CC Resolution 10006 RESOLUTION NO. 10006 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AUTHORIZING THE PUBLIC WORKS DIRECTOR TO SUBMIT AN APPLICATION FOR TRANSPORTATION DEVELOPMENT ACT (TDA) FUNDS FOR THE LEIGH A VENUE BIKE LANE PROJECT AND THE CAMPBELL A VENUE UNDERPASS REPLANKING PROJECT WHEREAS, the City of Campbell has the Campbell A venue Underpass Replanking Project (Replanking Project) in its Capital Improvement Program for FiscalYear 2001/02; and WHEREAS, the City of Campbell has guaranteed TDA funds and Measure B SWAP funds available to fund portions of the Replanking Project; and WHEREAS, additional funds for the Replanking Project are needed to fund the design and construction of additional structural supports for the existing cantilevered structure; and WHEREAS, the City of Campbell has $23,773 of guaranteed TDA funds available to fund a portion of the design and construction work associated with the additional structural supports for the Replanking Project; and WHEREAS, the City of Campbell has guaranteed TDA funds available to fund the Leigh A venue Bike Lane Project; and WHEREAS, the Leigh Avenue Bike Lane Project TDA funds will expire in June, 2002; and WHEREAS, rescinding and reallocating the Leigh Avenue Bike Lane Project TDA funds to the same project would allow the City of Campbell to bank these TDA funds for two additional years until June, 2004; and WHEREAS, both the Replanking Project and the Leigh A venue Bike Lane Project have been endorsed by the City Bicycle Advisory Committee; and WHEREAS, the ability to obtain funding approval requires City Council endorsement of the project; and WHEREAS, the Metropolitan Transportation Commission (MTC) requires the City of Campbell to use language from MTC's Model Governing Body Resolution in this resolution to obtain MTC's funding approval; and WHEREAS, MTC requires an Attachment A, "Findings", and an Attachment B, "Project Application"; and WHEREAS, Article 3 of the Transportation Development Act (TDA), Public Utilities Code (PUC) Section 99200 et ~, authorizes the submission of claims to a regional transportation planning agency for the funding of projects exclusively for the benefit and/or use of pedestrians and bicyclists; and WHEREAS, the Metropolitan Transportation Commission (MTC), as the regional transportation planning agency for the San Francisco Bay region, has adopted MTC Resolution No. 875, Revised, entitled "Transportation Development Act, Article 3, Pedestrian/Bicycle Projects," which delineates procedures and criteria for submission of requests for the allocation of "TDA Article 3" funding; and WHEREAS, MTC Resolution No. 875, Revised requires that requests for the allocation of TDA Article 3 funding be submitted as part of a single, countywide coordinated claim from each county in the San Francisco Bay region; and WHEREAS, the City of Campbell desires to submit a request to MTC for the allocation of TDA Article 3 funds to support the projects described in Attachment B to this resolution, which are for the exclusive benefit and/or use of pedestrians and/or bicyclists. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell that the Public Works Director is hereby authorized to submit a TDA grant application for Fiscal Year 2002/03 to the Valley Transportation Authority to obtain additional funds for the Campbell A venue Underpass Replanking Project; BE IT FURTHER RESOLVED by the City Council of the City of Campbell that the Public Works Director is hereby authorized to submit a request to the VT A to rescind and reallocate Fiscal Year 1999/2000 TDA funds from and to the Leigh A venue Bike Lane Project; BE IT FURTHER RESOLVED by the City Council of the City of Campbell that the City of Campbell declares it is eligible to request an allocation of TDA Article 3 funds pursuant to Section 99234 of the Public Utilities Code; BE IT FURTHER RESOLVED by the City Council of the City of Campbell that there is no pending or threatened litigation that might adversely affect the project described in Attachment B to this resolution, or that might impair the ability of the City of Campbell to carry out the project; BE IT FURTHER RESOLVED by the City Council of the City of Campbell that the City of Campbell attests to the accuracy of and approves the statements in Attachment A to this resolution; BE IT FURTHER RESOLVED by the City Council of the City of Campbell that the City shall forward a certified copy of this resolution and its attachments, and any accompanying supporting materials to the Santa Clara County Congestion Management Agency for submission to MTC as part of the countywide coordinated TDA Article 3 claim. Attachment A Re: Request to the Metropolitan Transportation Commission for the Allocation of Fiscal Year 2002/03 Transportation Development Act. Article 3. Pedestrian/Bicycle Project Funding Findings page 1 of 1 1. That the City of Campbell is not legally impeded from submitting a request to the Metropolitan Transportation Commission for the allocation of Transportation Development Act (TDA) Article 3 funds, nor is the City of Campbell legally impeded from undertaking the projects described in "Attachment B" of this resolution. 2. That the City of Campbell has committed adequate staffing resources to complete the projects described on Attachment B. 3. A review of the projects described in Attachment B has resulted in the consideration of all pertinent matters, including those related to environmental and right permits and clearances, attendant to the successful completion of the projects. 