A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
A WARDING THE CONTRACT FOR THE CONSTRUCTION OF THE HERITAGE
THEA TRE RENOVATION PROJECT 00-02 TO ROBERT A. BOTHMAN, INC. IN THE
AMOUNT OF $5,602,785; ENCUMBERING A CONSTRUCTION CONTINGENCY OF
$945,278; APPROVING A BUDGET ADJUSTMENT AND ASSOCIATED ACTIONS
WHEREAS, bids were received for construction of the Heritage Theatre Renovation
Project 00-02 by the City Clerk on March 28, 2002; and
WHEREAS, Robert A. Bothman, Inc. has been found to be the lowest responsible bidder
with a total bid of $5,602,785, including additive bid alternates 1 through 5; and
WHEREAS, an adjustment to project funding is needed to complete the project as shown
on the source and use of funds spreadsheet; and
WHEREAS, additional design and construction services are desired in order to complete
additional improvements to the Campbell A venue frontage of the Heritage Theatre; and
WHEREAS, C. David Robinson, Architects are currently under contract for
improvements to the Heritage Theatre and possess the unique knowledge and ability to complete
the required additional services; and
WHEREAS, funds are available to include Public Art within the project; and
WHEREAS, proposals for the Sound System Design and Installation and for the
Construction Testing and Specialized Services have been received and reviewed by the Public
Works Department,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby awards the construction contract for the Heritage Theatre Renovation Project (00-02) to
Robert A. Bothman, Inc., in the amount of $5,602,785, authorizes the encumbrance of a
construction contingency of $ 945,278; and approves the attached budget adjustment.
BE IT FURTHER RESOLVED that the City Council of the City of Campbell hereby
authorizes the Public Works Director to take the following actions:
. Execute the construction contract with Robert A. Bothman, Inc. and negotiate and
execute contract change orders up to and within the construction contingency amount;
. Negotiate and execute an amendment to the agreement with C. David Robinson,
Architects for additional design services for the Campbell A venue frontage
improvements and marquee;
. Negotiate and execute an agreement for the Heritage Theatre Sound System design
and construction in an amount not to exceed $250,000 with Pro Media plus a 10%
contingency;
. Negotiate and execute an agreement for Heritage Theatre Construction Testing and
Specialized Inspection Services with a qualified firm in an amount not to exceed
$40,000.
