DISCUSSION On December 8, 1998, the Planning Commission adopted Resolutions 3209, 3210, and 3211 granting approval of a Variance to allow 59 foot wide parcels instead of the required 70 feet, a Tentative Parcel Map to create two residential lots, and the Site and Architectural applications, respectively. Included with the Parcel Map is an offer of dedication for right-of-way for public street purposes and a ten foot public service easement. According to the Subdivision Map Act dedications offered on maps must be accepted by the legislative body prior to the approval of the Parcel Map. Staff is ready to approve the Parcel Map, and recommends that the City Clerk be authorized to accept the public dedications and easement as shown on the Parcel Map. FISCAL IMPACT None with this action. AL TERNA TIVES 1. Do not authorize the City Clerk to accept the public dedication and easement. This is not recommended since the public street dedication was a condition of approval for the development and the utility companies have agreed to the filing of the Final Map with the public service easement shown. The failure of Your existing structures, or any part of them, to be constructed in accordance with applicable building codes. I have discussed this with Chuck and we both recalled that we all had agreed that the drainage would be overland, and not involve any percolation trenches with the exception of one possible at the rear of the redwood tree lot. The new plan has trenches around the perimeter of both lots to a 1.5 foot depth, with the exception of within the redwood tree area. In that area a swale is indicated to be graded. The arborist report stated that the 31 foot Tree Protection Zone for the Redwood "should not be disturbed by excavation of soil, the application of soil fill, compaction, or the storage and/or disposal of construction materials." The proposed plan does not meet this criteria. The plan indicates that a minimum of 4 inches will be graded uphill of the tree. No existing or proposed grades are indicated near the tree trunk or beyond. fyJe had requested that a number of such grades be indicated under the tree, and especially between the trunk and the side property line.) The ground near the trunk is higher, due to the natural growth pattems of the redwood roots. Thus, most probably, the amount of grading which this plan would result in would be even greater than the 4 inches, in order to provide the fall needed. We had discussed draining away from the tree, with the swale/water between the tree and the rear yard being directed into the back yard to a percolation trench at the rear fence. This is the only area where a percolation trench had been discussed. The drainage would then be directed from this trench out to the street along the opposite side of the house from the tree. SUMMARY . No Percolation trenches except a few feet in only from the rear property line of the redwood tree lot. . No grading within 31 feet of the trunk of the redwood tree, except the pier and grade beam for the porch, and new house foundation. . Park Impact Fee: A park impact fee of $10,990 per unit/parcel shall be paid into the Park Impact Fund, with % of the fee due prior to map recordation and the remainder prior to final occupancy of the dwelling. A credit will be given for the preexisting legal single family use on the property, if the project is constructed within two years of the demolition of that house. 5. Property Maintenance: The property is to be maintained free of any combustible trash, debris and weeds until the time that actual construction commences. Any vacant existing structures shall be secured, by having windows boarded up and doors sealed shut, or be demolished or removed from the property (Section 11.201 and 11.414, 1985 Ed. Uniform Fire Code). 6. Tree Protection Plan: A. The tree protection methods outlined in the arborist report by Gil Mitchell, RCA #317, shall be incorporated into the demolition, grading and drainage, building, utility, landscape, and any and all plans pertaining to any demolition or construction work on this property . B. An arborist shall be retained to supervise any excavation within a 31 foot radius of the trunk of the coast redwood. C. All underground utility/drainage lines shall be located outside a 31 foot radius of the trunk of the coast redwood tree. D. Prior to issuance of the demolition permit, the owner and contractor shall meet with representatives of the Planning and Building Divisions of the Community Development Department to discuss the tree protection plan. E. No permits shall be issued, including a demolition permit, until the trees which are to be saved have been fenced according to the methodology outlined in the report. 