4. Issues attendant to securing environmental and right-of-way permits and clearances for the projects described in Attachment B have been reviewed and will be concluded in a manner and on a schedule that will not jeopardize the deadline for the use of the TDA funds being requested. 5. That the projects described in Attachment B comply with the requirements of the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), and that the City of Campbell is in possession of the document(s) supporting such compliance, said document(s) having been made available to for public review and stamped by the County Clerk or County Recorder of the county in which the claimant is located. 6. That as portrayed in the budgetary descriptions of the projects in Attachment B, the sources of funding other than TDA are assured and adequate for completion of the projects. 7. That the projects described in Attachment B are for capital construction and/or design engineering; and/or for the maintenance of a Class I bikeway which is closed to motorized traffic; and/or for the purposes of restriping Class II bicycle lanes; and/or for the development or support of a bicycle safety education program; and/or for the development of a comprehensive bicycle and/or pedestrian facilities plan, and an allocation of TDA Article 3 funding for such a plan has not been received by the City of Campbell within the prior five fiscal years. 8. That the projects described in Attachment B which are bicycle projects have been included in a detailed bicycle circulation element included in an adopted general plan, or included in an adopted comprehensive bikeway plan (such as outlined in Section 2377 of the California Bikeways Act, Streets and Highways Code section 2370 et seq.). 9. That any project described in Attachment B that is a "Class I Bikeway," meets the mandatory minimum safety design criteria published in Chapter 1000 of the California Highway Design Manual. 10. That the projects described in Attachment B are ready to commence implementation during the fiscal year of the requested allocation. 11. Attachment B page_of_ TDA Article 3 Project Application Form Explanatory Comments Page Short Title Description ofProiect: Campbell Avenue Underpass Replanking Enter explanatory comments below, as required due to certain "YES" or "NO" answers to items "A" through "G" on the Project Application Form, or to provide information that will not fit on the application form, or to provide information that will clarify any potential confusion concerning the scope, cost or schedule for the project. Council approval is anticipated on May 7, 2002. Environmental compliance documentation will be completed by May 15, 2002. Project Description: The existing surface on the section of the Los Gatos Creek Trail that passes under Campbell Avenue consists of painted plywood panels placed on top of wood planks that have become warped over time (see project vicinity map and location map). The section length is approximately 460 feet and eight feet wide, and is both curved with grades as high as 7.25 percent. Figure 1 (Project Vicinity Map) and attached Project Location Map show the project location in greater detail. Installation of the plywood was necessary because of the uneven level of the planks, but the plywood has created its own safety problem because the smooth surface becomes slippery when wet. Research by City staff has identified several options for installing planks that will eliminate warping and also minimize the potential for skidding accidents. The project will replace the plywood surface with new planking in order to provide a long-life, low-maintenance surface that also provides for safe usage by pedestrians and bicyclists in all weather conditions. Project Justification: The primary purpose of the project is user safety. The City has received several reports of joggers' falling on the slippery planks and numerous complaints regarding the danger of the smooth plywood surfacen that the surface is particularly slippery in wet weather. Usage of the trail in this section has increased significantly with the installation of a bridge to the south that connects the trail on the west side of Los Gatos Creek to the trail on the east side. Additional usage is anticipated after a major upgrade of Campbell Park has resulted in much higher activity in the project area. Los Gatos Creek Trail, especially in the vicinity of downtown Campbell, is highly multi-user, attracting walkers, joggers, and rollerbladers as well as bicyclists. The recent extension of the trail on the north from Leigh Avenue to Meridian Avenue as well as the construction of the Mozart Avenue Bridge across Highway 17 should increase commuter usage of the trail. In addition, the trail intersects bus routes on Campbell and Hamilton Avenues in the vicinity of the proposed project. Project Cost: The engineer's estimate is $140,000, which includes engineering, removal of the existing surface. and installation of new planks. Revised engineer's estimate reflects additional costs for designing and constructing additional structural supports for existing cantilevered structure. Schedule: The project can be completed within fiscal year 2002/2003 if approved for the current funding cycle. Public Support: The Los Gatos Creek Trail has been strongly supported by the City's Bicycle Advisory Committee as well as the Parks and Recreation Commission and the City Council.
