CC Resolution 10682 RESOLUTION NO. 10682 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL ADOPTING THE CITY COUNCIL POLICY ON THE USE OF THE CITY COUNCIL CHAMBERS AND GOVERNMENT CHANNEL 26 FOR ELECTION-RELATED ACTIVITIES. WHEREAS, local groups have requested the use of the Council Chambers to conduct election forums; and, WHEREAS, there is a public benefit from informing the citizens of electoral choices by telecasting such forums on government access cable channel 26; and, WHEREAS, the City desires to have a policy to provide guidance regarding the use of this public asset for such election-related purposes; and, WHEREAS, the City Council reviewed and provided direction on a draft policy at an August 1, 2006 study session; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby adopt the Council policy on Use of City Council Chambers and Government Channel 26 for Election-related Activities as noted in Exhibit 1. (.,' 'O~CH^\l\"l' CITY COUNCIL POLICIES AND PROCEDURES Subject: Use of City Council Chamber and Government Channel 26 for Election Activities Date: September 12, 2006 Purpose: The purpose of this policy is to provide guidelines on the use of the City Council Chamber and Channel 26 for election-related purposes. It will be monitored and enforced by the City Manager's Office. Policy: The City Council Chamber and Channel 26 may be used for government election information forums and presentations that serve Campbell residents. A sponsoring organization may use the facility and cablecasting system to hold and televise neutral candidates' forum or other educational election/ballot measure presentations for the benefit of Campbell residents. All candidate forums shall be open to the public and allow sufficient time for a full airing of questions from the audience. While the City of Campbell will not be responsible for programming content, all candidates running for the office, which is the subject matter of the forum, must be invited to participate. The City's official seal in the Council Chamber must be covered during these events so as to not suggest the City's endorsement of the forum or particular candidates. Video recordings of the event may be replayed on Channel 26 up to two times per week leading up to the election at the City's discretion. Video recordings will also begin with a disclaimer that the City of Campbell and its Redevelopment Agency are not responsible for the programming content and that the program does not represent the view of the City or Redevelopment Agency. User Eligibility: Locally-based, non-profit groups are eligible to use the Council Chamber for election-related forums. Newspapers of general circulation (as defined in California Government Code Section 6000) are eligible to co-sponsor such forums. The Chamber may be used for this purpose ten weeks prior to an election. Groups or organizations endorsing candidates or taking a position on a ballot issue prior to the forum are not eligible to use the Chamber or Channel 26. Use of Council Chamber and Channel 26 Policy Page 2 of 2 Groups that do not meet the criteria of this policy are invited to rent a facility at the Campbell Community Center or Campbell Library for similar forums. Procedure: Written requests must be submitted to the City Manager's Office no later then 4 weeks prior to the event. A determination by the City Manager's Office will be made within 5 business days.