7. Landscaping: The applicant shall submit a landscape plan prior to issuance of any demolition plan which provides the following: A. Trees. The minimum number and size of trees to be planted shall be shown, with a listings and a diagram which show that the plan meets the following criteria: i. A minimum of one (I) tree per 2,000 square feet of net lot area of the subject property, per the San Tomas Area Neighborhood Plan. Existing trees within the net lot area of the subject property shall be included in the total, and shown on the plan. 11. Two California black walnut (Juglans hindsii) trees, one coast redwood (Sequoia sempervirens) tree, one California fan palm (Washingtonia filifera) tree, one silver dollar gum (Eucalyptus camadulensis) tree, and one coast red elderberry (Sambucus callicarpa) tree. The trees were affixed with numbered aluminum disks at approximately four to five feet above ground line. Only two trees are recommended for retention, the California fan palm and the coast redwood trees. The other trees are recommended for removal. The Tree Protection Zone (TPZ) The tree protection zone is defined as the area adjacent to the mainstem of a tree which should not be disturbed by excavation of soil, the application of soil fill, compaction, or the storage and/or disposal of construction materials. The radius of the TPZ is calculated given that the root zone around the entire circumference of a tree will be affected. For the coast redwood tree on this property I have determined that the TPZ is equal to one times the diameter of the trunk (measured in inches) at four and one half feet above ground line (Trees and Development, Matheny & Clark, 1998, page 74). California fan palm trees of the size on this property need a relatively small TPZ of approximately a three foot radius. Appraised Value The appraised value of a tree is determined by using a formula developed by the Council of Tree and Landscape Appraisers. The factors involved are the size of the tree, species, condition, and location. The size of the tree is typically the diameter of the trunk measured four and one half feet above ground line. For the purposes of this report, the diameter of each tree was taken at four and one half feet above ground line unless stipulated otherwise. The Western Chapter of the International Society of Arboriculture developed the basic price of a replacement tree and species ratings for each tree species in California. These two factors are used to determine the basic value of a particular tree in a landscape. The basic value is then adjusted by condition-and location factors. Condition factors are summarized in the Analysis of Condition Factors pages of this report and adjust the appraised value (line 7 of the Appraised Value A~e). Site refers to urban versus rural, residential versus commercial or industrial. Placement is a function of where a tree is growing on a property. Contribution and placement are usually complimentary in that the better the placement the higher the contribution. Analysis By Tree Silver dollar gum tree #228 This tree is the sum of nine primary stump sprouts that grew after the tree was cut to a nine inch tall stump. The reason for the removal is unknown but the result is a very large "bush tree". This species of eucalyptus has inherently weak limb attachments that can fail with little or no wind, and during storms or on a hot summer days. The very poor trunk structure makes this a tree that I recommend for removal. For the purposes of this report I related the nine trunk diameters as comparable to a 25 inch diameter trunk. The appraised dollar value of the tree is $9,000.00 Coast redwood tree #229 The diameter of the mainstem is 31 inches measured at four and one half feet above ground line. This tree is in excellent condition. The corner of the existing house is 12 feet from the edge of the trunk. The lowerst limbs on the driveway side of the tree are within 12 feet of ground line. Removing some low limbs would not affect the health or structure of the tree but could affect the aesthetic value so pruning should only be for the least amount of building clearance. Limbs should have either their drooping lateral branches removed or entire limbs removed versus cut back to stubs. The TPZ for this tree has a radius of 31 feet and includes a total area of 3,017 square feet The existing building is located eight feet to the north and eleven feet to the west of the center of the mainstem and includes 480 square feet of the TPZ or 15 percent of the total area included in the TPZ I suggest that removing the existing house and building a new house in the location of the existing house would do little or no damage to the existing root zone of the tree. I also suggest that a new foundation could be constructed within the TPZ if that portion of the foundation within the TPZ were built a minimum of fifteen feet away from the mainstem and on one side only. Coast red elderberry tree #230 This is an over mature tree that branches into two scaffold limbs within 12 inches of ground line. One scaffold limb branches into three limbs at 32 inches above ground line. One of these limbs branches again into two limbs at four feet above ground line. The diameter of all the branches at four and one half feet above ground line are 14, 13, 8.8, 6.25, and 6 inches. This tree has live foliage scattered through out the canopy with over half of the foliar canopy