NO FEE Ia RESOLUTION NO. 8246 11313912 FILED FOR R£'!rCORD AT REQUEST OF CIT7 OF CAMPBELL OFFiO]kL F ~OORDS SANTA CLARA COUNTY LAURIE KANE RECORDER BEING A RESOLUTION AND ORDER OF THE CITY COUNCIL OF THE CITY OF CAMPBELL, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA VACATING A PORTION OF CENTRAL AVENUE WHEREAS, the City Council of the City of Campbell, County of Santa Clara, State of California, pursuant to the provisions of The Public Streets, Highways, and Service Easements Vacation Law, did heretofore, on the 21st day of January, 1992 pass upon and adopt its Resolution of Intention to vacate a certain portion of a Public Street, being Resolution No. 8226; and WHEREAS, the hour of 7:30 p.m. of this 18th day of February, 1992 in the Council Chambers at City Hall, 70 North First Street, Campbell, California are the time and place set for hearing all persons interested in or having objections to said proposed vacation: and NOW THEREFORE, The City Council of said City of Campbell finds and determines from the evidence submitted that the portion of Central Avenue, a public street in the city of Campbell, hereinafter described, be, and it is hereby, vacated, abandoned and closed to public use as a street, reserving a public utility easement as described in that certain Grant of Easement recorded in Book L346 of Santa Clara County Official Records at page 2022, and that the portion so vacated is described on Exhibit "A" attached hereto and incorporated herein by reference. Council Report Item: ~ Category: Public Hearing Date: February 18, 1992 Title: Public Hearing and Council action on proposed vacation of a portion of Central Avenue (Resolution/Roll Call) RECOMMENDATION Adopt the attached resolution vacating a portion of Central Avenue between Grant Street and the Library lot. DISCUSSION On January 21, 1992 the City Council adopted a Resolution of Intention to vacate the portion of Central Avenue that is presently occupied by the Ainsley House Museum. A copy of the Resolution of Intention is attached for the Council's reference. Staff recommends the City Council order the vacation subject to the retention' of a ten foot easement for public utility facilities. N6 objections to the vacation have been received by the City staff. Subsequent to City Council ordering the vacation, the fee title to the property will revert to the adjacent property owner, which is the City of Campbell. FISCAL IMPACT None Prepared by:~.Tech. Council Report Item: Category: Consent Date: January 21, 1992 Title: Resolution of Intention to Vacate a Portion of Central Avenue (ResoLution/Roll Call) RECOMMENDATION Adopt the attached resolution giving notice of intention to vacate a portion of Central Avenue. DISCUSSION Backqround. In September of 1989, Council received a Feasibility Study for the Resiting of the Ainsley House For Use as the Campbell Historical Museum. The study, prepared by Gilbert Arnold Sanchez Architect Inc., proposed the siting of the Ainsley House directly over the then existing portion of Central Avenue, south of Grant Street. On September 19, 1989, the Council adopted Resolution No. 7823 which formally accepted the Ainsely house and garage for use as a museum. Plans for the relocation of the house and for the site work required at the new location were initiated. In October of 1989, utility companies that had existing facilities within Central Avenue, south of Grant Street, were notified of the future street abandonment due to the relocation of the Ainsley house. The utility companies were asked to relocate their facilities. This process was completed, and the Ainsley House was successfully moved into place on November 18, 1990. Analysis. The existing dedication of Central Avenue south of Grant Street for public street purposes is no longer appropriate since the Ainsley House/Museum occupies this site. The attached resolution of intention to vacate this portion of Central Avenue initiates the process by which the fee title of the property reverts back to the current owner of the adjacent parcel that originally granted the street dedication. In this situation, since the City of Campbell owns both adjacent parcels, the fee title will revert to the City of Campbell. During the week of February 3, 1992, two actions must take place. First, the property to be abandoned will be posted with "Notice of Intent to Abandon" and second, the "Notice of Public Hearing" to consider the adoption of the resolution of vacation will be advertised in the local newspaper. The public hearing to consider the adoption of the resolution of vacation will be scheduled for the February 18, 1992 City Council meeting. Utility companies will also be notified again of the intent to vacate this portion of Central Avenue.
