WHEREAS, First Party desires to have a street installed to
be known as VIRGINIA AVENUE, in the City of Ciulpbell, County
of Santa Clara, State of California, in front of the property
of First PartY7 and
WHEREAS, City is willing to install said street with the
necessary sewers, gutters, and drainage facilities, as the
agent on behalf of First Party; and
WHEREAS, it will be necessary in such event for First Party
to dedicate to City, a 30 foot strip of land belonging to Pirst
Party, hereinafter described in the attached Bxhibit "A", which
is incorporated herein by reference, and
WHBRBAS, in consideration of City installing such street
facilities, street, gutter and sewer facilities, First Party
agrees to pay the aum of one Thousand Seventy Dollars ($1,070.00),
for storm drainage 7 and the sum of Three 'l'houaan4 .ine Hundred
Sixty-Five Dollars ($3,965.00) for other tmpro.'~.nts7 and
WHEREAS, in consideration for the dedication of said
property to City by Pirst Party, City aqr... to waive pa~nt by
Pirst Party of the engineering cost amounting to the sum of
One Hundred Eighty Dollars ($180.00) and City a180 agr... to
supply curb ways, drainage facilities, location, etc., as needed
in the preparation of the improvement plaae.
THE PARTIES HERETO agrees as folloW81
City agrees to install the street facilities, sidewa1ka, pavement.,
etc., for the sum of Five Thousand ThtIrtY'9in "!~1I
($5,035.00).
CITY FURTHER AGREES to waive the cost of One Hundred Eighty
Dollars ($180.00) involved in engineering studies for the project.
FIRST PARTY AGREES to pay to City as the in.talling agent
of the street, curbs and gutters and drainage facilities, the
sum of Five Thousand Thirty Five Dollars ($5,035.00) in full
payment thereof and to dedicate the real property described

SUBJECT TO the reservations set forth in said Deed,
including right of joint use of the street.
CITY FURTHER AGREES to prepare proper plans and speci-
fications and award covering contract tor the aforementioned
public improvements.
FIRST PARTY AGREES that upon receipt of the bill from
City of the cost of construction, plus charges for the time
of City personnel, it will pay the same to the City without
delay.
THE PROVISIONS OF THIS AGREEMENT shall inherit to the
benefit of and be binding upon the respective successors and
assigns of the parties hereto.

In regard to your verbal resuest concerning the
street improvements fronting your company's well site
on Virginia Avenue, please be advised that this office
is agreeable to acting as contracting agency for the
proj ect. I"... have additional work in the same area
which, it is felt, could be combined iLl the same
cOil,'l:ract. l1'his cO'lld, also, result in slightly lower
unit prices for the c0nstL"ucti..:)tl in your frontage.

It is proposed, then, that the City prepare the plans
and specifications and award this contract. Prior to the
award, and on the basis of bids received, we will bill

charges for the time of city personnel. Upon receipt of
such payment, we will award the contract.
Under this approach, the only additional stipulations,
of those discussed in our letter of January 24, 1962, would.
be the execution of the deed for street widening which
has been forwarded previously and the pa~nent of the storm
drain fee in the amount of $l,070.00. It will be appreciated
if these items are completed in the near future.

IN ACCORDANCE WITH the provisions of Section 9328.1 (I), Chapter 3, Article IX,
of the Campbell Municipal Code,
SAN JOSE WATER WORKS
Is hereby granted a Use Permit to allow a water well field on property located at
320 South Virginia Avenue, Campbell, California, subject to the following conditions:
1. The ambient noise level at any time of the day Is not to exceed the average
noise level as It exists In the neighborhood.
2. The architect's drawing showing fence and landscaping fronting on Virginia
Avenue to be presented for approval of Chairman of the "5" Approval
Committee and Planning Staff.
3. Sufficient plant material shall be provided to screen well sites and equip-
ment which will be compatible with the surrounding residential landscape.
4. There shall be a 25-foot residential setback for fence on front of property.
5. Applicant to conform with provisions of Article IX, Chapter I, Part II,
Campbell Municipal Code, and also conform with Flood Control Oistrlct's
requirements for San Tomas Aquino Creek.
GRANTED by the Planning Commission of the City of Campbell, California, on the
21st day of November, 1961.
