Dear Wayne:
Pursuant to our previous discussions, the City of Campbell wishes
to have four (4) one-inch water services installed in Van Dusen
Lane. The locations of these services are shown on the attached
map. City staff will request funding for these services from the
Ci ty Council at their meeting of october 6. Please send me a
proposal for the installation of these services, including permit
fees. If you have any questions regarding this request, please

Dear Wayne:
On October 6 the Campbell City Council approved payment for the
installation of four one-inch water service for future development
on Van Dusen Lane. The amount approved coincides wi th the
$1,563.75 unit price which you quoted. A check in the amount of
$6,255.00 is currently being processed, and should be sent to you
in approximately ten days.
The purpose of this letter is to request that you schedule this
work as soon as possible, as the street improvements are scheduled
to begin upon completion of this work and P. G. & E.'s electrical
work.

IN FURTHER CONSIDERATION of the issuance of building permits for 1513 Van Dusen
Lane and 1605 Van Dusen Lane, owners also agrees, warrants and represents as follows:
1. He shall indemnify, defend and hold the CITY OF CAMPBELL, its officers, agents
attorneys, employees and assignees, harmless against any and all claims, damages, losses,
demands, actions and causes of action arising out of the circumstances giving rise to the
accident, casualty or event of issuing building permits for 1513 Van Dusen Lane and 1605
Van Dusen Lane.
2. This is a full and final release applying to all known and unknown and unanticipated
claims, demands, losses, actions, causes of action, injuries, deaths, or damages of nay nature
that the undersigned party may have against the CITY OF CAMPBELL, its undersigned
party waive all right or benefits, which the undersigned party now has or in the future may
have under the terms of Section 15642 of the Civil Code of the State of California, which
said Section reads as follows:
"A general release does not extend to the claims, which the creditor does not know or
suspect to exist in his favor at the time of executing the release, which if known by
him must have materially affected his settlement with the debtor."

SUBJECT: Encroachment Permits for properties at
1600, 1605, 1513 and 1494 Van Dusen Lane
Dear Mr. Cauthorn:
Pursuant to our discussion yesterday on the aforementioned
subject, I have reviewed your request for this letter with
my client, Swart Development Company.
My client has agreed to pay for all "encroachment permits"
from the State of California (Caltrans) for all proposed
work in their "right-of-way". The existing street improvements
were put in place under their direction, and not the City of
Campbell. The proposed improvements in the Cal-Trans "rigth-of-
way" will be per CalTrans direction and the City of Campbell's
"standards" as required. If tranfer of any building occurs prior
to request for encroachment permits, then Swart Development Co.
will work directly with the City's Public Works engineers.
We acknowledge and accept that all City Building permits shall
be conditioned on recordation of this document letter. There
shall be no finalization of this project until Swart Development
Co. has obtained all required CalTrans encroachment permits and
has completed all contruction within the "right-of-way" to the
satisfaction of CalTrans and the City of Campbell.
The construction phase involving the "move-on houses" and their
placement on foundations is projected to be completed within
45 working days of the issuance of building permits. The Swart
Development Co. will cause this Letter to be recorded at the
Santa Clara County Recorder and the original to be sent to the
City of Campbell at Swart Development Co. expense.

The Public Works Department has reviewed the above application and the following are our
comments:
A. COMPLETENESS COMMENTS
1. The proposed development site consists of three remnant parcels of land
fronting upon public State of California property which is not a public street.
Public street improvements have been constructed.
A storm drain system has been constructed, however, it does not extend
through the frontage of this property. Public utility facilities have been
constructed. Public utility facilities are shown as encumbering parts of the
development site.
The City of Campbell has jurisdiction upon the proposed private development
site. The three remnant parcels need to be combined into one unit parcel via a
Parcel Map based upon a field survey,
The City of Campbell does not have jurisdiction upon the State of California
public property, nor upon the existing roadway, nor upon the public utility
facilities.
The City cannot grant approval to a development that does not front upon a
City of Campbell public street. The City needs to issue encroachment permits
for work within the State's property for public street improvements and for
public utilities. The City cannot issue permits because the City does not have
jurisdiction on State property.
The proposed public street rights of way need to be granted to the City of
Campbell and the existing roadway improvements need to be relinquished to
and accepted by the City Council of the City of Campbell before the City can
issue encroachment permits or even approve the site plan. .

2. The plans submitted with the application include an "Architectural Site Plan"
and a "Topographic Survey" map. Each plan is contradictory to the other as to
existing physical improvements and/or rights of way and property lines.
Neither of the plans show a legend, notes or abbreviations as is normal standard
practice. Neither of the plans show the existing and/or proposed public utility
facilities. Neither of the plans show the proposed grading and drainage system
for the site, nor proposed pad elevations. The topography survey map shows
that the property is graded downstream to the northeast, toward VanDusen,
3. Revise plans to show existing street centerline and horizontal control
monuments, existing and proposed right-of-way line, existing and proposed
public street improvements, with dimensions, existing and proposed public
utilities including existing and proposed on-site and off-site grading and storm
drain system.
B. CONDITIONS OF APPROV AL
1, File and process Parcel Map to merge the separate parcels based upon a field
survey as required by Title 20, "Subdivision and Land Development," of the
City of Campbell Municipal Code. It is our understanding that this Parcel Map
is currently being prepared by the SCC Traffic Authority.
2. Dedicate public street right of way from Harriet Avenue to the north property
line of this property.
3. Submit three sets of grading and drainage plans that show grading and drainage
of the property toward the proposed public street right of way.
4. Pay storm drainage area fee in the amount of $510.00 (0.2615 acres @
$1 ,950.00/acre).
5. Submit application for encroachment permit(s), submit plans, post surety, and
pay fees for work within the public right of way.
