Subject: Street Improvements, 839 Virginia Avenue
Dear Mr. Haggerty:
The street improvement agreement which you signed on April 28, 1992 provided one year
for you to install street improvements on the frontage of your property at 839 Virginia
Avenue. These street improvements have not yet been designed or constructed. In
accordance with our conversation on November 2, the City will now proceed with the design
and construction of those improvements. The costs of the design, construction, and
administration of the improvements will be recovered from the $12,000 surety which you
posted on April 30, 1992. As that surety was not meant to cover the costs of design,
inspection, compaction testing, and administration, it may not fully cover the cost of the
improvements on your frontage. Should costs be incurred beyond the amount which you
posted, you will be billed for these costs. Of course, if total costs are less than $12,000, you
will be refunded any remaining surety funds.
The City will begin the design of these improvements immediately. Upon completion of the
improvement plans, they will be forwarded to the appropriate utilities with a request to
relocate their facilities to allow the construction of the improvements. Construction of the
improvements will begin as soon as possible after the relocation of these utilities. Weather
permitting, construction should begin on the offsite improvements in April, 1994. (We have
allowed three months for coordination with Pac Bell and the water company.)

I am writing in response to Mr. Haggerty's request to the City Manager for the return \\
of his street improvement surety. The surety ($12,000) was posted by Mr. Haggerty to :'\ II
guarantee his performance on an agreement to install street improvements on the frontage ~ \)
of his residence at 839 Virginia Avenue. The street improvement requirement was \ ...
triggered by an addition to his residence. Mr. Haggerty entered into an agreement to V... {4;.\(
install the street improvements within twelve months from April 14, 1992. Mr. Haggerty \
also verbally agreed to construct, at the City's expense, the improvements adjacent to his Y\.z. \~\
neighbor at 845 Virginia Avenue. The Council authorized and the City has encumbered \
$18,000 for the design and construction of these improvements at 845 Virginia. Mr. l(/) C.1()-'-'\
Haggerty has requested several times to have portions of his surety released so that he can -
afford to get started on the street improvements. He has been told that the surety is to f\U\'1. dt~ ~
be held by the City to guarantee the work, and that it will only be released if it is +
replaced by a performance bond. As I see it, we have several alternatives: ..1)
1) The most preferable alternative is to have Mr. Haggerty hire an engineer, haveU\\t~(\~~L~'~
the improvements designed, and build them. These were the terms of the original \1....1), L&
agreement between Mr. Haggerty and the City. When he has a contractor, and ~ ~ "'-,
that contractor presents a performance bond to the City, Mr. Haggerty's $12,000 ~ \,j}YL
can be released to construct the improvements. Mr. Haggerty has been presented \
this scenario several times by staff, and has contended that he does not have . \. \) ~.-k\---

2) If Mr. Haggerty will not have the improvements designed, the City could take the
position that Mr. Haggerty has defaulted on his agreement, and use the surety to
design and construct the improvements. As this surety is not intended to cover
the costs of design, plan check, and inspection, it may not be sufficient to
completely construct the improvements. We should be prepared for the possibility
of having to recover additional costs. If costs must be recovered in addition to
the surety which Mr. Haggerty has posted, the City can attempt to recover those
costs in small claims court. As the improvements are relatively simple, some

3) The estimate made for the surety assumed that an electrolier was required on Mr.
Haggerty's frontage. Under current City policy an electrolier is not required, so
the surety estimate is high by approximately $2,440. All or part of this amount
could be returned to Mr. Haggerty without defeating the purpose of the surety.
We should consider the fact, though, that Mr. Haggerty still owes the City $1,666
for fees and deposits associated with the permit. If we release all or part of this
$2,440 to Mr. Haggerty, it may be enough to get him going on the
improvements. If he does not perform, the City has that much less money with
which to enforce the agreement.

Dear Mr. Haggerty:
The City Council, at the meeting of October 20, 1992, reserved
funds for the installation of the improvements adjacent to your
property at 839 Virginia Avenue. Per our previous discussion,
you will hire an engineer to design the street improvements
fronting your property and those fronting the adjacent property.
The City requires a copy of the proposal for this work, and the
proposal should separate the charges for the work on your
frontage from the work in front of 845 Virginia Avenue. Your
engineer will bill the City directly for the work in front of the
property adjacent to yours. You must get at least three bids
from contractors to do the street improvement work. These bids
must itemize the work, and the prices for the City's portion must
be separated from the work on your frontage. Submit the three
proposals to the City for review when you have them. Your
contractor may also bill the City directly for our portion of the
work.
The money which you posted as a surety will be released by the
City when it is replaced with a performance bond. Without a
bond, this money cannot be released as the project progresses for
the purpose of paying your engineer and contractor.
Please call me when you have a proposal for the engineering work
so that we can look it over. If you have any questions, please
