Subject: Vacation of Wesnnont Avenue
We have reviewed your letter, dated August 14, 1996, relative to the proposed vacation of Westmont
A venue adjacent to the Granados property and make the following comments:
A. The IS-foot-wide strip of land which you propose to convey to the abutting owner is encumbered
with an existing pipeline easement in favor of the District. Your conveyance document should
address this easement and indicate that the District will not compensate the owner for damages
or improvement costs in the event that we must enter the property to repair the existing pipeline.
No trees may be planted in the easement, and a District permit must be obtained prior to any
landscaping or placement of any structures induding fences within the easement.
B. Because this approach will not result in any sale proceeds being distributed to the District and the
District will incur processing costs, the District should receive one-half of the processing fee
referred to in your letter to be charged by the City in connection with transfers of title to the
adjoining owners.
If this request is acceptable, please send me a copy of the proposed deed language that you will use, and
I will have it reviewed by District Counsel.

Westmont Avenue and authorized the execution of the Quitclaim Deed. Enclosed please
fmd the originally signed Quitclaim Deed and a copy of City Council Resolution No. 9292
concerning the above subject property. It is your responsibility to file the Deed with the
County Recorder's Office (located at 70 West Hedding Street, San Jose).
Prior to issuance of building permits for your property, you will have to merge this parcel
with your existing parcel (APN 403-10-037). Please contact me at 866-2158 for additional

A RESOLUTION Of THE CITY COUNCIL Of THE CITY Of CAMPBELL
VACATING EXCESS RIGHT-Of-WAY ONWESTMONT AVENUE
ADJACENT TO APN # 403-10-037
WHEREAS, on August 7, 1990, the Santa Clara Valley Water District (SCVWD) executed a
Grant Deed conveying a certain 45 foot wide strip of land on the north side of Westmont Avenue
west~rly of San Tomas Aquino Road to the SCVWD flood control easement to the City of Campbell
for public street purposes; and
WHEREAS, the City accepted the right-of-way which was consistent with the long range
plans for Westmont Avenue; and
WHEREAS, the City's subsequent adoption of the San Tomas Area Neighborhood Plan
which classified Westmont Avenue from San Tomas Aquino Road to Harriet Avenue as a minor
collector street and revised the long range plans for Westmont Avenue to be a 28 foot half street
right-of-way, resulted in an excess street right-of-way of 17 feet maximum; and
WHEREAS, there have been several inquiries from current and potential land owners
requesting the vacation of the excess street right-of-way;
WHEREAS, the SCVWD has agreed to the vacation of the excess right-of-way by the City
directly to the adjacent property owners based on the following conditions:
1. The vacated right of way will be encumbered by an easement m favor of the
SCVWD.
2. The City's conveyance document must indicate that the SCVWD will not compensate
the owner for damage or improvement costs if the SCVWD needs to enter the
property to repair the pipeline.
3. No permanent improvements can be installed in the easement without a permit from
the SCVWD.
4. If the City sells the property, the proceeds should be given to the SCVWD.
5. If the City collects a fee for processing the Application for Vacation of Excess Right-
of-Way, one half of the proceeds should be given to the SCVWD.
6. The width of the street vacation should not exceed 15 feet.
7. The future street improvements should be constructed as generally shown on the
attached Exhibit "B".
WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of Part 3 of
Division 9 of the California Streets and Highway Code; and
WHEREAS, the property to be vacated is described on the attached legal description and
shown on-the attached plat "Exhibit A" reserving therefrom a public use/public utility easement for
the benefit of the City of Campbell and the existing pipeline easement for the benefit of the
SCVWD; prohibiting the installation of trees or placement of any structures including fences within
the easement without a permit from the SCVWD; allowing the SCVWD the right to access,
maintain, repair and/or replace the existing pipeline without comi!ensation to the property owner for
damages or improvement costs over, under, and upon said property; and
WHEREAS, the property to be vacated constitutes excess street right of way not required for
street or highway purposes; and
WHEREAS, from and after this date that this Resolution is recorded, the street portion or
portion thereof vacated no longer constitutes a public street;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the excess right-of-way on Westmont Avenue adjacent to APN# 403-10-037,
authorizes the Public Works Director to execute the necessary documents for vacation of this excess
right-of-way, and authorizes the City Clerk to record this Resolution.

of City Council Resolution No. 9292 and proposed quit claim deed for the vacation of a
portion of excess street right-of-way along 1305 Westmont Avenue. We have included all of
the conditions requested by the SCVWD in your September 17, 1996 letter (copy attached).
Please let us know as soon as possible if you have any comments.
The City will forward a check for $225 (one-half of the Street Vacation application fee) to the
SCVWD if the deed meets with your approval.

