CC Ordinance 2033 Ordinance No. 2033 BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AMENDING SUBSECTION 7 OF SECTION 3.34.010 OF THE CAMPBELL MUNICIPAL CODE TO CLARIFY THE DEFINITION OF "TRANSIENT. " The City Council of the City of Campbell does ordain as follows: Section One: Subsection 7 of Campbell Municipal Code section 3.34.010 is hereby amended to read: (7) "Transient" means any person who exercises occupancy or is entitled to occupancy by reason of concession, permit, right of access, license or other agreement for a period of thirty consecutive calendar days or less counting portions of calendar days as full days. Any such person so occupying space in a hotel shall be deemed to be a transient until the period of thirty days has expired. After the expiration of the thirty-day period, such person shall prospectively cease to be a transient during any additional consecutive calendar days of such person's occupancy, but such person shall still be considered a transient as to the first thirty days of such person's occupancy. In determining whether a person is a transient, uninterrupted periods of time extending both prior and subsequent to the effective date of the ordinance codified in this chapter may be considered. Section Two: The amendment set forth in Section One of this ordinance is declaratory of existing law, and is not intended to change the law, but is solely for purposes of clarifying the intent of the City Council as to the application of the existing provisions. Section Three: This Ordinance shall become effective thirty days following its passage and adoption and shall be publishesd once with fifteen (15) days upon passage and adoption in the Campbell Express, a newspaper of general circulation in the City of Campbell, County of Santa Clara.
