Hedegard Ave.TO BI: RECORDED WITHOUT FLJ~ ~EC:ION 6103 GOVERNMENT CODI' tkt IHE REQUEST OF CiTY OF CAMPBELl, Ci'"v ~OF CAMPBELL ~rth First Street Campbell, California 95008 RESOLUTION NO. 7013 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAHPBELL, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA, VACATING A PORTION OF A PUBLIC SERVICE EASEHENT ACROSS THE WESTERLY PROPERTY LINE OF 1020 HEDEGARD AVENUE WHEREAS subject easement was offered to the public on Tract No. 370 in Santa Clara County and accepted on behalf of the public by the Santa Clara County Board of Supervisors at a meeting of said board on December 1, 1947; and WHEREAS said Tract No. 370 was annexed to the City of Campbell by annexa- tion entitled Latimer 79-12, effective November 1, 1980; and WHEREAS the easement to be vacated is described as: the westerly 10 feet of Lat 4, designated as Public Utility ease- ment, as shown on that certain map entitled Tract No. 370, Campbell Manor, which map was filed in Book 15 of Maps at page 15 in the office of the Recorder of the County of Santa Clara; and WHEREAS the Director of Public Works has recommended that said easement be vacated; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell as follows: SECTION ONE: The City Council elects to proceed in accordance with the pro- visions of Division 9, Part 3, Chapter 4, Section 8333, et sequens, of the Streets and Highways Code. SECTION TWO: The City Council does hereby summarily vacate said public service easement. SECTION THREE: The City Clerk is directed to record a copy of this resolution in the office of the County Recorder. SECTION FOUR: That from and after the date the resolution is recorded the aforesaid ten-foot strip of land no longer constitutes a public easement.