At the regular City Council meeting of October 21, 1997, the City Council adopted
Resolution No. 9292 authorizing the vacation of excess right-of-way on Westmont
Avenue adjacent to APN# 403-10-037 (1305 Westmont Avenue). Please find certified
copy of this Resolution attached for your own records.
As per your request, the original Resolution has been sent to the County Recorder's
Office for recordation. I will of course forward a copy of the recorded document
to you in due course.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
VACATING EXCESS RIGHT-OF-WAY ONWESTMONT AVENUE
ADJACENT TO APN # 403-10-037
WHEREAS, on August 7, 1990, the Santa Clara Valley Water District (SCVWD) executed a
Grant Deed conveying a certain 45 foot wide strip of land on the north side of Westmont Avenue
westerly of San Tomas Aquino Road to the SCVWD flood control easement to the City of Campbell
for public street purposes; and
WHEREAS, the City accepted the right-of-way which was consistent with the long range
plans for Westmont Avenue; and
WHEREAS, the City's subsequent adoption of the San Tomas Area Neighborhood Plan
which classified Westmont Avenue from San Tomas Aquino Road to Harriet Avenue as a minor
collector street and revised the long range plans for Westmont Avenue to be a 28 foot half street
right-of-way, resulted in an excess street right-of-way of 17 feet maximum; and
WHEREAS, there have been several inquiries from current and potential land owners
requesting the vacation of the excess street right-of-way;
WHEREAS, the SCVWD has agreed to the vacation of the excess right-of-way by the City
directly to the adjacent property owners based on the following conditions:
1. The vacated right of way will be encumbered by an easement III favor of the
SCVWD.
2. The City's conveyance document must indicate that the SCVWD will not compensate
the owner for damage or improvement costs if the SCVWD needs to enter the
property to repair the pipeline.
3. No permanent improvements can be installed in the easement without a permit from
the SCVWD.
4. If the City sells the property, the proceeds should be given to the SCVWD.
5. If the City collects a fee for processing the Application for Vacation of Excess Right-
of-Way, one half of the proceeds should be given to the SCVWD.
6. The width of the street vacation should not exceed 15 feet.
7. The future street improvements should be constructed as generally shown on the
attached Exhibit "B".
WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of Part 3 of
Division 9 of the California Streets and Highway Code; and
WHEREAS, the property to be vacated is described on the attached legal description and
shown on-the attached plat "Exhibit A" reserving therefrom a public use/public utility easement for
the benefit of the City of Campbell and tlre existing pipeline easement for the benefit of the
SCVWD; prohibiting the installation of trees or placement of any structures including fences within
the easement without a permit from the SCVWD; allowing the SCVWD the right to access,
maintain, repair and/or replace the existing pipeline without compensation to ihe property owner for
damages or improvement costs over, under, and upon said property; and
WHEREAS, the property to be vacated constitutes excess street right of way not required for
street or highway purposes; and
WHEREAS, from and after this date that this Resolution is recorded, the street portion or
portion thereof vacated no longer constitutes a public street;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the excess right-of-way on Westmont Avenue adjacent to APN# 403-10-037,
authorizes the Public Works Director to execute the necessary documents for vacation of this excess
right-of-way, and authorizes the City Clerk to record this Resolution. /

