BEING A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CA~WBELL, COUlffY OF
SANTA CLARA, STATE OF CALIFORNIA,
AUTHORIZING EXECUTION OF AN AGREEHENT
BY AND BETWEEN THE CITY OF CM'1PBELL
AND PHILIP W. SONDENO, ET AL.
. WHEREAS, Philip W. and Esther M. Sondeno, husband and wife;
and Noble L.and Mary E. Ballew, husband and wife, did, on
November 18, 1970, submit an agreement hereto attached and by
reference made a part hereof for the construction of public street
improvements upon Union Avenue and Michael Drive throughout the
frontage of that certain real property described upon that certain
instrument recorded September 2, 1966, and filed in Book 7494 of
Official Records at Page 98 in the office of the County Recorder
of said County of Santa Clara, and upon that certain instrument
recorded February 16, 1966, and filed in Bo~~ 7282 of Official
Records at Page 458 in said office of said County Recorder, which
real property is hereinafter referred to and by reference made a
part hereof; and,
lmEREAS, said Philip W. Sondeno, et aI, did, on the 13th day of
August, 1968, enter into an agreement with the City of Campbell to
construct public street improvements upon Union Avenue throughout
the-frontage of said real property hereinabove referred to, which
agreement was recorded September 16, 1968, and filed in Book 8263
of Official Records at Page 398, et sequens, in the office of the
County Recorder of the County of Santa Clara, State of California;
and,
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the City
Council of the City of Campbell that the Mayor and City Clerk 'be
and they are hereby authorized to execute said agreement dated
November 18, 1970, on behalf of the City of Campbell; and,

BE IT AND IT IS hereby further resolved by the City Council
that in consideration of the agreement entered into by and between
Philip W. Sondeno, et aI, dated November 18, 1970, the City of
Campbell hereby waives any and all the terms and conditions contained
in that the agresnent hereinabove referred to recorded September 16,
1968, and filed in Book 8263 of Official Records at Page 398,
et sequens, in said office of said County Recorder, and said
agreement is hereby declared null and void. The City Clerk is
hereby directed to record a certified copy of this resolution in
the said office of said County Recorder.

ag-reement for the development of their real property in

WHEREAS, by the terms of said agreement, and
concurrently herewith they have sublnitted grant deeds of
certain portions of their property for street'purposes;
NO\'1, THERE~"ORE, BE IT RESOLVED by the City Council
that the Mayor be and he is hereby authorized to execute the
said agreement on behalf of said City; and
BE IT FURTHER RESOLVED that the grant deed submitted
in connection therewith be and the same is hereby accepted.
