IW"EY PLANNER I I lc Encl.: Plans, Resolution cc: Fi re llipartmen t Public Works llipartment RESOLUTION NO. 2482 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT AND PLANS TO ALLOW THE CONSTRUCTION OF AN ADDITIONAL LIVING UNIT ON PROPERTY KNOWN AS 871 VIRGINIA AVE. IN AN R-1-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. (APPLICATION OF MR. EMORY MCGEHEE, UP 87-16). After notification and public hearing as specified by law on the application of Mr. Emory McGehee for a Use Permit and approval of plans to allow the construction of an additional living unit on property known as 871 Virginia Ave. in an R-1-6 (Single Family Residential) Zoning District, as per the application filed in the Planning Department on August 27, 1987; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: 1. Due to the large size of the lot, the location of the proposed unit to the rear of the property, the unit not being visible from the street, and the larger setbacks provided, that this unit will fit into the neighborhood inconspicuously. 2. The design and materials of the proposed unit will match the existing house. 3. Conditions of approval imposed will upgrade the site to the benefit of the neighborhood. 4. That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: 1. Property to be fenced as indicated and/or added in red on the plans. Fencing shall be maintained in accordance with the approved plans. 2. Fencing plan indicating location and design details of fencing to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. 3. All mechanical equipment on roofs and all utility meters to be screened as approved by the Planning Director. 4. Building occupancy will not be allowed until public improvements are installed. 5. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. Resolution No. 2482 -2- UP 87-16 6. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. 7. Noise levels for the interior of residential units shall comply with mInImum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. 8. The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Sect. 11.201 & ll.4l4, 1979 Ed. Uniform Fire Code. BUILDING DEPARTMENT 9. Retaining walls at property lines are limited to a height of 15 inches if constructed of wood. PUBLIC WORKS DEPARTMENT 10. Dedicate an additional 10 feet across the frontage to widen Virginia Ave. to 30 feet half-width. PLANNING DEPARTMENT 11. Prior to final inspection & occupancy, applicant to provide to the Planning Department a copy of a recorded deed restriction requiring that not more than one unit on the property shall be rented or leased. 12. Prior to final inspection and occupancy, applicant to: A. Remove existing accessory building on rear of property or reduce its size to 200 sq.ft. and bring it up to code. B. Remove structure on right side of property between fence and garage. C. Remove all junk, debris, wood, scrap, metal, building materials not for use on the site, and similar materials. D. Construct new 6-foot fence on right side of property. FIRE DEPARTMENT No comments at this time. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the Laws of the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