RECOMMENDATION
Adopt the attached resolution summarily vacating excess right-of-way at 1305 Westmont Avenue.
BACKGROUND
Prior to the adoption of the San Tomas Area Neighborhood Plan (STANP) in December of 1993,
the proposed right-of-way width for Westmont Avenue between San Tomas Aquino Road and
Harriet Avenue was 90 feet. In August, 1990, the Santa Clara Valley Water District (SCVWO)
dedicated the northerly 45 feet of this proposed right-of-way to the City of Campbell for street
purposes. This dedication was accepted by the City, with the Water District retaining an easement
for maintenance of their existing 42 inch pipeline located within the proposed right-of-way.
With the adoption of the STANP in December 1993, Westmont Avenue from San Tomas Aquino
Road to Harriet Avenue was reclassified as a minor collector street. As a result of this change, the
proposed right-of-way was reduced from 90 to 56 feet, leaving the City with 34 feet of excess right-
of-way along this portion of Westmont.
Staff has received several inquiries from current and potential land owners about the possibility of
acquiring the excess right-of-way so that this excess property could be incorporated into and used by
the adjacent land owners rather than remaining a vacant and unmaintained property. On January 7,
1997, the City Council summarily vacated a portion of this excess right-of-way to the property
owner at 1325 Westmont Avenue. An application for the vacation of excess right-of-way from the
property owners at 1305 Westmont Avenue (APN 403-10-037 as shown on Attachment A) has been
received and reviewed by staff. The application is complete with the plat and description necessary
to allow the City to vacate this excess stteet right-of-way.
DISCUSSION
Because this property was dedicated to the City by the SCVWD, it has been necessary for staff to
coordinate with the District on the proposed City vacation of this excess right-of-way to the adjacent
property owners, as typically, vacated property is returned to the dedicating party. Although the
Water District has indicated that they do not wish to retain ownership of this property, they have
requested the following actions be taken by the City in conjunction with the proposed vacation:
1. The City's conveyance document must indicate the presence of the District's easement.

2. The City's conveyance document must indicate that the District will not compensate the
owner for damage or improvement costs if the District needs to enter the property to repair
the pipeline.
3. No permanent improvements can be installed in the easement without a permit from the
SCVWD.
4. If the City sells the property, the proceeds should be given to the District.
S. If the City collects a fee for processing the Application for Vacation of Excess Right-of-Way,
one half of the proceeds should be given to the District.
6. The width of the street vacation should not exceed 15 feet.
7. The future street improvements should be constructed as generally shown on Attachment B.
The SCVWD terms for release of the property are reasonable, and staff has prepared the attached
resolution which includes the SCVWD requirements. Should Council adopt the attached resolution,
one-half of the $550 processing fee collected from the applicant will be transmitted to the SCVWD.
Condition 7 will require an exception to the STANP. Construction of Westmont to conform to the
STANP is not possible due to the location of the SCVWD's 42 inch pipeline and specific SCVWD
requirements to allow for the maintenance of this facility. The revised cross section required to
protect the existing pipeline is shown in Attachment B and will require a 30 foot half street right-of-
way rather than the ST ANP required 28 foot half street right-of-way.
Staff is recommending that the City Council adopt the attached resolution summarily vacating the
excess street right-of-way along this portion of Westmont Avenue adjacent to parcel number 403-10-
037 subject to the comments received from the SCVWD, approve the exception to the STANP for
this section of Westmont Avenue, authorize the Public Works Director to process and execute the
necessary documents to complete the vacation of the excess street right-of-way, and authorize the
City Clerk to record the resolution summarily vacating this portion ofWestmont Avenue.
As future parcel owners along this portion of Westmont submit applications, legal descriptions, and
plats for vacation of the excess street right-of-way adjacent to their parcels, staff will return to
Council and recommend the vacation of the additional excess street right-of-way.

