Would it be appropriate to begin vacation proceedings now? There has been a question on-the timing of the vacation because we believe the street automatically reverts to the adjacent property upon vacation and we don't know who currently owns the easterly side. We have been unable to locate the document that originally created this portion of Central Avenue. We do have two maps that offered to dedicate an apparantly preexisting Central Avenue for all but the southerly forty feet of the west side. Both maps show Central Avenue, 50 feet wide, adjacent to the lots being created. The tract on the east side extends to Campbell Avenue so includes all the frontage to be vacated but the tract on the west side ends about forty feet short of Civic Center Drive though it shows Central Avenue extending to Campbell Avenue. Neither map specifically names Central Avenue in the owners statement. They both use the phrase "...hereby dedicate the streets, roads, alleys and squares as shown on the accompanying map to the use of the public forever." Neither map contains a statement relating to the acceptance of the offers. The easterly side was offered on the "Map of the Subdivision of the Moulton Tract at Campbell" recorded in Book E of Maps at page 133 on February 25, 1892, and the westerly side was offered on the "Map of the Subdivision of the Swope Tract at Campbell" recorded in Book E of Maps at page 106 et seq. on July 1, 1891. Pacific Bell has asked that we grant a seperate easement to them over the same area. Since the previous easement was not an exclusive one we forsee no difficulties and are agreeable to their request. In addition to the. comments on the map the following issues are of concern. This map was prepared before it was decided to vacate Central Avenue. It might be more productive to abandon this map in favor of the one that will be needed to create the site currently proposed. After Central Avenue is vacated, a map that merges this parcel with Central Avenue and a portion of the Police parking lot will be needed. The remainder of the City Hall block will need to be shown on the map as a second parcel. The current map does not show sufficient street width to provide for meandering sidewalks as shown on the architects drawing. Public Works would prefer that the sidewalks be included in the dedicated street right of way rather than as part of the building site. The~e is no record in Public Works or Planning Department that a tentative map was ~yer formally submitted and approved for this proposal. When a tentative map is submitted it should be presented-to the Planning Department rather than the Public Works Department in accordance with the recently implemented procedure change.