dead. This is a very poor tree and I recommend removal. The appraised value of the tree is the cost of removal, $300.00 California black walnut tree #231 The diameter of the mainstem is 215 inches at four and one half feet above ground line. There is extensive dead tissue around five feet of the 9' 6" circumference (measured at nine inches above groWld line). The tree was once cut to a 15'6" tall stump. Five branches have taken over the foliar canopy. Two of the five are dead or dying. The stem diameter at the cut point appears to be 18 inches. There are no natural scaffold limbs on the tree and the entire foliar canopy consists of watersprouts. I recommend removing the tree. The appraised dollar value is $1,800.00 California black walnut tree #232 The diameter of the mainstem is 29 inches at four and one half feet above ground line. The tree was once pollarded to a 12 foot height and includes three scaffold limbs that are each approximately 14-24 inches in diameter. The foliar canopy consists of watersprouts (three to four . .. The appraised value of this tree is $5,100.00 California fan palm tree #233 The diameter of the mainstem is 19.5 inches measured at four and one half feet above ground line and the tree is approximately 45 feet tall. The existing house is nine feet from the center of the trunk. The tree appears to be in excellent condition. An appraised value is given in case the tree needs to be removed in order to develop the property. The Guide for Plant Awraisal is not used for palm trees because a cost for replacement is a more accurate value than the appraised dollar value. The replacement cost is calculated by adding the cost of the plant and the cost of the installation of the plant The cost of a 45 foot tall palm tree was quoted by Valley Crest Tree Company to be $2,250.00. The planting cost was quoted by Corporate and Commercial Services of San Jose to be $2,200.00 for a total replacement cost of $4,450.00 General Recommendations 1. Remove and/or prune trees as necessary prior to materials and equipment arriving on site. 2. Contactors working on site should be fami1i3r with how the development of the property will impact the trees (see enclosures) to be retained. 3. Apply a two to four inch layer of wood chips or mulch over the area identified as the TPZ. 4. Erect construction period fencing prior to materials and equipment arriving on site. The fencing should consist of chainlink fence that is a minimum of five feet in height, mounted on two inch galvanized pipe driven 18 inches into the ground, and able to keep out even foot traffic. The fencing should be at the edge of the TPZ or existing hardscape, and moved only to accommodate the construction of new hardscape. 5. I suggest that an International Society of Arboriculture (ISA) Certified Arborist be retained to supervise any excavation below existing grade and within the TPZ of each tree to be retained. Roots damaged during excavation should be pruned and treated per the specifications found in this report. Root Care Recommendations Root severing, soil compaction, and construction of an impervious layer, such as asphalt or concrete, should be avoided or minimized within the TPZ of each tree to be retained Any hardscape (such as asphalt or concrete) to be removed over tree roots must be broken up with a pneumatic chisel, and/or hand tools, and then the pieces hand loaded into a dump truck or disposal site. A skip loader or other heavy equipment should not be used as it will destroy the feeder roots. If the tree has roots damaged, severed or covered within it's dripline it will be considered stressed and should be deep irrigated prior to construction. Irrigation is best provided using "ooze" -type soaker hoses. They are easily available at hardware stores and garden centers. These hoses dribble water into the ground, providing deep watering wherever they are laid down. Where the root zone is intact, the soaker hose should be placed at the dripline. Where root destruction has occurred, the hose should be placed over the cut ends of the roots. If left over night, enough water should easily be provided to penetrate 24" deep. Depth of penetration should be checked with a soil probe or shovel. Monthly irrigations during the dry season should occur until one year after construction is completed. If any roots over three inches in diameter are severed during any excavation the following procedure should be followed: 1. The roots should be shaded by immediately covering the entire trench with plywood, or by covering the sides of the trench with burlap sheeting kept moist with twice a day wettings. 2. When ready to backfill, each root should be severed cleanly with a handsaw. Where practical, they should be cut back to a side root. Immediately, a plastic bag (or wrap) should be placed , . Shading should be immediately replaced until backfilling occurs. The purpose of this procedure is to keep root cambium alive. This layer of cells produces all of the new tissues, including new roots. New root initials may be produced much sooner using this method.