VACATING EXCESS RIGHT-OF-WAY ON WESTMONT AVENUE
ADJACENT TO APN # 403-10-037
WHEREAS, on August 7, 1990, the Santa Clara Valley Water District (SCVWD) executed a
Grant Deed conveying a certain 4S foot wide strip of land on the north side of Westmont Avenue
westerly of San Tomas Aquino Road to the SCVWD flood control easement to the City of Campbell
for public street purposes; and
WHEREAS, the City accepted the right-of-way which was consistent with the long range
plans for Westmont Avenue; and
WHEREAS, the City's subsequent adoption of the San Tomas Area Neighborhood Plan
which classified Westmont Avenue from San Tomas Aquino Road to Harriet Avenue as a minor
collector street and revised the long range plans for Westmont Avenue to be a 28 foot half street
right-of-way, resulted in an excess street right-of-way of 17 feet maximum; and
WHEREAS, there have been several inquiries from current and potential land owners
requesting the vacation of the excess street right-of-way;
WHEREAS, the SCVWD has agreed to the vacation of the excess right-of-way by the City
directly to the adjacent property owners based on the following conditions:
1. The vacated right of way will be encumbered by an easement in favor of the
SCVWD.
2. The City's conveyance document must indicate that the SCVWD will not compensate
the owner for damage or improvement costs if the SCVWD needs to enter the
property to repair the pipeline.
3. No permanent improvements can be installed in the easement without a permit from
the SCVWD.
4. If the City sells the property, the proceeds should be given to the SCVWD.
S. If the City collects a fee for processing the Application for Vacation of Excess Right-
of-Way, one half of the proceeds should be given to the SCVWD.
6. The width of the street vacation should not exceed 15 feet.
7. The future street improvements should be constructed as generally shown on the
attached Exhibit "B".
WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of Part 3 of
Division 9 of the California Streets and Highway Code; and
WHEREAS, the property to be vacated is described on the attached legal description and
shown on the attached plat -Exhibit A- reserving therefrom a public use/public utility easement for
the benefit of the City of Campbell and the existing pipeline easement for the benefit of the
SCVWD; prohibiting the installation of trees or placement of any structures including fences within
the easement without a permit from the SCVWD; allowing the SCVWD the right to access,
maintain, repair and/or replace the existing pipeline without compensation to the property owner for
damages or improvement costs over, under, and upon said property; and
WHEREAS, the property to be vacated constitutes excess street right of way not required for
street or highway purposes; and
WHEREAS. from and after this date that this Resolution is recorded, the street portion or
portion thereof vacated no longer constitutes a public street;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the excess right-of-way on Westmont Avenue adjacent to APN# 403-10-037, .
authorizes the Public Works Director to execute the necessary documents for vacation of this excess
right-of-way, and authorizes the City Clerk to record this Resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
VACATING EXCESS RIGHT-OF-WAY ON WESTMONT AVENUE
ADJACENT TO APN # 403-10-038
WHEREAS, on August 7, 1990, the Santa Clara Valley Water District (SCVWD)
executed a Grant Deed conveying a certain 45 foot wide strip of land on the north side of
Westmont Avenue westerly of San Tomas Aquino Road to the SCVWD flood control easement
to the City of Campbell for public street purposes; and
WHEREAS, the City accepted the right-of-way which was consistent with the long range
plans for Westmont Avenue; and
WHEREAS, the City's subsequent adoption of the San Tomas Area Neighborhood Plan
which classified Westmont Avenue from San Tomas Aquino Road to Harriet Avenue as a minor
collector street and revised the long range plans for Westmont Avenue to be a 28 foot half street
right-of-way, resulted in an excess street right-of-way of 17 feet maximum; and
WHEREAS, there have been several inquiries and one application from current and
potential land owners requesting the vacation of the excess street right-of-way;
WHEREAS, the SCVWD has agreed to the vacation of the excess right of way by the
City directly to the adjacent property owners based on the following conditions:
1. The vacated right of way will be encumbered by an easement in favor of the
SCVWD.
2. The City's conveyance document must indicate that the SCVWD will not
compensate the owner for damage or improvement costs if the SCVWD needs to
enter the property to repair the pipeline.
3. No permanent improvements can be installed in the easement without a permit
from the SCVWD.
4. If the City sells the property, the proceeds should be given to the SCVWD.
5. If the City collects a fee for processing the Application for Vacation of Excess
Right-of-Way, one half of the proceeds should be given to the SCVWD.
6. The width of the street vacation should not exceed 15 feet.
7. The future street improvements should be constructed as generally shown on the
attached Exhibit "B".
WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of Part 3
of Division 9 of the California Streets and Highway Code; and
WHEREAS, the property to be vacated is described on the attached legal description and
shown on the attached plat "Exhibit A" reserving therefrom a public use/public utility easement
for the benefit of the City of Campbell and the existing pipeline easement for the benefit of the
SCVWD; prohibiting the installation of trees or placement of any structures including fences
within the easement without a permit from the SCVWD; allowing the SCVWD the right to
access, maintain, repair and/or replace the existing pipeline without compensation to the property
owner for damages or improvement costs over, under, and upon said property; and
WHEREAS, the property to be vacated constitutes excess street right of way not required
for street or highway purposes; and
WHEREAS, from and after this date that this resolution is recorded, the street portion
or portion thereof vacated no longer constitutes a public street;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the excess right-of-way on Westmont Avenue adjacent to APN# 403-10-038,
authorizes the Public Works Director to execute the necessary documents for vacation of this
excess right-of-way, and authorizes the City Clerk to record this Resolution.
