Further Investigation of the proposed L. I. D. on
Hacienda and Virginia Avenue project reveals that Ward Cramer has
filed a proposed subdivision on the ealt Ilde of Virginia Avenue
south of Sunnyoaks Avenue with a street plan that would tie Into
Virginia Avenue adjacent to the continuation of Bucknam Avenue.
It Is my suggestion and reComMendation that the
City Council have the Keith property ~ppralsed and negotiate for
purchase of said property and the~ extension of Buckham.
Said property not to be developed at this time. If and when, the
surrounding properties owners file for a proposed development
the CIty could enter into negotiations as to the amount of the
Improvements that the City would partl~ipate in.

Please estimate assessment to each lot, based upon the following assumptions:
1. That the City will contribute the cost of all traffic lanes throughout the
assessment district or the equivalent cost.
2. That 8~ of the side yard on any lot will be distributed to the assessment district
as a whole.
3. That the cost of teMporary Improvements at the corner of Hacienda and Virginia in the
form of asphalt curb and an asphalt sidewalk 4' in width will be borne by the City.
The temporary sidewalk on Hacienda and VirginIa will be placed In the nonmal parking
lane of Hacienda. south of the trees.
4. Assume that we will pay 30' a square foot for the lot in the way of the projection
of Bucknam.
5. Assume that the City or the Santa Clara Water 8ist. will provide the crossing of
the ditch to connect with the subdivision north of the ditch.

6. Assume that the City will do the engineering of the job and the inspection.
7. Assume the 11ty will advance the amofnt of money for acquisition of the excess
take for the projection of Bucknam and sign a contract with adjoining property owners
for acquisition over a 5 year period.

trees and all utilities required to complete this corner to the ultimate width.
Please check with the City Attorney, or upon your own knowledge, answer the following
question: Can an Individual owner subdivide and sell Individual lots without a
Realtor's license or subdivider's license?

The Cliffords were hesitant about committing them-
selves until they found whether 2 additional lots could be
obtained and the cost of the project to them.
The Messas were interested in the street going
through, but again the amount of interest would depend on
the cost. They would ~aintain their interest if the benefit
they accrue would be more than their cost of project.
Attached is a map which is self explanatory showing
existing buildings & proposed lot widths & depths. It is
assumed the strip on the southerly side of Bucknam <..vould be
sold to the :1essas.

PLANNING COMMISSION
CITY OF CAMPBELL. CALIFORNIA
The Planning Commission of the City of Campbell assembled In regular meeting
on the 2nd day of January, 1962, acted upon the Minor Subdivision of the lands
of Elsie Hayberry at 1059 South Virginia Avenue, a map of which property Is
marked Exhibit "A" and attached hereto, and upon recommendation of the Planning
Staff, denied said lot split for the following reason:
If at all possible the Staff recommends that Bucknam Avenue should be
continued through to Virginia Avenue for better development and emergency
service for the entire area.
The Commission further recommends that the City Council take the necessary
action to acquire the property of Elsie Mayberry for street purposes, and in the
event the City should acquire and approve this property. It Is recommended that
the Councl I consider a Non-Access Easement.
PASSED AND ADOPTED this 2nd day of January, 1962. by the following roll call
vote:

It seems that the Council ~y have two choices here - to either order
acquisition of the property as recommended by the Planning Commission, or
direct the City Manager to contact abutting properties to see If they would
be Interested In an assessment proceeding In acquiring their neighbor's
property In order to afford them additional lots over and above what they
can be afforded at the present time.
It seems apparent that even so, such an acquisition would have to be shared
with the abutting property owners In an assessment proceeding.
