MANAGEMENT fUTILITIES
5. Property Maintenance: The property is to be maintained free of any
combustible trash, debris and weeds, until the time that actual
construction commences. All existing s~ructures shall be secured by
having windows boarded up and doors sealed shut, or be demolished or
removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform
Fire Code). (Fire)
6. Santa Clara County Valley Water District: Prior to final map approval,
applicant to provide a clearance letter from Santa Clara Valley Water
District approving abandonment of existing easements and creation of
new easements on the project site.
7. Street Name: Obtain approval of a new street name by the City Council
upon recommendation of the Civic Improvement Commission prior to
final map approvaL (Planning)
8. Retaining Walls: Retaining walls at property lines are limited to a
· height of 15 inches if constructed of wood. (Building)
PUBLIC SAFETY fWELFARE
9. Handicapped Requirements: Applicant shall comply with all
appropriate State and City requirements for the handicapped. (Building)
10. Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)
11. Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to
the Planning Department, prior to installation of PG&E utility
(transformer) boxes and S.J. Water back-flow preventers, indicating the
location of the boxes and screening (if boxes are above ground) for
approval of the Planning Director. (Planning)
12. Park Dedication Fee: Applicant to pay Park Dedication In-lieu Fee,
which will be assessed at the time the subdivision map is submitted.

FIRE DEPARTMENT
14. Provide two fire hydrants, one near lot 12, one near lot 23.
15. This development provides for a dead end street in excess of 1000 feet.
This street should go through and connect with West Sunnyoaks
Avenue or a 14 foot emergency access shall be provided.
PUBLIC WORKS DEPARTMENT
16. As a condition of approval, the applicant must process and file a final
map.
17. Applicant must obtain approval of Civic Improvement Commission
and County Communications for names of streets within subdivision.
18. Sewers: Installation of a sanitary sewerage system to serve all lots
within the subdivision in conformance with the proposed plans of the
West Valley Sanitation District. Sanitary sewerage service to be
provided by said district.
19.; Water Service: Installation of a water distribution system to serve all
lots within the subdivision in conformance with the plans of the San
Jose Water Works. Water service to be provided by said water company.
Fire hydrants and appurtenances shall be provided and installed at the
locations specified by the Fire Chief, Fire Department, City of Campbell.
Fire hyrdrant maintenance fees shall be paid to City at the rate of $195
per fire hydrant.
20. Subdivision Map Act: Compliance with the provisions of Title 20,
Subdivisions of the Campbell Municipal Code.
21. Storm Drain Fee: Subdivider to pay Storm Drainage Area Fee of $12,881.
22. Surety: Subdivider shall install street improvements and post surety to
guarantee the work.
23. Dedications: Dedicate additional right-of-way to widen W. Sunnyoaks
Avenue to 30 feet from centerline and dedicate sufficient property to
provide for cul-de-sac extensions.

24. Grading/Drainage Plan: Provide a grading and drainage plan for the
review and approval of the City Engineer.
25. Excavation Permit: Obtain an excavation permit and pay fees and
deposit for all work in the public right-of-way.
26. Park Lands Dedication: Pay a fee of $304,973 in lieu of dedication of land
for parks.

Dear Honorable Members of the Planning Commission:
I am with the ownership of the 198 unit Newport Apartments, adjacent to the proposed
development noted above. While we trust that the various City Departments will carefully
analyze the proposed sub-division, we strongly oppose any hearings that do not include the long
standing request by our neighborhood to make Hacienda A venue (near Winchester) the proper
width and remove the percolation pond fences that are jutting into Hacienda Avenue. While we
know this condition would not hold up a development, perhaps the City should consider using a
portion of the Park Fee paid by the developer to construct sidewalks (or at least one sidewalk on
the North side of the street) so that pedestrians or bicyclists can travel on Hacienda to Los Gatos
Creek Park which services this neighborhood, including any pedestrians or bicyclists generated
from this new development.
The following is a review of the history of this issue:
1. The letter writing campaign began on December 10, 1986 (see letter attached)
In the first quarter of 1987 approximately sixty (60) neighbors began to send letters to
the Manager of the Santa Clara Water District, and the City of Campbell.(samples
attached)
2. Our neighborhood established a relationship with Jose Ortiz/Gary Stevens of the
Santa Clara Water District and David Valkenaar/Don Wimberly of the City of
Campbell. Needless to say, it was gratifying to see the two departments moving
toward a solution.
3. In May 1987 Santa Clara Valley Water District agreed to cooperate in the removal of
the above mentioned fences, and the City of Campbell allotted public work funds
toward this project. It is important to note that this project has always been on the
priority list for the Public Works Department but, due to a lack of cooperation
between the city and water district, it never seemed to get done.
4. Our neighborhood was thrilled and backed off from exerting pressure on the City of
Campbell.
5. What transpired next was six years of delays with excuses including:
1. The Public Works Department was busy on the new exit off
of Highway 17 to accommodate Apple Computer.
2. Some possible land swaps with Santa Clara Water District
3. A proposed retail development at the corner of Hacienda
Avenue/Winchester Blvd which would allow the City of Campbell to
require that the retail developer construct sidewalks on the south side
of Hacienda while the city concurrently constructed the sidewalk on
the north side. (copies of the Planning Commission minutes and my
February 13, 1991 letter to Bill Helms/City of Campbell are enclosed).
What is incredibly unfair is that the City of Campbell has chosen to delay for six (6) years
the elimination of chain link fences jutting into a major arterial after agreeing to this sidewalk
construction in May 1987. And, what is even worse is that the excuse in recent years is that the
city has chosen to wait for a private developer to help pay half the bill, which in our
neighborhood's opinion should not hold up the implementation of improvements agreed up
with Campbell taxpayers in 1987 - notwithstanding the immense liability and exposure to the
dangers of leaving these ugly fences in such an awkward location.
On behalf of the 300 residents at Newport, I urge each of you to please look at this issue as
we think you will agree that a pedestrian is forced to literally walk in the middle of the "natural
width" of the street. Isn't six (6) years long enough to wait for the city to perform that which it
has agreed to?

Re: Review of the Revised Development Plan and Site Circulation pattern for the
Sunnyoaks Project
Dear Mark:
This letter presents the results of our review of the revised plan and circulation system
for the Sunnyoaks residential project in the City of Campbell.
A previous traffic impact report for the same project development was prepared by
Barton-Aschman Associates, Inc. in July 1989. A total of 52 single-family dwelling units,
with a trip generation of 53 trips during the PM peak hour, were assumed in the 1989
study and the resultant project impacts at the local intersections were found to be
insignificant.
This latest revised plan entails a reduced development size of 37 single-family dwelling
units with a different circulation system. Since the size of the development is smaller
than that used in the 1989 study, it is reasonable to assume that the revised project with
a PM peak- hour generation of 37 trips, will not have significant impacts at the local
intersections. However, it was decided that new counts be taken during the PM peak.
period at the Hacienda/Capri intersection in order to obtain a more accurate picture of the
local growth since 1989. The existing level of operation at this intersection was estimated
to be LOS D during the PM peak hour. With the addition of the project trips, the future
operation should remain at LOS D which is an acceptable standard of operation.
The revised plan will provide access on Sunnyoaks Avenue for only 9 of the 37 units. The
remaining 28 units will have to gain access via Capri Drive. It is estimated that a total of
9 project trips (6 inbound/3 outbound) will use Sunnyoaks Avenue during the PM peak.

and out of the site via Capri Drive. We believe that the small increases in traffic on
Sunnyoaks Avenue and Capri Drive from the project development will not cause any
significant impacts.
