RESOLUTION NO. 10704
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
APPROVING THE TRACT MAP FOR TRACT NO. 9738, ACCEPTING THE PUBLIC
SERVICE EASEMENTS OFFERED FOR DEDICATION, VACATING PUBLIC RIGHT-
OF-WAY, AND AUTHORIZING THE MAYOR TO EXECUTE THE PEDESTRIAN
BRIDGE LICENSE AGREEMENT FOR PROPERTY LOCATED AT
201 E. CAMPBELL AVENUE
WHEREAS, on November 16, 2004, the City Council approved Resolution No. 10415
approving a Tentative Map for the property located at 201 E. Campbell Avenue; and
WHEREAS, revised and/or new public service easements, building foundation
easements, ingress and egress easements, emergency vehicle access easements, and
utility easements are necessary to accommodate the approved use of the property; and
WHEREAS, existing public right-of-way is to be vacated to allow for the approved use of
the property; and
WHEREAS, the public service easements have been offered for dedication on the Tract
Map; and
WHEREAS, the public right-of-way to be vacated has been delineated on the Tract
Map; and
WHEREAS, the proposed use of the property includes a pedestrian bridge that
connects the property to the upper level of the City's parking structure; and
WHEREAS, a Pedestrian Bridge License Agreement has been prepared to address the
encroachment of this facility onto public property; and
WHEREAS, the Tract Map has been prepared, reviewed by staff, and found to be in
compliance with the Tentative Map, Subdivision Map Act and Title 20 of the Campbell
Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that the Tract Map for Tract 9738 is hereby approved and the public service easements
offered for dedication as shown on the said map are hereby accepted in conformity with
the terms for which they are offered, and the public right-of-way as shown on said map
to be vacated is hereby approved; and the Mayor of the City of Campbell is hereby
authorized to execute the Pedestrian Bridge License Agreement on behalf of the City of
Campbell.
